L REGULAR BOARD MEETING JANUARY 20, 1993 TOHN HALL 7:30 P.M. Present were Councilman Mark H. Flowers, Councilman Don A. Hohlhueter, Councilman Milton I. Hittmeyer, Councilman David G. Ziiiunerman, Supervisor Richard L. Kennedy, Town Attorney Michael F. Perley. Absent: Highway Superintendent Eugene Ruchalski. A motion was made by Councilman Hittmeyer and seconded by Councilman Zimmerman to accept the correction and adoption of the minutes of the January 6, 1993 Regular Town Board Meeting. five (5) Ayes Carried A inotion was made by Supervisor Kennedy and seconded by Councilman Flowers that the General Fund and Special District Bills on Abstract #1 A, dated January 20, 1993 in the amount of $55,924.41 be paid. five (5) Ayes Carried Letter received from Dale M. Volker, N.Y. Senate, supporting funding for the restoration of the Beaver Island Park Casino, received and on file in the Town Clerk's office. Letter received from Dennis Gorski, County Executive in response to Boston's resolution relative to a rabies hotline, received and on file in the Town Clerk's office. Letter received from R.J. Russell, Regional Director, NYS Dept. of Transportation regarding designation of restricted highway, referring to a portion of Route 219 from Route 39 to a point 3,000 feet north of Route 391. Including all intersecting roads and ramps to the limits shown on the contract plans. All in the Towns of Concord and Boston, Erie County, received and on file in the Town Clerk's office. Letter received from Thomas C. Jorling, N.Y. D.E.C, with a Draft New York State Solid Waste Management Plan, 1991/92 Update and Appendices. The 1991/92 Updates contains information as of January 1992 on a number of solid waste management subjects, such as local solid waste management planning and solid waste generation and recycling rates in New York State. Copy of update is available in the Town Clerk's office. Supervisor Kennedy asked Councilman Flowers to inform the Conservation Advisory Council that this is on file, and advise them that they would have access to the copy in the Town Clerk's office. Letter received from David Gaskell, NYS Division of Equalization and Assessment regarding equalization rates in Erie County, received and on file in the Town Clerk's office. Supervisor Kennedy responded that he will meet with Vincent Smith, Property Valuation Bureau Manager. We have received tentative rates and have challenged those rates and as soon as more information is available on a final rate the Town Board will be advised. Councilman Flowers questioned why the Erie County Data file format was not fully compatible with the Real Property Systems format used by the State of New York? Town Assessor Hilliam Kleis responded that the system was changed over from the County to the State before our computer system was installed. Now we are on line with the State. ! .) J

Marshall, Erie County Legislature regarding resolution relative to installment payrnents for property tax collections, received and on file in the Town Clerk's office. Letter received from Bruce H. Hale, National Fuel providing Emergency phone numbers in the event an emergency involving a pipeline of National Fuel Distribution Corporation, received and on file in the Town Clerk's office. Supervisor Kennedy directed the Town Clerk to distribute the emergency phone list from National Fuel to the three (3) Fire Companies, Boston Emergency Squad and the New York State Police- Boston. REQUESTS FROM THE FLOOR Reed Garver, 8353 Lower East Hill Road, inquired as to what the status of reconstruction project of Lower East Hill Road is. Since, he has not heard much about t'ne rebuilding project. Supervisor Kennedy responded that the last information he had on the reconstruction of Lower East Hill Road is that a lot more environmental work is necessary before the project could go forward. He will be in contact with Mr. Gugino to find out what the status is at the current time. Reed Garver: Do you know whether they may have to file an Environmental Impact Statement? I have heard that there has been a change in some of the rating specifications. Supervisor Kennedy: I believe that the on going controversy was, whether in fact, they would be allowed to file an abbreviated Environmental Impact Statement (EIS) or a full blown State Environmental Quality Review (SEQR). I will look into this and let you know at the next meeting. A motion was made by Supervisor Kennedy and seconded by Councilman Hittmeyer to approve payment of medical bills for Joe Gern out of the Risk Retention Fund for injuries sustained during the Triquasquicentennial in the amount of one hundredsixty-five dollars and twenty-three cents ($165.23). five (5) Ayes Carried Rezoning request received from Chester Panek to rezone his property on Feddick Road from R/A to R-2. A motion was made by Supervisor Kennedy and seconded by Councilman Wittmeyer to refer Chester Panek's request to rezone property on Feddick from R/A to R-2 to the Planning Board for review. five (5) Ayes Carried Letter received from Clair Montroy, III, Attorney for Larry Ovitt requesting rezoning of a portion of properties at 5803 and 5805 Herman Hill Road from C-1 to R-2 as outlined on survey. Legislature regarding resolution relative to installment<br />
payrnents for property tax collections, received and on file in<br />
the Town Clerk's office.<br />
Letter received from Bruce H. Hale, National Fuel providing<br />
Emergency phone numbers in the event an emergency involving a<br />
pipeline of National Fuel Distribution Corporation, received and<br />
on file in the Town Clerk's office.<br />
Supervisor Kennedy directed the Town Clerk to distribute the<br />

Reed Garver, 8353 Lower East Hill <strong>Road</strong>, inquired as to what the<br />
status of reconstruction project of Lower East Hill <strong>Road</strong> is.<br />
Since, he has not heard much about t'ne rebuilding project.<br />
Supervisor Kennedy responded that the last information he had on<br />
