REGULAR BOARD MEETING<br />

SEPTEMBER 1, 1993<br />

REQUESTS FROM FLOOR<br />

Nancy Stetter, 5562 James Drive: What is being done with Greg and<br />

Julie Dake's rezoning request? At the Public Hearing weren't they<br />

in violation of the zoning law by conducting business? Have they<br />

applied for a variance?<br />

Supervisor Kennedy: What have they done?<br />

Town Clerk Shenk: At this point Greg and<br />

applied for a variance through ray office.<br />

Julie Dake have not<br />

Town Attorney Perley suggested that the Code Enforcement Officer go<br />

to the Dake property.<br />

Supervisor Kennedy: I would suggest that if they have not applied<br />

for a variance, and I was under the impression that they had. I<br />

also, have been questioned by raerabers of the community. Since they<br />

have not done this, I will direct the Code Enforcement Officer to<br />

serve the Dake's with a summons, since we have been waiting for his<br />

application for a variance.<br />

Letter received from Boston Hills Homes & Estates, Re: Anriual<br />

License referred to the next Regular Board Meeting September 15,<br />

1993.<br />

Supervisor Kennedy commented that the Town Clerk has not been able<br />

to locate any documentation showing that a different set of plans<br />

have been approved by the Board other than the original plans<br />

adopted in July of 1991.<br />

A motion was made by Councilman Flowers arid seconded by Councilman<br />

Zimmermari to grant the request submitted by Nadine G. Houghton,<br />

Operations Officer, Evans National Bank to use the Town Hall<br />

building as a backup site in case there is a disaster at the North<br />

Boston office.<br />

A motion was made by Councilman Wittraeyer and seconded by<br />

Supervisor Kennedy to refer the Building Permit Application<br />

submitted by Loren and Dorothy Bower, 8963 Boston State <strong>Road</strong> to the<br />

Planning Board for review. Also, direct the Town Clerk to contact<br />

Code Enforcement Officer Kramer to see if there is any additional<br />

information with this application. If not the Code Enforcement<br />

Officer should contact Mr. Bowers' prior to the Planriing Board<br />

Meeting informing him that this application is incomplete and<br />

advise him of what will be required when this application is<br />

presented to the Planning Board for review.<br />

Letter received from Margaret Herron, d/b/a Boston Deli, advising<br />

of renewal application for off-premises beer license at 9375 Boston<br />

State <strong>Road</strong> received and on file in the Town Clerk's office.<br />

SUPERVISOR REPORT<br />

A) Supervisor's Monthly Financial Report for August 1993<br />

received and on file in the Clerk's Office.<br />

Supervisor Kennedy received a comraunication from the Department of<br />

Environraental Conservation acknowledging receipt of application for<br />

suppleraental 1993 National Small Business Tree Planting Program.<br />

The Town of Boston's award for five thousand ($5,000) has been<br />

selected and forwarded to the SBA for final approval. The<br />

calculated match and number of trees for the approved projects are<br />

four thousand, one hundred and thirty-one dollars ($4,131) and<br />

fifty-three (53) respectively.<br />
