Wittraeyer, Supervisor Richard L. Kennedy, Town Attorney Michael F. Perley and Highway Superintendent Eugene E. Ruchalski. A raotion was made was made by Councilraan Wohlhueter and seconded by Councilman Zimmerman to accept the correction and adoption of the minutes of the July 21, 1993 Regular Board Meeting. five (5) Ayes Carried 325 A motion was made by Supervisor Kennedy and seconded by Councilman^*- Wittraeyer that the General Fund and Special District Bills on ^-"^"^^-i y^ Abstract #9 dated September 1, 1993 in the amount of $64,412.97 be paid. ^-J/ five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilman Wittmeyer to accept the correction of Abstract #8 dated August 18, 1993 as follows: Voucher #625 SF 3410.4 Voucher #628 SL 5182.4 GENERAL FUND TOTAL GENERAL FUND TOTAL FIRE PROT. Letter received frora Erie County Commissioner of Personnel Richard Slisz, Re: Amendment to Section 75 (2) of the Civil Service Law referred to the Town Attorney for review. Letter received from Erie County Department of Development and Planning, Re: Southtowns Mobile Social Service Van on file in the Clerk's office. Supervisor Kennedy responded that he would assist the Town Clerk in the completion of questionnaire so that these services can be provided to the people of Boston. Letter received from Erie County Local Emergency Planning Committee, Re: Hazardous Materials Seminar for Public Officials and Emergency Managers - Saturday, September 18, 1993.

Supervisor Kennedy reviewed this letter with Councilman Flowers and asked that if any of the Public Officials are interested in attending this seminar to let him know as soon as possible so reservations can be made. Letter received from Erie County Department of Environment and Planning, Re: The release of ozone depleting chemicals, advising that the final person in the disposal chain is responsible for ensuring that refrigerant is removed from appliances prior to their final disposal. Since each appliance iraproperly disposed of is considered a violation, the fines can be quite high. Supervisor Kennedy has asked Councilman Wohlhueter to arrange a meeting with Mr. Balbierz of BFI for the latter part of September to review this matter. Erie County Water Authority's 1992 Annual Report received and on file in the Clerk's Office. Letter from Suzanne L. Bissonette, Town of Eden Supervisor, Re: Free Rabies Clinic to be held at the Eden Highway Department on Septeraber 23, 1993 between 2 and 4 P.M. A raotion was made by Councilman Wohlhueter and seconded by Councilman Wittmeyer to authorize Supervisor Kennedy to enter into an agreement with the Town of Eden to Co-Sponsor the Free Rabies Clinic. Each town will pay $1.6o/per shot for residents from their respective towns. Shots given to residents not in any of the towns will be split equally. The Town Clerk was directed to install an ad in the Pennysavers that cover the Town of Boston. five (5) Ayes Carried Resolution received from the Orchard Park School District, Re: Partial payment of school taxes received and on file in the Clerk's Office. Resolution received from the Hamburg School District, Re: Partial payment of school taxes received and on file in the Clerk's Office. Letter received from Adelphia Cable regarding_chajiges in cable rates and services effective September 1, 1993 as the result of the new Federal "Cable Act" Legislation passed in 1992, received and on file in the Clerk's Office. Notice of Petition received from New York Telephone Company received and on file in the Town Clerk's Office. Town Attorney Perley commented that the Town has received an Article 7 Petition of the Real Property Tax Law challenging the assessment of New York Telephone property in the Town of Boston. Request for Judicial Intervention from New York State Electric and Gas received and on file in the Clerk's Office. Town Attorney Perley commented that the basis of this challenge is that we should multiply their assessment by the equalization rate. We are going to determine whether or not this is the basis for their challenge throughout the county. If it is, this will present a coramon legal issue among the towns. The towns may look to have one Council represent them, in this instance. Our appearance will be noted and the necessary papers will bs filed to dispute the claim. ..--- uJ J
