• ^ REGULAR BOARD MEETING JANUARY 6, 1993 TOHN HALL 7:30 P.M. Present were Councilman Mark H. Flowers, Councilman Don A. Hohlhueter, Councilman Milton I. Hittmeyer, Councilman David G. Zimmerman, Supervisor Richard L. Kennedy, Town Attorney Michael F. Perley, Highway Superintendent Eugene Ruchalski. A motion was made by Councilman Hittmeyer and seconded by Supervisor Kennedy to accept the corrections and adoption of the minutes of the December 31, 1992 Special Board Meeting. five (5) Ayes Carried A motion was made by Councilman Zinunerman and seconded by Councilman Hohlhueter that the General Fund and Special District Bills on Abstract #1, dated January 6, 1993 in the amount of $43,697.46 be paid. five (5) Ayes Carried A motion was made by Councilman Hittmeyer and seconded by Councilman Flowers that the Highway Bills on Abstract #1, dated January 6, 1993 in the amount of $6,939.25 be paid. five (5) Ayes Carried A motion was made by Councilman Hohlhueter and seconded by Councilman Zimmerman to accept the Town Clerk's Monthly report for December 1992. five (5) Ayes Carried Received application from National Fuel for Annual Blanket Permit covering all excavation work performed on the Town of Boston's public places and rights-of way during the year 1993. Town Attorney Perley asked that the if the Town Board is inclined to grant a permit to send National Fuel the towns form which contains other specific information that is not contained here so that we have a proper form on file with the information that the Town Board in adopting that form has determined that it wants. Supervisor Kennedy directed Town Clerk Shenk to forward National Fuel Gas the proper application form asking for the opportunity to open cut roads, etc. within the Town of Boston, under emergency situations, that they use the form that is properly utilized by the community. Action will be taken at the next Town Board Meeting on Wednesday, January 20, 1993. Resolution received from the Town of Orchard Park, Re: University Games, received and on file in the Town Clerk's Office. Received a franchise check from Adelphia Cable in the amount of $690.08. This check represents payment for the amount deducted in error from the last franchise fee payment for the New York State Cable Commission for the period from April 1 through September 30, 1992. Supervisor Kennedy applauded Town Attorney Perley for following up on this matter. Letter received from Kenneth Taft, NYSDEC with two (2) copies of the Draft Environmental Impact Statement (DEIS) for Kiantone Pipeline Corporations proposed crude oil and finished products pipelines. Supervisor Kennedy directed that one (1) copy of the DEIS be on file in the Town Clerk's Office and one (1) copy is in the Engineering Room. J J

Letter received from County Legislature Fred Marshall regarding: a) HEAP Outreach schedule for 1992-93 b) Food distribution scheduled for Thursday, January 14, 1993, 9 A.M. until supplies are exhausted. A motion was made by Supervisor Kennedy and seconded by Councilman Zimmerman to appoint Milton I. Wittmeyer to the Office of Deputy Supervisor, salary of $1,800.00 per year, term to expire December 31, 1993 five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilman Hittmeyer to appoint Joyce Carr to the position of Part-time Clerk and Secretary to the respective Boards: Planning Board, Conservation Council and Zoning Board of Appeals at a salary of $8.15 per hr., term to expire December 31, 1993. five (5) Ayes Carried A motion was made by Councilman Zimmerman and seconded by Councilman Hittmeyer to appoint David Wilson to the position of Deputy Town Attorney, salary of $4,300.00 per year, term to expire December 31, 1993.
