maintaining a fire hydrant, if required, which said cost will be<br />

borne by the Town of Boston Fire Protection District; and<br />

WHEREAS, the proportionate share to each Petitioner and<br />

the manner of payment of said cost is contained in certain<br />

Agreements executed by and among each Petitioner, the Town of<br />

Boston, New York arid Water District No. 1 of the Town of Boston,<br />

which said agreements are dated June 3, 1993 and filed with the<br />

Town Board; and<br />

WHEREAS, the engineering firm of Nussbaumer & Clarke,<br />

Inc. has prepared plans, specifications and cost estifnates for the<br />

extension of the water line to serve the annexed property; and<br />

WHEREAS, the Town Board of the Town of Boston duly<br />

adopted an Order reciting the filing of said Petition, the<br />

improvements proposed, the boundaries of said extension to Water<br />

District No. 1, specifying July 21, 1993 at 7:45 P.M. in the<br />

evening of said date in the Boston Town Hall as the place where<br />

said Board would hear all persons interested in the subject thereof<br />

and concerning the same; and<br />

WHEREAS, a Public Hearing was held in the Town Hall of<br />

the Town of Boston, 8500 Boston State <strong>Road</strong>, on the 21st day of<br />

July, at 7:45 P.M. to consider said Petition and to hear all<br />

persons interested in the subject thereof and all persons<br />

interested were heard.<br />

NOH THEREFORE, BE IT RESOLVED,<br />

That the Town of Boston herein determines by this<br />

Resolution:<br />

1. That the Notice of Hearing v/as published and<br />

posted as required by law and is otherwise<br />

sufficient; and<br />

2. That the property and property owners within<br />

the proposed extension are benefitted thereby;<br />

and<br />

3. That all the property owners benefitted are<br />

included within the limits of the proposed<br />

District extension; and<br />

That the extension of Water District No.<br />

in the public's interest; and<br />

1 is<br />

That the Petition is signed, acknowledged or<br />

proved as provided by law and is otherwise<br />

sufficient; and<br />
