town and county roads and not state roads. The town then has to<br />

make a determination as to which street should be the through<br />

street and then adopt an order on a case by case basis.<br />

COUNCILMEN REPORTS<br />

Councilman Flowers attended the Chamber of Commerce Heeting and<br />

reported that the Chamber is going to promote supporting businesses<br />

doing business in the town.<br />

Councilman Flowers met with John Szalay and his contractor<br />

regarding the street lighting in the Ssjalay Subdivision.<br />

Councilman Flowers addressed Councilman Zimmerman with reference to<br />

some inquiries he received from residents of Haag <strong>Road</strong> regarding<br />

Cable Service.<br />

Town Attorney Perley responded that the Cable Company is waiting<br />

for the make-ready of the poles on Haag <strong>Road</strong> and on Rockwood <strong>Road</strong>.<br />

RESOLUTION 1993 - 19 DUNN ROAD 4 TON WEIGHT LIMIT<br />

Councilman Wohlhueter advised that there seems to be a problem with<br />

the disposal of refrigerators in the town. He will take this<br />

matter up with Paul Balbierz of BFI to see if something could be<br />

worked out to rectify this matter.<br />

Councilman Ziitimerman had a complaint from a resident on the Boston<br />

Cross <strong>Road</strong> that there still needs to be some remedial work done on<br />

the South Boston Park Project.<br />

Supervisor Kennedy and Councilman Wittmeyer will go out and do an<br />

on site inspection of the properties involved with the<br />

South Boston Park Project.<br />

A motion was made by Councilman Wittmeyer and seconded by<br />

Supervisor Kennedy to grant a Soil Removal Permit to Roy Emerling<br />

for property on Boston State <strong>Road</strong> near Omphalius <strong>Road</strong>.<br />

five (5) Ayes Carried<br />

Councilman Wittmeyer asked Code Enforcement Kramer to comment on a<br />

Soil Removal Permit requested by Anthony Bernardi, 6385 Willow<br />

Drive.<br />

Code Enforcement Officer Kramer advised Mr. Bernardi that before a<br />

Soil Removal Permit can be issued he must rough grade the entire<br />

yard. When this has been completed, a Soil Removal Permit will be<br />

considered.<br />

After lengthy discussion it was determined that Mr. Bernardi did<br />

not require a Soil Removal Permit as he did not intend to remove<br />

soil from his property. Only move it around on the premises. If<br />

at a later date he should decide to take soil off the premises or<br />

sell the soil, then he will reapply for a Soil Removal Permit.<br />

ERIE COUNTY SHERIFF'S REPORT<br />

Erie County Sheriff's Report for April 1993 received and on<br />

file in the Clerk's office.<br />

A motion was made by Councilman Wohlhueter and seconded by<br />

Councilman Zimmerman to adjourn meeting at 8:29 P.M.<br />
