RESOLUTION<br />

NUMBER 1993-19<br />

At a Regular Heeting of the Town Board of the Town of<br />

Boston, Erie County, New York , held at the Boston Town Hall, 8500<br />

Boston State <strong>Road</strong>, Boston, New York, on the 19th day of May, 1993<br />

at 7:30 o'clock in the evening Eastern Time there were:<br />

Counoilman Flowers presented the following Resolution and<br />

moved its adoption:<br />

nasREAB, <strong>Dunn</strong> <strong>Road</strong>, for the distance of one mile frOin<br />

its intersection with the Boston-Colden <strong>Road</strong> is a Town Highway in<br />

the Town of Boston, New York; and<br />

WHEREAS, the property adjacent to the said <strong>Dunn</strong> Koad is<br />

zoned R-A Resident Agricultural; and<br />

VHEREAS, the Town Board of the Town of Boston has<br />

received complaints from residents on <strong>Dunn</strong> <strong>Road</strong> concerning the<br />

condition of same, namely, that the said <strong>Dunn</strong> <strong>Road</strong> has become<br />

rutted and pot-holed as a result of vehicular traffic; and<br />

WHEREAS, it appears to the Town Board and the<br />

Superintendent of Highways of the Town of Boston that the ruts and<br />

pot-holes may have been caused by vehicular traffic on the said<br />

<strong>Dunn</strong> <strong>Road</strong>; and<br />

WHEREAS, the Town Board herein determines that there is<br />

a need to restrict the type and weight of vehicles travelling on<br />

<strong>Dunn</strong> <strong>Road</strong>; and<br />

WHEREAS, the Town Board has determined that <strong>Dunn</strong> <strong>Road</strong><br />

would be materially injured if vehicles exceeding four (4) tons in<br />

weight were allowed to travel on the said <strong>Dunn</strong> <strong>Road</strong>; and<br />

WHEREAS, Section 1660 of the Vehicle and Traffic Law<br />

allows the Town of Boston to restrict the weight of vehicles<br />

travelling on the said <strong>Dunn</strong> <strong>Road</strong>.
