extensive waterline relocations riecessitated by the proflie of the
said Road; and
WHEREAS, With the construction of the Rice Road
Interchange by the State of New York, Boston Cross Road will no
longer function as a County Road since iriter-municipal traffic will
be routed over Boston-Colden Road, which is also a County Road; and
WHEREAS, The County of Erie and the Town of Boston have
entered into negotiations wherein and whereby the County would
reconstruct Boston Cross 6oad to standards acceptable to the Town
of Boston and thereafter the Town of Boston would accept said Road
as a Town Road pursuant to Highway Law § ll5-b; and
NOW THEREFORE, BE IT
RESOLVED: that the Town of Boston herein agrees to accept
Boston Cross Road as a Town Road upon the completion of its
reconstruction by the County of Erie upon the following terms and
conditions:
and be it further
1. That the County of Erie reconstruct Boston Cross
Road along the same profile as set forth in project
number RWP-443-91
2. That the,County of Erie install the drainage system
as originally outlined in the aforesaid project number;
3. That the County of Erie construct a road base and
depth pavement in accordance with the plans and
specifications of the Town and in consultation with the
Town Engirieer at the width and depth and in such manner
as shown on the cross section attached to this Resolution
as Exhibit A and made a part hereof;
4. That the County of Erie relocate any water lines,
within the Boston Cross Road right of way so that same
are situated within the said right of way but not
underneath the paved portion of said Road, at the
County's expense.
RESOLVED: That the Town Board of the Town of Boston urges
the County of Erie to improve Mill street in the Town of Boston
from Boston State Road to Back Creek Road (said road also being
known as part of County Road 543) so that the Town of Boston can
consider acceptance of same as a Town Highway, and be it further
