m^^y < TOWN OF BOSTON RESOLUTION 1993 - 3.5 At a Regular Meeting of the Toun Board of the Town of Boston, Erie County, New Vork, held at the Boston Town Hall, 8500 Boston State Road, Boston, New Vork on the 1st day of September at 7:30 P.M. Flowers Supervisor Ccuncilnian Counci iman Councilman CouaciIman The following resolution was offered by Councilman Wohlhueter who moved it2 adoption: VJHEREAS, the Southtowns Solid Waste Board and the Northeast Solid Waste Board have formed together to become the Northeast- Southtowns Solid Waste Management Board (NEST), WHEREAS, the Town of Boston has been a member of Southtown Solid Waste Soard, BE !T RESOLVED, that the Town of Boston join the Northeast- Southtowns Solid Waste Board (NSST), BS IT RESOLVED, that the Town of Boston pay membership dues on an annua) basis to Northeast-Southtowns Solid Waste Management (NEST) at a rate of 3.5 cents per capita based on the 1990 population (7,445), BE IT RESOLVED, that the Town Board cf the Town of Boston appoint two (2) representatives to the Northeast-Southtowns Solid Waste Board. The first representative being Don A. VJohlhueter the alternate being Michael F. Perley terms to expire December 31, 1993, BE IT RESOLVED, that Richard L. Councilman Flowers has received requests from residents of Haag Road about when TV cable service is going to be available. Town Attorney Perley responded that he has called Adelphia Cable and has been informed by them that they are waiting for some final make ready and energization on the poles for the transforraers from the power company. He will call Adelphia Cable regarding this and inform Councilman Flowers. A motion was made by Councilman Flowers that the Town Board should ask Recreation Director, Gerald O'Brien to offer a public apology to Marcia Latosihski for going a bit overboard on his response to a letter that she had written about the hiring practices of the Recreation Department. Motion lost for lack of Second. Supervisor Kennedy: I don't think that he was out of line. I think he tried as best he cdiild to explain why he made the decisions that he made. I am not going to defend Mr. O'Brien. He is certainly capable of defending himself. I am not going to ask for a public apology from Mr. O'Brien. Town Attorney Perley: In raatters of-personnel and disciplinary proceedings the individual that is irivolved has a right to be present. If he was not notified that this issue was on the agenda tonight and given and opportunity to appear, I think it is out of order'to require that. Councilman Flowers: I would like to notify Mr. O'Brien to please be at the next Town Board Meeting so that this matter can be discussed. Councilman Wohlhueter reported that the Northeast Solid Waste Management Board and the Southtown Solid Waste Committee have been meeting jointly and have passed a resolution creating the Northeast-Southtown Solid Waste Management Board. The Northeast- Southtown Solid Waste Management Board will be called NEST and any municipalities in these two regions have to have the Supervisor of the town sign an agreement to become a member of this group. RESOLUTION 1993 - 34 JOINT MUNICIPAL AGREEMENT CREATING NEST Councilman Wohlhueter reminded the people of the Erie County Household Hazardous Waste Drop-off day on Saturday, September 11, 1993 frora 9:00 A.M. till 2:00 P.M. at the Erie County Highway Garage at 8730 Delaraeter Road, Angola, New York. Councilman Wohlhueter asked the people from the news media present to advertise this in their respective papers. Councilman Zimmerman commented that the towns' ambulances are both getting old with a lot of miles on them and are in need of a lot of repairs. He announced that the Emergency Squad has formed a committee and is starting to look for a new arabulances and they are setting up specs so that we could bid for one possibly next year. Supervisor Kennedy responded that he appreciated the fact that Donna Odoj had invited hira over tb look at sorae of the Modular Units they -had borrowed. Certainly this would give him some indication in preparation to set aside some monies in this years budgets. 329! J J

Councilman Flowers has received requests from residents of Haag<br />
<strong>Road</strong> about when TV cable service is going to be available.<br />
Town Attorney Perley responded that he has called Adelphia Cable<br />
and has been informed by them that they are waiting for some final<br />
make ready and energization on the poles for the transforraers from<br />
the power company. He will call Adelphia Cable regarding this and<br />
inform Councilman Flowers.<br />
A motion was made by Councilman Flowers that the Town Board should<br />
