REGULAR BOARD MEETING<br />

SEPTEMBER 15, 1993<br />

TOWN HALL<br />

7:30 P.M.<br />

Supervisor Kennedy: Defined the Local Law. Anyone applying for a<br />

building permit in the area described raust corae to the Town Board.<br />

It is reviewed by the Town Board, and the Code Enforcement Officer<br />

no longer has jurisdiction to issue that permit. It would be<br />

issued by Board action. That way the Board could review the<br />

property in question. Talk to the adjoining property owners and<br />

make a determination as to what they thought vias in the best<br />

interest of the people in that particular area.<br />

Glen Orser, 7147 Chestnut Ridge <strong>Road</strong>: I ara also in favor of this<br />

raoratoriura. In a seventeen (17) year period each year we<br />

progressively run out of raore water on a regular basis. A new home<br />

just went in across the street from us and since their well went in<br />

we have gone out about five (5) or six (6) time just in the last<br />

month. I think this is a sraart decision by the Board. Giving an<br />

opportunity to homeowriers to go to the Board with special concerns<br />

and permits is a smart choice, as well to make it a case by case<br />

scenario.<br />

David Gurney, 7052 Chestnut Ridge <strong>Road</strong>: We have a spring across<br />

the road from us and from all reports there has never been a<br />

problem with the water there. This summer we came very close to<br />

running out. The people v?ho have maintained this spring and<br />

property for two (2) generations said that this is the lowest it<br />

has ever been. We are in danger of running out. My wife and<br />

myself are in favor of this law. Thank ybii.<br />

Angelo Bellitiere, 8406 Zimmerman <strong>Road</strong>: The west hill has the same<br />

problem. My question is why are we doing it just for the east<br />

hill? Perhaps we ought to do this for the complete town. The<br />

water on the west hill is deteriorated. We have been running out<br />

of water. There are other neighbors here tonight who can vouch for<br />

me. Thank you.<br />

Supervisor Kennedy: I certainly concur with Mr. Bellitiere in<br />

certain respects, because I know that there are just as many water<br />

problems existing in certain areas of the west hill as presently<br />

exist on the east hill. However, I wouldn't like to have us limit<br />

permits in areas that are served by public water. In those areas<br />

outside of Water District #1 and Water District #2, that's a<br />

possibility that we could restrict. That encompasses a very large<br />

area some of which there are no pronounced water problems. I just<br />

do not want to be to restrictive to people that own property, and<br />

yet I would like to see this Law as has been demonstrated here by<br />

the people speaking on behalf of both hills on the shortage of<br />

water. As already stated by one individual, we have people that<br />

have constructed homes in the $130,000 - 175,000 range and then<br />

drilled the well. We do not have a whole lot of aquifer under the<br />

whole town of Boston, so it cannot be just tapped like that. Maybe<br />

there should be sorae raodification to it. That is why we're here to<br />

hear your thoughts, and we are certainly receptive to thera.<br />

Bea Bender, 7804 Cole <strong>Road</strong>: How did you arrive at singling out the<br />

east hill? The reason I question this is that we have been up<br />

there since the 50's and never ran out of water. Down the road on<br />

Cole <strong>Road</strong> to the south people are out of water all the tirae. Down<br />

further Mr. Arendt has built and sold many lots. Are you going to<br />

say that our area cannot sell lots without the specialties added on<br />

to it, yet people down the road can keep on selling lots, when<br />

their neighbors are out of water and they don't happen to be in the<br />

square that you are singling out? Do you consider that fair?<br />

Supervisor Kennedy: I understand your comraents. Drawing a<br />

geographic area, there is difficulty in that. You are correct,<br />

that is why we are here to hear your comments. Nothing has been<br />

cut in stone on this proposed Local Law.<br />

Bea Bender: Is there a plan for water coming in two (2) years?<br />
