Peter Schreier, 7643 Back Creek <strong>Road</strong>: I have concerns about the<br />
rezoning and questions that I hope can be ansv/ered. Hr. Dake is<br />
this a two (2) person operation or do you have other employoes on<br />
site who are helping to split and cut wood?<br />

Peter Schreier: Town Board, after reading the recommendation from<br />
the Planning Board on of which was a two (2) year limit, if this is<br />
approved what happens after the two (2) year limit, will it be<br />
automatically renewed, up for review or how is that handled?<br />
Supervisor Kennedy: When the Planning Board made their<br />
recommendation they were under the impression that you could grant<br />
a "Special Use Permit" established under certain co.iditions and<br />
they listed the conditions that thought would be imposed if in fact<br />
this operation were to continue. ' It was the consensus of the" Town<br />
Attorney after receipt of this letter froin the Planning Board that<br />
"Special Use Permits" are only utilized in the Town of Boston for<br />
certain applied applications. V'v'e returned this application to the<br />
Planning Board indicating that it was our understanding from<br />
consultations with Legal Council that it did not come under the<br />
framework of a "Special Use Permit" and the only way that this<br />
operation could continue was if the property were rezoned.<br />
Peter Schreier:<br />

If it is rezoned there will be no time limitation<br />
Supervisor Kennedy: No there would not be. A.ad it covers a<br />
multitude of other operations also that would be included under<br />
this M-1 zoning.<br />
Peter Schreier: I certainly have empathy for the Dake's based on<br />
the economic situation from 1987, is there a time limit v;here you<br />
can foresee that you will have repurchased the property and then<br />
ceased this extended operation?<br />
Greg Dake: That v/ill be fourteen (14) years frora nov/.<br />
Peter Schreier: In the environmental assessment I read that you<br />
already have a D.E.C. permit for graveling in eighteen r.iie creek.<br />
To v/hat extent does this affect the lumbering or for what purpose<br />
is that permit?<br />
Greg Dake: That permit allows me to when I v/ish to take gravel<br />
from the creek bed. We don't use it very often. That has nothing<br />
to do with this.<br />
Peter Schreier: In the last couple of weeks I have looked around<br />
Boston and agree v/ith some of my neighbors that there are other<br />
properties in commercial zoning that are available for sale in the<br />
Tov/n of Boston. Living in a residential area I have concerns for<br />
the safety of the neighborhood and the children. It is a jogging<br />
path, bicycle and v/alking path for kids. There is a huge inpact of<br />
pedestrians on that road because of the playgrounds and the nature<br />
of it being an off commercial type of use. I have great concern of<br />
someone being injured. Finally, I have fear that if you make an<br />
exception you are opening up a pandoras' box and I v/orr-/ about<br />
that.<br />
My recommendation would be that the Dake's continue the business,<br />
but in a zoned area that v/ould allov/ it and not to expose the Tov/n<br />
of Boston to continue their open zoning changes- Thank you.<br />
