REGULAR BOARD MEETING OCTOBER 6, 1993 TOWN HALL 7:30 P.M. A motion was raade by Supervisor Kennedy and seconded by Councilman Wittmeyer to approve the Boston Hills Estates Annual License to expire June 30, 1994. five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilraan Wohlhueter to approve the new lots #7, #9, and #22 at the Boston Hills Estates provided that they are in conforraance with the Code Enforcement Officers inspection, that he be directed to issue Temporary Certificates of Occupancy. When this area is complete there will be more work done on the roadway. five (5) Ayes Carried John and Katherlne Falkides submitted photocopies of a petition with one hundred and seventy-two (172) signatures requesting that the Town Board take the following action: 1) Reduce the Speed Limit on "Boston State Road in vicinity of Boston Hills Estates from 55 mph to 40 mph. 2) Change order to close North entrance to Boston Hills Homes. 3) Eliminate annual fee of $15.00 per home assessed against manufactured horaes in Boston. 4) Elirainate the annual inspection of manufactured housing communities in Boston. Received and on file in the Clerk's Office. Supervisor Kennedy commented that there are a number of items in this petition and would like to give all the Board Merabers an opportunity to review what has been stated in this petition and to respond to them. Councilraan Wittmeyer commented ori the speed limit request, that an extensive study was done on the Boston State Road about five years ago to get the speed limit reduced to 45 mph frora town line to town line. We were denied that at that time. He suggested that maybe we should keep resubmitting this request until it is granted. It takes six months or raore to get a study completed. A raotion was raade by Supervisor Kennedy and seconded by Councilraan Flowers to submit an application to Erie County asking that the speed limit on the areas of Boston State Road that are 55 mph be reduced frora 55 mph to 45 mph. five (5) Ayes Carried Supervisor Kennedy with regards to the other items in the petition the town has to study thera and raake a decision based on what their findings are. There has never been a problera nor would there be a problera with any of the fire corapanies getting down the roadway as it presently exists. These items will have to be thought out and action taken at a later date. REGULAR BOARD MEETING OCTOBER 6, 1993 RESOLUTION 1993 - 39 INTEGRATED WASTE SYSTEM - CONTRACT Letter received from Don Dank. Secretary, Patchin Volunteer Fire Company regardirig the scheduling of town supported or sponsored activities that are scheduled in conflict with other civic organizations, referred to Gerald O'Brien, Recreation Director. A motion was made by Councilman Wohlhueter and seconded by Councilman Ziramerman to authorize Supervisor Kennedy after consultation with the Town Engineer to sign-off on the contractors that have finished their work on the ambulance garage addition in conformance with their contract requirements five (5) Ayes Carried Supervisor Kennedy advised that there were four (4) submissions on the Lango Road v/ater requests for proposals which were very competitive: 1) Klarberg Incorporated $12,140.00 2) Sharco Enterprises 12,875.00 3) Mooney Excavating 12,420.00 4) Nichter Utility Construction Co Inc 16,383.00 A motion was made by Councilman Flowers and seconded by Supervisor Kennedy to award bid for Lango Road Water extension to Mooney Excavating in the amount of $12,420.00. There have been some difficulties with Klarberg Incorporated in the past, and the water district has the opportunity to deduct Mr. Mooney's proportionate share of the extension of the waterline which is a potential immediate recoupment of his share as opposed to a deferred recoupment based upon construction sometirae in the future. five (5) Ayes Carried A motion was raade by Councilman Wittmeyer and seconded by Supervisor Kennedy to reject Mr. Spors Application for Site Plan Review and refer it to Town Attorney Perley for further handling. five (5) Ayes SUPERVISOR REPORT Carried A) Supervisor's Monthly Financial Report for September 1993, received and on file in the Town Clerk's Office. A motion was made by Councilman Flowers and seconded by Supervisor Kennedy to grant permission to Lisa Rood's 4H Club to conduct an Election Day Baked Good Sale in the northern end of the hallway at the Town Hall. five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilraan Wittmeyer to grant an exception to place a manufactured horae of Two thousarid twenty six square feet (2,026 sq. ft.) on lot #5 of the Boston Hills Estate. An additional two feet (2') has already been added to the existing lot line from lot #4 along the entire east side. Lots on both sides are already approved. This will not set a precedent. It does not interfere with the present set-backs on either side, front or rear. five (5) Ayes Carried L J bitf J
