extensive waterline relocations riecessitated by the proflie of the<br />

said <strong>Road</strong>; and<br />

WHEREAS, With the construction of the Rice <strong>Road</strong><br />

Interchange by the State of New York, Boston Cross <strong>Road</strong> will no<br />

longer function as a County <strong>Road</strong> since iriter-municipal traffic will<br />

be routed over Boston-Colden <strong>Road</strong>, which is also a County <strong>Road</strong>; and<br />

WHEREAS, The County of Erie and the Town of Boston have<br />

entered into negotiations wherein and whereby the County would<br />

reconstruct Boston Cross 6oad to standards acceptable to the Town<br />

of Boston and thereafter the Town of Boston would accept said <strong>Road</strong><br />

as a Town <strong>Road</strong> pursuant to Highway Law § ll5-b; and<br />

NOW THEREFORE, BE IT<br />

RESOLVED: that the Town of Boston herein agrees to accept<br />

Boston Cross <strong>Road</strong> as a Town <strong>Road</strong> upon the completion of its<br />

reconstruction by the County of Erie upon the following terms and<br />

conditions:<br />

and be it further<br />

1. That the County of Erie reconstruct Boston Cross<br />

<strong>Road</strong> along the same profile as set forth in project<br />

number RWP-443-91<br />

2. That the,County of Erie install the drainage system<br />

as originally outlined in the aforesaid project number;<br />

3. That the County of Erie construct a road base and<br />

depth pavement in accordance with the plans and<br />

specifications of the Town and in consultation with the<br />

Town Engirieer at the width and depth and in such manner<br />

as shown on the cross section attached to this Resolution<br />

as Exhibit A and made a part hereof;<br />

4. That the County of Erie relocate any water lines,<br />

within the Boston Cross <strong>Road</strong> right of way so that same<br />

are situated within the said right of way but not<br />

underneath the paved portion of said <strong>Road</strong>, at the<br />

County's expense.<br />

RESOLVED: That the Town Board of the Town of Boston urges<br />

the County of Erie to improve Mill street in the Town of Boston<br />

from Boston State <strong>Road</strong> to Back Creek <strong>Road</strong> (said road also being<br />

known as part of County <strong>Road</strong> 543) so that the Town of Boston can<br />

consider acceptance of same as a Town Highway, and be it further<br />
