REGULAR BOARD MEETING<br />

supervisor Kennedy: There definitely is a plan. As soon as a<br />
financing proposal is put together to be presented to the people to<br />
be served ultimately by this new Water District and the cost that<br />
will be incurred. The Bookkeeper has already drawn up and assessed<br />
evaluation of all the properties that would be included within the<br />
area that could be served depending on the size of this tank, which<br />
is under review right now by the Town Engineers. Once that is<br />
determined we can put together the type of package that could be<br />
reviewed by the people in this entire area and a determination will<br />
be made then whether they wish to go forward or not based on the<br />
cost that would- be apportioned to each homeowner.<br />
Bea Bender: This would include the area so called the east hill?<br />
Supervisor Kennedy: We fee! that v/e will be in a position to have<br />
the water up there if fhe people so desire it, at the same time<br />
that the Erie County Water Authority would have their transmission<br />
lines and their pump stations in line in Orchard Park to pump an<br />
adequate supply of water to that elevation.<br />
Bea Bender: If this proposed law would go through and a person<br />
were to dig a well and it is not sufficient.<br />
Supervisor Kennedy: The way this Law would read is that you would<br />
come in and apply for a permit to build. The Board wOuld then ask<br />
the adjoining property owners in that area. Where we know and have<br />
documented evidence that there are extreme problems with water. In<br />
those areas the Board would be reluctant to. grant a permit for<br />
additional dwellings to draw down that water table where we already<br />
know there isn't enough water to accomraodate the people that<br />
already live there.<br />
James Kersten, 6480 Ludon Drive: It seems to rae that you are<br />
opening up a pandora's box with this. The word raoratoriura was used<br />
earlier and the explanation you are giving in effect is alraost<br />
doing the same thing. Providing a moratorium. I don't think that<br />
this is really your intent on building.'<br />
Councilman Flowers: We did not use raoratoriura, simply because it<br />
is not a raoratoriura.<br />
Supervisor Kennedy: It is raore of a restriction than a moratorium.<br />
Resident, Cole / Omphalius: I object to this only because we have<br />
land up there, and who is to say that our land is going to be worth<br />
less than people on the other side of the street? That is<br />
basically what you are saying. Are we going to get a break on our<br />
taxes? I don't think so. I don't see how you can single us out.<br />
I think you have do all of Boston or it just doesn't seem legal.<br />
Madonna Williams 7255 Lower East Hill <strong>Road</strong>: I would like to see<br />
it expanded to include Lower East Hill <strong>Road</strong>. In the thirteen (13)<br />
years since we built a new home there we have taken our well from<br />
forty (40) feet to one hundred (100) feet, we have added a suction<br />
pump. I'm buying water so we have drinking water, and I'm taking<br />
my laundry to a laundromat. We do have a problera, and I think need<br />
to expand what you are doing.<br />
Supervisor Kennedy: If we do create this Water District it would<br />
have the capacity to service Lower East Hill Rd. through Boston to<br />
Colden. I don't know yet which way Colden is going to determine it<br />
is in their best interest to receive the water. If they were to<br />
elect it would be better to receive it through Lower East Hill <strong>Road</strong><br />
they probably would share in those costs. If they go out route<br />
#240 then it would be up to us to construct those lines.<br />
Lisa Rood 8798 Zimmerman <strong>Road</strong>: I inquired about including the west<br />
hill in this law, and Councilman Flowers explained to me that it<br />
had to be a separate law. Now you are talking about modifications.<br />
