L A 'y-M^^yyyy-- TOWN OF BOSTON NEW YORK R E S O L U T I O W NUMBER 1993-15 SERIAL BOND RESOLUTION DATED HAY 5, 1993 At a Regular Heeting of the Town Board of the Town of Boston, Erie County, New YOrk , held at the Boston Town Hall, 8500 Boston State <strong>Road</strong>, Boston, New York, on the 5th day of May, 1993 at 7:30 o'clock in the evening Eastern Time there were : Present: Richard L. Kennedy David G. Zimmerman Don A. Wohlhueter Mark W. Flowers Absent: Milton I. Wittmeyer Supervisor Councilman Councilman Councilman Councilman councilman Zimmerman presented the following Resolution and moved its adoption: BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF BOSTON, ERIE COUNTY, NEW YORK AS FOLLOWS: SECTION 1. That the Town of Boston, Town Park Improvement Project as outlined in a certain project grant issued under the Federal Land and Water Conservation Fund Act, 16 U.S.C. 460(1)-4 et sea.; administered by the State of New York Office of Parks, Recreation and Historic Preservation and entitled L.& W.C.F. Project #36-01164 for the purpose of making improvements to the Boston Town Park be and the same is hereby authorized. u y Siy

That the maximun estimated cost of such specific object or purpose Is $ 190,900.00 and the plan for financing therefor is as follows: a) By the issuance of $ 108,000.00 serial bonds of the Town of Boston, hereby authorized to be issued pursuant to the Local Finance Law;and b) By the use of $ 70,900.00 awarded pursuant to L.& W.C.F. Project # 36-01164 as set forth in SECTION 1 hereof. c) By allocation of $12,000.00 from the General Fund of the Town of Boston available therefor and appropriated for such purpose in the 1993 Budget of the Town of Boston. SECTION 3. That it is hereby determined that the period of px'obable usefulness of the aforesaid specific object or purpose is ten (10) years, same being defined as the embellishment of a park, playground or recreational area, pursuant to Local Finance Law §11.00 subsection 19(c). SECTION 4. That the Town of Boston, Erie County, New York, issue its serial bonds in the amount of $ 108,000.00 to finance such cost in accordance with the financial plan set forth above. Such bonds shall be dated approximately as of the date of adoption of this Resolution and the power to fix and determine the exact date of such bonds is hereby delegated to the Supervisor. SECTION 5. That such bonds shall be numbered consecutively and shall be in the total amount of $108,000.00 and shall mature in numerical order in annual installments in the years and in the total amounts as follows: $21,600.00 - Hay 9, 1994, $21,600.00 - May 8, 1995, $21,600.00 - May 7, 1996, $21,600.00 - May 7, 1997, $21,600.00 - May 7, 1998 in such Individual amounts to be determined; and said bonds shall be issued in bearer form without coupons and shall contain a power to convert to registered form in accordance with the applicable provisions of the Local Finance Law. The bonds shall bear interest at a rate not exceeding
