L 3 REGULAR BOARD MEETING MAY 5, 1993 TOWN HALL 7:30 P.M. Received franchise check from Adelphia Cable in the amount of $16,522.34 for Intgrnational Cablevision, Inc. This check represents payment of franchise fees for the period of October 1, 1992 through March 31, 1993. Payment was based on gross revenues of $350,437,50 at five (5%) percent iess a credit of $999.54 for the Town of Boston Special Franchise Taxes. Councilman Zimmerman requested that the town Attorney request the $999.54 credit that was withheld, be returned. Our agreement with them is that they do not deduct from our payment. Resolution received from the Town of Wales, Re: DWI Costs, received and on file in the Clerk's Office. REQUESTS FROM THE FLOOR Daniel Poppenberg, President of the Boston Emergency Squad asked that any complaints or criticism of the Squad that come into the Town Clerk's Office be directed to the Boston Emergency Squad, Director of Operation or the President. With these complaints, we offer follow-ups to the patients or family to better ourselves with our service to the Town of Boston. Bob Keel on behalf of the Emergency Squad, as Chairman of the Squad's Fund Raising Campaign for this year, I would like to publicly thank the members of the Town Board as well as the Public in the Community who attended the opening event at the Boston Gardens on May 3, 1993. We had a tremendous "Kick-off Event" that brought in over four thousand ($4,000) dollars for our campaign. Lisa Rood: I would like to bring to the Town Board's attention that this is officially "Water Week." Also, reporting from the Conservation Advisory Council that we have planted the trees'we received from the Tree Grant down at the Highway garage. Thanks to Gene Ruchalski and his machine operator Joe for assisting us. He did not know that the people applying were to go directly to Gerald O'Brien, Recreation Director. Recreation Director Gerald O'Brien: Prefers that the people call him directly so that he can briefly screen the applicants and explain the program to the prospective applicant. Application received from Gregory and Julie Dake, 7825 Back Creek <strong>Road</strong> requesting a Restricted or Conditional Rezoning referred to the Planning Board for review and recommendation. Received a copy of a letter from Katrina Washington, Legal Assistant, Bureau of Consumer Fraud and Protection acknowledging the receipt of a Notice of Complaint from the residents of the Sprague Mobile Home Park sent to the Attorney General. Received a copy of the Mobile Home Program Group Complaint Form sent by residents of the Sprague Mobile Home Park to the NYS Division of Housing and Community Renewal. Supervisor Kennedy responded that hopefully the Sprague Mobile Home Park will be in compliance with the Town Law when the Town Board inspects the park in July. A motion was made by Supervisor Kennedy and seconded by Councilman Zimmerman to create the Boston Town Park Improvement Project (L&WCF Proj #36-01164) as follows: Project Cost To be funded by: General Fund LCWCF Grant BAN four (4) Ayes $190,900.00 $ 12,000.00 70,900.00 108,000.00 RESOLUTION 1993 - 15 SERIAL BOND RESOLUTION RESOLUTION 1993 - 16 BOND ANTICIPATION NOTE RESOLUTION Carried Letter received from the Boston Conservation Advisory Council asking the Town Board to consider the recommendation of hiring a planner to assist on Subdivision and Site Plan approval with the Planning Board. Supervisor Kennedy indicated that there is in fact money in the budget for the employment of a planner and they should continue with their interviews and follow this through. Letter received from the Planning Board recommending that the Steep Slope Legislation, as presented by Town Attorney Perley, be adopted. \m "1 A .yps^^
