TOWN ATTORNEY REPORT<br />
TOWN HALL<br />
7:30 P.H.<br />
Town Attorney Perley received communication from Mel Kase of<br />
Erie County with reference to the proposed hearing on the<br />
abandonment of <strong>Dunn</strong> <strong>Road</strong>, it confirmed that Hr. Gugino will be<br />
available on Hay 7, 1993 at 6:30 P.H.for the Public Hearing on<br />
the Qualified Abandonment of <strong>Dunn</strong> <strong>Road</strong>. A Public Notice will be<br />
published.<br />
With Supervisor Kennedy and Town Engineer Pettit the Town<br />
Attorney attended a session with the Erie County Water Authority<br />
and various Southtown Governments that are involved in the<br />
upgrade of the water system in Orchard Park. The most<br />
significant development is that there is a proposed sighting of<br />
the additional tank at this end of the upgrade, at an elevation<br />
of 1600 feet which would put it outside of the present described<br />
area ot what is known as VJater Improvement #1. Town Attorney<br />
asked for permission from the Board to begin to do the paperwork<br />
to dissolve the current Water Improvement #1, so that we can<br />
reform and appropriately describe improvement on the east hill,<br />
to encompass the areas that we may actually be able to serve as<br />
a result of this upgrade.<br />
COUNCILMEN REPORT<br />
Councilman Flowers wished everyone a "Happy Easter".<br />
Councilman Flowers discussed with Barbara Ballachino the<br />
possibility of the Tri-Q Committee staying on under a different<br />
name. The Tri-Q Committee is going to have a meeting at which<br />
time they will discuss this possibility and they will report<br />
back to Councilman Flowers.<br />
A motion was made by Councilman Wittmeyer and seconded by<br />
Councilman Flowers to appoint Joe Wells, Alternate Delegate to<br />
the Southtowns Hazmat Team granting him voting power in the<br />
absence of Councilman Flowers and/or Councilman Wittmeyer.<br />
four (4) Ayes Carried<br />
Councilman Zimmerman had a call from the Emergency Squad that<br />
they were having problems with their 1987 vehicle, the<br />
transmission was bad. Verbal consent was given for repair at a<br />
cost of eighteen hundred ($1800.00).<br />
A motion was made by Councilman Wittmfeyer and seconded by<br />
Supervisor Kennedy to grant a soil removal permit to remove six<br />
hundred (600) yards of gravel as staked in the area on the<br />
Joseph Simmeth property at 8010 Boston State <strong>Road</strong>.<br />
four (4) Ayes<br />

A motion was made by Supervisor Kennedy and seconded by<br />
Councilman Flowers to grant a soil removal permit to remove six<br />
hundred (600) yards of topsoil as staked in the area on the<br />
Martin & Mildred Logel property 7784 Boston State <strong>Road</strong>.<br />
four (4) Ayes Carried<br />
Councilman Wittmeyer attended the South Boston Park meeting and<br />
reports that the drainage is finished and they are co-ordinating<br />
with the Highway Superintendent to get the driveway put in. The<br />
Boston Fire Company has donated a shelter to them.<br />
