I L r L BE IT FURTHER RESOLVED, that the extension to Water District No. 1 as proposed in said Petition be approved and constructed and service provided in accordance with this Resolution, and that such extension shall be designated and known as Water District No. 1 of the Town of Boston - Lango Road Extension fl} and BE IT FURTHER RESOLVEO, that the property described on Exhibit A, attached hereto and made a part hereof, be and the same is hereby annexed to §Water District JNo. 1 of the Town of Boston under the name of and title "Water District No. 1 of the Town of Boston - Lango Extension #1"; and BE IT FURTHER RESOLVED, that the proportionate share of the cost of preparing the Plans and Specifications, and in constructing and installing v.'ater service to the property included within the above-described extension, including an allowance to the Town of Boston for the services of the Town Attorney in connection with this application, shall be borne by the owners thereof as set forth in their Petition and as further set forth in the separate agreements dated June 3, 1993, by and among each Petitioner, the Town of Boston New York and Water District No. l of the Town of Boston; and BE IT FURTHER RESOLVED, that the cost of purchasing, installing and maintaining of the fire hydrant to serve the annexed property shall be borne by the Town of Boston Fire Protection District; and BE IT FURTHER RESOLVED, That the annexation of the property, described on the attached Exhibit A, be and the same is subject to a Permissive Referendum as provided by law; and BE IT FURTHER RESOLVED, that the Town Clerk of the Town of Boston shall, within ten (10) days after adoption of this Resolution, file Certified Copies thereof , in duplicate at the New York State Department of Audit and Control in Albany, New York. Oi a REGULAR BOARD MEETING JULY 21, 1993 George Novak, 7728 Back Creek Road: . I am against the change in the zoning. Back Creek Road was originally R-1, residential area. I bought under those pretenses and have lived there for thirty-five (35) years very happily I am against changing the ordinance, because it would depreciate property, and that would cost us money. If a variance is given the noise will increase. Most importantly, it will affect the safety. If you are going to change the ordinance than you should change the entire road of Back Creek. I am sure that an operation such as this could be done at another location where there is ordinances past for commercial areas. The neighborhood values, safety and noise levels, I think this should be denied. Thank You. John Pavlovic, 5571 John's Terrace: I am raostly concerned with safety. Has anyone looked at the shoulder of the road a quarter raile each way in regards to the Dake residence? In some places the shoulder of the road is about eighteen (18") inches wide. My concern,is that I have young children that are going from Old Orchard Drive to the Playground and the other way to the Town Hall. Has anyone looked at the width of the logging trucks? Does anyone know the weight of a truck coming in with a full load of logs? That would be my concern. Back Creek Road you can't pass from one side to the other. I have a strong concern for my children riding bicycles with these logging trucks. It is not inconceivable that something could happen with these logs. I am glad to see that the property has been cleaned up and that was one of ray concerns also. I hope that soraebody would look at the safety aspect of this. I would like to go on record as not in favor. Thank you. Ceil Novak, 7728 Back Creek Road: I would like to go on record as not in favor. Supervisor Kennedy: The Board had made no recommendations to Mr. Dake prior to this hearing. We are concerned that this would constitute spot zoning. Therefore, we are apprehensive and we have come here tonight to hear your comments also.
