Received from Nev; York Telephone a copy of petition of Special Franchise Assessment for 1993 on file in the Clerk's Office. RESOLUTION 1993 - 33 ADDITIONAL STREET LIGHTING TOWN PARK LANE Letter received frora Leonard Saniewski, Erie County Department of Public Works Division of Highways, Re: Designation of Restricted Highways - Old Lower East Hill Road and Lower East Hill Road on file in Clerk's Office, Letter from R»J. Russell, N.Y.S.D.O.T, Re: Designation of Restricted Highway - U.S. Route 219 at Concord Road ending 4,500 feet north of the Rice Hill Road interchange in the Town of Boston, on file in the Clerk's Office. Supervisor Kennedy had a Bid Proposal prepared by Company regarding Roofing Repairs for the Town Hall. Garland and The following Roofing Repairs Bid Sheets v/ere sent to six separate contractors along with a letter asking thera if they wished to participate in a walk-through: 1. Corapletely remove existing BUR insulation and Flashing, install new insulation and HPR Stress Ply roof assembly. Price to include all necessary labor, materials, insurance and taxes. All work to be completed by October 31, 1993. 2. Add to base price the amount necessary to re-shingle entire building per specifications. Roofing Bids were received from the following contractors: Company: Item #1 Item #2 Carmody Roofing & Sheet Metal Co Inc. $10,900.00 $ 5,300.00 Joseph E. Neubert Roofing Inc. 12,242.00 5,550.00 Jeraco Roofing Co., Inc. 13,665.00 5,880.00 Grove Roofing Co., Inc. 22,000.00 16,375.00 Councilman Flov/ers asked that a Bid Bond or a Performance Bond be required. A raotion was made by Supervisor Kennedy and seconded by Councilraan Zimmerman to authorize the Supervisor to accept the Bid Proposal by Carmody Roofing & Sheet Metal Co., Inc. in the amount of sixteen thousand, two hundred dollars ($16,200.00) with some written assurances and some documentation that would protect the tov/n should a problem arise. five (5) Ayes Carried A motion was raade by Councilman Wohlhueter and seconded by Supervisor Kennedy to approve the Towns share of expenditures for the installation fencing at the Tov;n Park and the South Boston Park in the araount of One thousand, nine hundred-sixty-six dollars ($1,966.00). five (5) Ayes Carried ^/f-^SS5 A motion was made by Supervisor Kennedy and seconded by Councilman Wohlhueter to approve William Kleis, Assessor to attend the N.Y.S. A motion was made by Councilman Flowers and seconded by Councilman Zimmerman to transfer General Funds as follows: FROM: 1910.4 1910.4 TO: 7110.2 1940.4 $10,000 5,201 five (5) Ayes Carried Petition received from residents of the Boston Hills Homes and Boston Hills Estates containing thirty-five (35) signatures opposing the closing of the entrance at the north end of the park on file in the Clerk's Office. Supervisor Kerinedy asked Councilman wittmeyer to read a letter received from Erie County D.O.T. Councilman Wittmeyer read a letter received from Mr. Sickler, Erie County D.O.T. dated February 26, 1993, Re: Site Plan Change Boston State Road Boston Hilis Estates North Road Entrance. Councilman Wittraeyer commented that at the February Town Board Meeting this letter was read and Mr. Falkides replied that he would close the road. Supervisor Kennedy responded that he respects the request of the residents that the roadway remain open. However, the plans and docuraents that were submitted to the Planning Board, that were duly approved, are the way that this park must be built. This entrance is not suppose to be there. Town Attorney Perley responded that it is a matter of County jurisdiction as to whether or not this road remains. Town Clerk Shenk read a letter dated August 15, 1993 from John Falkides stating that a cable barricade on the North Road entrance of Boston Hills Homes had beeri installed. If you review the approved site plans, you will find it specifies a "beam or cable guard rail barricade". Enclosed with this letter vias a copy of a revised site plan for Boston Hills Estates, specifying the changes approved by the Town Board in December 1992. Supervisor Kennedy stated that he could not find on his copy of the map where it says cable guard rail barricade. The Supervisor will review the new raap. A raotion was made by Councilman Flowers and seconded by Supervisor Kennedy to extend the Boston Hills Homes and Estates Annual License until September 15, 1993. five (5) Ayes Carried Town Attorney Perley received a telephone call from Mr. Sprague, Sprague Mobile Home Park at which time he was advised that a ninety (90) day notice had been served on the substandard trailer in his park as of August 1, 1993, which at the expiration of that time, the trailer is to be removed. Town Attorney perley advised Mr. Sprague, that this was a Board matter not something that he could approve and would report this to the Board. supervisor Kennedy commented that Mr. Sprague has also been asked to make the roadway dust free. The Supervisor will ask Mr. Sprague to provide written documentation that he has, in fact, taken action against the tenant who we feel is improperly there with a smaller unit than what is allowed under the Mobile Home Ordinance. A motion was made by Supervisor Kennedy and seconded by Councilman Flowers to extend Sprague Mobile Home Park Annual License until September 15, 1993 provided written documentation is submitted that action has been taken against the tenant who we feel is improperly IJ "1 /
