L REGULAR BOARD HEETING JUNE 2, 1993 REOUESTS FROM THE FLOOR Kay Falkides, Boston Hills Estates Owner: Is there anything that the town can do with regards to the neighbors of the property next to the Boston Hills Estates who are speeding on a dirt road next to the development raising a lot of dust? We spoke to Hr. Logel and he responded, "That's just too bad." Supervisor Kennedy: Are these people dumping in this area? Kay Falkides: I asked what they are doing and their response was "We are dumping, this is our land we can do whatever we v/ant." I don't know what they are doing back there. Supervisor Kennedy will draft a letter to Hr. Logel regarding this matter. Also, Code Enforcement Kramer will be notified of this situation. John Falkides: There is a semi-trailer at the end of Willow Dr. is it suppose to be there, isn't this wrong? Supervisor Kennedy: We are aware of some abandoned cars as well as the trailer that you refer to. The Code Enforcement Officer has given^a directive to the property owner as far as cleaning this area up. This matter will be followed up. Supervisor Kennedy addressed Mr. Falkides about the previously requested updated survey that the Town Board had asked for of the updated version of the layout of the Hobile Home Park. Also, that he was going to close off the north roadway. To date you have not responded. John Falkides: We have instructed our contractor to close this road off. There is going to be a solid steel barricade put in place. The contractor is trying to match other guard rails that we currently have in place. A motion was made by Councilman Wohlhueter and seconded by Councilman Zimmerman to set the summer Town Board schedule for the months of July and August as follows: Agenda Review Town Board Meeting Monday Wednesday July 19, 1993 August 16, 1993 July 21, 1993 August 18, 1993 7:00 P.M. 7:00 P.M. 7:30 P.M. 7:30 P.M. five (5) Ayes Carried Letter received from Richard Slater, 6375 Tillen Road questioning the potential problems affecting the temperamental water supply as the new West Hill Road is excavated. He questioned if they are protected by the State if they lose their water. Supervisor Kennedy will contact Mr. Forrestal of Cold Springs Construction and a representative of the D.O.T. asking that they investigate Mr. Slater's complaint. Councilman Flowers also had an inquiry from a resident in this area. After contacting the D.E.C. regarding the excavation procedure he was advised that this process was within the guidelines of the D.E.C. Town Attorney Perley responded that unfortunately the Town cannot do anything directly to remedy this problem. This is a D.O.T. project. The state is a superior municipal entity and has jurisdiction. L ] REGULAR BOARD MEETING JUNE 2, 1993 TOWN HALL 7:30 P.M. Supervisor Kennedy directed the Town Clerk to draft a letter to the owners of the Boston Hills Estates and Sprague Hobile Home Park respectively informing them of the dates set for the Annual Hobile Home Park License Inspection by members of the Town Board as follows: Sprague Hobile Home Park Honday June 14, 1993 6:45 P.H. Boston Hills Estates Tuesday June 15, 1993 6:45 P.M. A motion was made by Supervisor Kennedy and seconded by Councilman Flowers to issue a Temporary Certificate of Occupancy to the Boston Hills Estates Lot #15 and #16, contingent upon a report from Code Enforcement Officer Dennis Kramer. Councilman Zimmerman has a problem voting for this sirice we have been waiting five to six months to get the north road closed, and three or four months for the updated survey. Councilman Flowers Councilman Wohlhueter Councilman Zimmerman Councilman Wittmeyer Supervisor Kennedy Voting Voting Voting Voting Voting Aye Aye Nay Aye Aye four (4) Ayes one (1) Nay Carried A motion was made by Supervisor Kennedy and seconded by Councilraan Wittmeyer to approve a change order in the amount of $7,180.00 to re-roof the entire roof on the ambulance garage at the recommendation of the Capitol Improvements Committee. five (5) Ayes Carried A motion was made by Councilman Flowers, with no second, to grant Charlap's Dairy a Building Permit for an 8'x 14' storage tank with a 6' fence and leave out the flower box in front of the fence. Supervisor Kennedy after hearing much discussion would like to confer with Mr. Charlap to see if it is imperative that this project be done by a certain date. If Mr. Charlap wishes to amend his application, as indicated to Herb Klein on Memorial Day, then Supervisor Kennedy would be receptive to tabling this until the next Board meeting. If in fact Mr. Charlap needs this permit within the next few days Supervisor Kennedy would poll the Town Board Members into a meeting. notion withdrawn by Councilman Flowers. After much discussion it was the consensus of the Board not to make a decision until Hr. Charlap has had an opportunity to clarify what he is asking for on this application. A motion was made by Supervisor Kennedy and seconded by Councilraan Flowers to table the Charlap Dairy's Building Permit until the next Town Board Heeting on June 16, 1993. five (5) Ayes Carried Letter from Boston Planning Board recommending a Special Perrait be granted to Greg and Julie Dake to conduct a firewood processing operation at 7825 Back Creek Road with contingencies as outlined on file in the Clerk's Office. Supervisor Kennedy responded to this letter recomraending that a Special Permit be granted which is not allowable under the current zoning. 28T
