JUNE 2, 1993<br />

TOWN HALL<br />

7:30 P.M.<br />

A motion was made by Councilman Zimmerman and seconded by<br />

Councilman Wohlhueter to accept the Tax Collector's report for Hay<br />

1993.<br />

five (5) Ayes Carried<br />

A motion was made by Councilman Wohlhueter and seconded by<br />

Councilman Zimmerman to grant the request of Hrs. Jeffrey<br />

Praczkejlo to use the Town Park and Lions Shelter for an 80th<br />

Birthday Party on Saturday, August 14, 1993, no alcohol will be<br />

served.<br />

HIGHWAY SUPERINTENDENT'S REPORT<br />

Carried<br />

Highway Superintendent Ruchalski asked the Town Board for<br />

authorization to purchase a twenty (20) ton trailer, air brakes,<br />

complete twenty-four (24) foot overall for $9,195.00 frcr> Mecca-<br />

Kendall, Inc. There is money in the Equipment Fund to pay for this.<br />

A motion was made by Councilman Wittmeyer and seconded by<br />

Supervisor Kennedy to authorize Highway Superintendent Ruchalski<br />

permission to purchase a twenty (20) ton trailer at a price of<br />

$9,195.00 from Mecca-Kendall, Inc.<br />

five (5) Ayes Carried<br />

Highway Superintendent Ruchalski thanked the Town Board for<br />

approving the Mutual Aid Agreement between the Towns as we had to<br />

use equipment and service from the Town on Eden.<br />

Supervisor Kennedy directed the Town Clerk to draft a letter of<br />

thanks to the Town of Eden Highway Department for the use of their<br />

equipment.<br />

TOHN ATTORNEY'S REPORT<br />

Town Attorney Perley reported that he had heard from Councilman<br />

Zimmerraan and received other phone calls from residents of Rockwood<br />

<strong>Road</strong> indicating that cable is being installed as well as on Haag<br />

and Enser <strong>Road</strong>s. On Rockwood <strong>Road</strong> the poles on which Adelphia is<br />

attaching the lines in some areas are very widely spaced and there<br />

is an extreme droop in the lines and he has received complaints<br />

from the neighbors. He has asked the General Manager of Adelphia<br />

to request that the survey crews do something to elevate thesje<br />

lines and get the sag out. He will keep the Town Board and the<br />

residents informed.<br />

COUNCILMEN REPORT<br />

Councilraan Flowers directed this question to the Town Attorney.<br />

It was brought to ray attention that the specification in the Cold<br />

Springs Construction contract had been waived for a particular fill<br />

and now it is ok to take the fill off the Bonerb property. If the<br />

fill is taken off the Bonerb property which is going to come to<br />

approximately 300,000 yards, do they have to go through the process<br />

of a Soil Removal Permit, Public Hearing and Site Plan Review?<br />

Town Attorney Perley responded: I hesitate to comment on that as<br />

Hr, Bonerb has been a client of mine. However, I can only tell you<br />

this the fill that is being removed is not virgin fill. It is fill<br />

from the 219. In a situation where fill has been stored, it is not<br />

naturally occurring soil and it is not subject to the permit<br />

requirements. This is transported fill from a contract. Direct<br />

your question to Deputy Town Attorney Wilson with reference to this<br />
