REGULAR BOARD MEETING<br />

JULY 21, 1993<br />

this resolution is passed the deecls and the rights-of-way will be<br />

filed and the project will be let for construction. The petition<br />

recites that the agreeraents which define these contributions are<br />

the final documents to define those contributions. We will not ask<br />

any of the property owners for any additional contribution for the<br />

extension of the line other than what has been recited in the<br />

agreements. However, they will then become members of the<br />

district subject to all the district taxes and subject to aill the<br />

usage fees from the Erie County Water Authority.<br />

A motion was made by Supervisor Kennedy and seconded by Councilman<br />

Wittmeyer to close the Public Hearing on the Lango <strong>Road</strong> Water<br />

Extension #1 Water District #1 at 8:00 P.M.<br />

RESOLUTION 1993-29 LANGO ROAD WATER EXTENSION #1 HATER<br />

DISTRICT #1<br />

At 8:00 P.M. a Public Hearing was held<br />

regarding the Rezoning of the property<br />

at 7825 Back Creek <strong>Road</strong> which is<br />

currently zone Single-family Residential<br />

(R-2) to Industrial Park Research and<br />

Development District (H-1). Town Clerk<br />

Shenk read the Legal Notice a Letter of<br />

Intent for Rezoning and a Letter from<br />

Greg and Julie Dake describing the on site<br />

activities and also a letter describing<br />

the relationship between Robert Evahs and<br />

Greg Dake. Notices were sent to thirty-one<br />

(31) property owners in the area and a<br />

Commercial Zoning Application Pending<br />

sign was placed on the property.<br />

Supervisor Kennedy convened the Public<br />

Hearing.<br />

Dolores Seufert, 7566 Back Creek Rd.:<br />

This is a residential area a while ago<br />

you changed a residential area to business.<br />

I have been at peoples houses when the<br />

saws have been in use and the noise is<br />

absolutely terrible. The logs are delivered<br />

on big trucks. If you went and changed his<br />

then other business people in the area<br />

should have the same. There is plenty<br />

of property outside of Boston if you<br />

want to have a saw mill. I'm not against<br />

anybody making a living, but I don't see<br />

why Back Creek <strong>Road</strong> should be a business<br />

area. It never was intended for that.<br />

I am against zoning and I hope that you<br />

people in office are not going to change<br />

Back Creek <strong>Road</strong> and make a business out<br />

of it. It is really a residential area.<br />

This is a residential area. We moved<br />

out to Boston because it was nice and<br />

peaceful. I'm totally against a chainsaw<br />

buzzing all day long. I noticed<br />

that when it started that it got a<br />

lot noisier, there are big trucks up<br />

and down the road. I am totally against<br />

this.<br />
