OJ J REGULAR BOARD MEETING SEPTEMBER 1, 1993 REQUESTS FROM FLOOR Nancy Stetter, 5562 James Drive: What is being done with Greg and Julie Dake's rezoning request? At the Public Hearing weren't they in violation of the zoning law by conducting business? Have they applied for a variance? Supervisor Kennedy: What have they done? Town Clerk Shenk: At this point Greg and applied for a variance through ray office. Julie Dake have not Town Attorney Perley suggested that the Code Enforcement Officer go to the Dake property. Supervisor Kennedy: I would suggest that if they have not applied for a variance, and I was under the impression that they had. I also, have been questioned by raerabers of the community. Since they have not done this, I will direct the Code Enforcement Officer to serve the Dake's with a summons, since we have been waiting for his application for a variance. Letter received from Boston Hills Homes & Estates, Re: Anriual License referred to the next Regular Board Meeting September 15, 1993. Supervisor Kennedy commented that the Town Clerk has not been able to locate any documentation showing that a different set of plans have been approved by the Board other than the original plans adopted in July of 1991. A motion was made by Councilman Flowers arid seconded by Councilman Zimmermari to grant the request submitted by Nadine G. Houghton, Operations Officer, Evans National Bank to use the Town Hall building as a backup site in case there is a disaster at the North Boston office. five (5) Ayes Carried A motion was made by Councilman Wittraeyer and seconded by Supervisor Kennedy to refer the Building Permit Application submitted by Loren and Dorothy Bower, 8963 Boston State Road to the Planning Board for review. Also, direct the Town Clerk to contact Code Enforcement Officer Kramer to see if there is any additional information with this application. If not the Code Enforcement Officer should contact Mr. Bowers' prior to the Planriing Board Meeting informing him that this application is incomplete and advise him of what will be required when this application is presented to the Planning Board for review. five (5) Ayes Carried Letter received from Margaret Herron, d/b/a Boston Deli, advising of renewal application for off-premises beer license at 9375 Boston State Road received and on file in the Town Clerk's office. SUPERVISOR REPORT A) Supervisor's Monthly Financial Report for August 1993 received and on file in the Clerk's Office. Supervisor Kennedy received a comraunication from the Department of Environraental Conservation acknowledging receipt of application for suppleraental 1993 National Small Business Tree Planting Program. The Town of Boston's award for five thousand ($5,000) has been selected and forwarded to the SBA for final approval. The calculated match and number of trees for the approved projects are four thousand, one hundred and thirty-one dollars ($4,131) and fifty-three (53) respectively. J J

Letter from Erie County Human Resources, Maureen Fitzpatrick thanking the Town for participating in the 1993 Summer Youth Program. TOWN CLERK REPORT A) Registrar of Vital Statistics Report for August 1993 received and on file in the Clerk's Office. A motion was made by Councilraan Zimmerman and seconded by Councilman Wittraeyer to approve the following Polling Places for 1993: DISTRICT #1 Boston Valley School DISTRICT #2 North Boston Fire Hall DISTRICT #3 Boston Town Hall DISTRICT #4 Catholic Church School DISTRICT #5 Boston Valley School DISTRICT #6 Boston Town Hall DISTRICT #7 North Boston Fire Hall five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilman Zimmerman authorizing the Highway Department to move the Electoral Voting Machines to their respective locatibris on Primary Day September 14th and on General Election Day November 2, 1993. five (5) Ayes Carried HIGHWAY SUPERINTENDENT REPORT Highway Superintendent Ruchalski reported that the CHIPS Program is about 75% done. This year work was done on Hywood Dr and Appletree Rd. The main road program is done. There is still a lot of shoulder work to do on Appletree and Hywood. Extensive pipe work needs to be done on Hywood on the east side of Mayer Road end, also on the Zimmerman Road north side. This should be done by October weather permitting. Brush pickup will begin on Tuesday, September 7th after that the 1st and 3rd Monday of September and October. TOWN ATTORNEY REPORT Town Attorney Perley had a two and a half hour meeting with the Economic Development Coramittee of the Boston Chamber of Commerce. This was a veiry informative meeting. He has been asked by the Chairman of the Committee to address them at a future date with regards to the possibility of forming a Business Iraprovement District under the General Municipal Law. If any member of the Town Board has an objection He will decline to speak because it does carry at least some color of official action from the Board. If there is no objection arrangements will be made with the Chairman of the Chamber to give that address. A deed has been filed for the turn-around on Mr. Bernardi's property on Willow Drive. Also, all of the deeds and easements on the Lango Road Water #1 Project have been filed, that project can now go forward at the convenience of the Board. • vW n •1 I -J J J
