REGULAR BOARD MEETING<br />

AUGUST 18, 1993<br />

TOWN ATTORNEY REPORT<br />

TOWN HALL<br />

7:30 P.M.<br />

Town Attorney Perley received a call from some of the residents on<br />

Crestwood Circle, there appears to be some confusion as to the<br />

configuration of Crestwood Circle. Research in the past has<br />

indicated that the records are somewhat scant. He will be meeting<br />

with the residents to try to get all the documents that they have<br />

in their possession. This was brought to his attention by Mrs.<br />

Schmidlin who has a seventy-five foot (75") right-of-v/ay in front<br />

of her house. There is some significant confusion as to how wide<br />

that right-of-way is as you go further south. He feels that this<br />

can be remedied fairly simply.<br />

He has been invited to attend a raeeting of the Economic Development<br />

Committee of the Chamber of Commerce on August 25, 1993 at 8:30<br />

A.M.<br />

Town Attorney Perley attended the first meeting of the Comjmittee<br />

that is looking into the design of the addition with the architect.<br />

We expect that tentative cost estimates may be available sometime<br />

next week.<br />

Town Attorney Perley will be attending a meeting on August 19, 1993<br />

in the Supervisors' office with Mr. Gugino regarding <strong>Dunn</strong> <strong>Road</strong><br />

Qualified Abandonment application.<br />

COUNCILMEN REPORT<br />

Councilman Flowers presented the Board with Local Law #1 - 1993.<br />

The title being Local Law to Amend Local Law #3 - 1987 entitled<br />

"Fire Prevention and Building Code Administratiori," which<br />

amendment pertains to requiring Town Board approval for the<br />

issuance of any permit to construct dwellings on certain property<br />

in the north east section of the Town of Boston having frontage on<br />

portions of Herman Hill, Ward, Cole, Omphalius, Boston State and<br />

South Abbott <strong>Road</strong>s in the Town of Boston.<br />

Supervisor Kennedy asked if geographic description could be changed<br />

to more clearly define the boundaries? Since this restriction<br />

should be applicable to both sides of road.<br />

Town Attorney Perley said that he could alter this description.<br />

Supervisor Kennedy asked that to insure proper publication of this<br />

Public Hearing signs be appropriately placed so that all the<br />

residents will be adequately informed. He will direct the signs to<br />

be made.<br />

A motion was made by Councilman Flowers and seconded by Supervisor<br />

Kennedy to schedule a Public Hearing for Local Law #1 - 1993 on<br />

Wednesday, September 15, 1993 at 8:00 P.M.<br />

Councilman Flowers reported that the Southtowns Haz/Mat Team was<br />

awarded a $12,500 grant through the work of Assemblyman Graber.<br />

In the August 4th Environmental News Bulletin there a number of<br />

items that impact the Town of Boston. They are all excavation or<br />

removal permits:<br />

National Fuel wants to excavate broken shale from the<br />

bottom of Eighteen Mile Creek to prevent flooding in<br />

their supply line on the southside of Back Creek <strong>Road</strong><br />

at 8073.<br />
