At a Regular Meeting of the Town Board of the Town of<br />

Boston, Erie County, New York , held at the Boston Town Hall, 8500<br />

Boston State <strong>Road</strong>, Boston, New York, on the 6th day of October,<br />

1993 at 7:30 o'clock in the evening Eastern Time there were:<br />

councilman Zimmerman presented the following Resolution<br />

and moved its adoption:<br />

WHEREAS, The Boston Cross <strong>Road</strong>, a County road situated<br />

between Boston State <strong>Road</strong> and Boston Colden <strong>Road</strong> in the Town of<br />

Boston, is also known as County <strong>Road</strong> number 443 (CR 443); and<br />

WHEREAS, The County of Erie has undertaken a project to<br />

reconstruct the Boston Cross <strong>Road</strong> at the~County'sexpense for the<br />

continued use of the <strong>Road</strong> as Courity <strong>Road</strong> 443 (or a part thereof) in<br />

the County highway system under project number RWP-443-91; and<br />

WHEREAS, In order to maintain the <strong>Road</strong> as a County <strong>Road</strong>,<br />

the project was required to meet minimum County specifications for<br />

lane width, shoulder width and drainage facilities; and<br />

WHEREAS, The current width and configuration of Boston<br />

Cross <strong>Road</strong> would have to be considerably altered to meet the<br />

minimum County highway specifications and would have resulted in<br />

considerable inconvenience to residents living on the Boston Cross<br />

<strong>Road</strong> and would have further necessitated the relocation of<br />

approximately two thousand seven hundred feet (2700') of water line<br />

at a cost to Boston Water District # 1 of over $130,000.00; and<br />

WHEREAS, The reconstruction of the Boston Cross <strong>Road</strong> to<br />

specifications suitable to the Town of Boston does not require such<br />

extensive increases in width of pavement and shoulder together with<br />
