L r NOW THEREFORE, BE IT RESOLVED: That the application of BFI to exempt its municipal solid waste collection trucks from the four (4) ton weight limit established on Dunn Road by Town Board Resolution Number 1993-19 be and the same is hereby approved, and be it further RESOLVED: That BFI is hereby allowed to operate the motor vehicles necessary to fulfill its contract for the collection of municipal solid waste with the Town of Boston on Dunn Road without regard to the weight limitation established by Town Board Resolution Number 1993-19. L REGULAR BOARD MEETING JUNE 2, 1993 TOWN HALL 7:3C P.M. Present were Councilman Mark W. Flowers, Councilman Don A. Wohlhueter,, Councilman David G. Zimmerman, Councilman Milton I. Wittmeyer, Supervisor Richard L. Kennedy, Town Attorney Michael F. Perley, and Superintendent of Highways Eugene E. Ruchalski. A motion was made by Councilman Wittmeyer and seconded by Councilman Flowers to accept the adoption and correction of the minutes of the May 19, 1993 Regular Monthly Meeting. five (5) Ayes Carried A motion was made by Councilraan Wohlhueter and seconded by Councilman Zimmerman that General Fund and Special District Bills on Abstract #6 dated June 2, 1993 in the amount of $47,796.18 be paid. five (5) Ayes Carried A raotion was made by Councilman wittmeyer and seconded by Supervisor Kennedy that the Highway Bills on Abstract #6 dated June 2, 1993 in the amount of $4,049.46 be paid. five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilraan Flowers to accept the Town Clerk's Monthly Report for May 1993. five (5) Ayes Carried Letter was received frOm Richard Steer, Franchise Accountant, Adelphia Cable with check in the amount of $999.54 representing a deduction taken in error for Special Franchises. Town Attorney Perley commented that at Councilman Zimmerman's direction when we negotiated with Adelphia Cable we insisted upon a net Franchise Fee. We have been successful in receiving this year an additional $1,600.00. Letter received from BFI Waste Systems requesting an exemption from the vehicle weight restriction of four (4) ton placed on Dunn Road. RESOLUTION 1993 - 20 B.F.I. WEIGHT EXEMPTION DUNN ROAD Letter received from John R. Finster, P.E., Erie County Deparrnent of Health - approval of application for Szalay Subdivision on file in the Town Clerk's Office. Letter from John Gugino, Erie County Dept. of Public Works, Highway Division regarding Speed Limit Reductions on the Town of Boston Subdivision Roads. Acknowledged receipt of Resolution for speed limit reduction. Town Attorney Perley is working on the descriptions and the TEIO forms. A motion was made by Supervisor Kennedy and seconded by Councilman Wittmeyer directing Highway Superintendent Ruchalski to place a 35 MPH speed limit sign on Fairlane Drive. five (5) Ayes Carried Resolution from the Town of Colden - D.W.I, received and on file ir. the Clerk's Office.
