TOWN ATTORNEY REPORT
TOWN HALL
7:30 P.H.
Town Attorney Perley received communication from Mel Kase of
Erie County with reference to the proposed hearing on the
abandonment of Dunn Road, it confirmed that Hr. Gugino will be
available on Hay 7, 1993 at 6:30 P.H.for the Public Hearing on
the Qualified Abandonment of Dunn Road. A Public Notice will be
published.
With Supervisor Kennedy and Town Engineer Pettit the Town
Attorney attended a session with the Erie County Water Authority
and various Southtown Governments that are involved in the
upgrade of the water system in Orchard Park. The most
significant development is that there is a proposed sighting of
the additional tank at this end of the upgrade, at an elevation
of 1600 feet which would put it outside of the present described
area ot what is known as VJater Improvement #1. Town Attorney
asked for permission from the Board to begin to do the paperwork
to dissolve the current Water Improvement #1, so that we can
reform and appropriately describe improvement on the east hill,
to encompass the areas that we may actually be able to serve as
a result of this upgrade.
COUNCILMEN REPORT
Councilman Flowers wished everyone a "Happy Easter".
Councilman Flowers discussed with Barbara Ballachino the
possibility of the Tri-Q Committee staying on under a different
name. The Tri-Q Committee is going to have a meeting at which
time they will discuss this possibility and they will report
back to Councilman Flowers.
A motion was made by Councilman Wittmeyer and seconded by
Councilman Flowers to appoint Joe Wells, Alternate Delegate to
the Southtowns Hazmat Team granting him voting power in the
absence of Councilman Flowers and/or Councilman Wittmeyer.

Councilman Zimmerman had a call from the Emergency Squad that
they were having problems with their 1987 vehicle, the
transmission was bad. Verbal consent was given for repair at a
cost of eighteen hundred ($1800.00).
A motion was made by Councilman Wittmfeyer and seconded by
Supervisor Kennedy to grant a soil removal permit to remove six
hundred (600) yards of gravel as staked in the area on the
Joseph Simmeth property at 8010 Boston State Road.

A motion was made by Supervisor Kennedy and seconded by
Councilman Flowers to grant a soil removal permit to remove six
hundred (600) yards of topsoil as staked in the area on the
Martin & Mildred Logel property 7784 Boston State Road.

Councilman Wittmeyer attended the South Boston Park meeting and
reports that the drainage is finished and they are co-ordinating
with the Highway Superintendent to get the driveway put in. The
Boston Fire Company has donated a shelter to them.
