REGULAR BOARD MEETING TOWN HALL<br />

JULY 21, 1993 7:30 P.M.<br />

Town Attorney Perley presented<br />

a map of the area to those<br />

present defining the area<br />

included within the water<br />

district showing that a<br />

certain area of Lango <strong>Road</strong><br />

which was outside of the water<br />

district. Advising that the<br />

town wanted to extend the line<br />

for the benefit of the Coakleys'<br />

and the Helmbrechts'. Indicating<br />

that specific authority was given<br />

from the Water Authority to extend<br />

this line as a six (6) inch line<br />

and not as an eight (8) inch line.<br />

Agreements were entered into with<br />

all the owners in the district to<br />

extend the district to encompass<br />

the Taylor, Taylor-Roehling Property,<br />

the Mooney property, Helmbrecht and<br />

Coakley.<br />

The agreements breakdown<br />

into four (4) separate agreements<br />

as follow:<br />

1) Taylor and Taylor-Roehling<br />

agreeraent recites the fact that<br />

they have been paying taxes all<br />

along and as a result it was a<br />

determination of the Board that<br />

they should not be required to<br />

pay any money in order to tap in.<br />

They in fact, have been paying.<br />

(2 &3) with regards to Helmbrecht<br />

and Coakley the Town of Boston<br />

would accept title to a certain<br />

property for a turn-around as well<br />

as certain rights-of-way so that<br />

they could install the water line,<br />

in exchange for their portion of<br />

the extension of the water line.<br />

The Town of Boston will then<br />

reimburse the district Fair Market<br />

Value or an agreed upon amount in<br />

exchange. The district is going to<br />

pay for the waterline but the Tov/n<br />

receives the benefit of the property.<br />

(4) Mr. Mooney entered into an<br />

agreeraent to pay a 25% share of the<br />

cost of the development of this<br />

property plus give the Town a<br />

right-of-way. Mr. Mooney's<br />

agreement calls for hira to pay<br />

for it at any tirae when he taps<br />

in (this property is presently<br />

undeveloped) or since Mr. Mooney<br />

is a contractor, to make an<br />

appropriate reduction in the net<br />

amount due on a bill if, in fact,<br />

he is a successful bidder for<br />

the project to accomplish the<br />

same 25% contribution. All of<br />

those agreements are signed. The<br />

deeds that reflect the conveyance<br />
