1 ^ 1 REGULAR BOARD MEETING APRIL 7, 1993 TOWN HALL 7:30 P.M. Letter received from Francis J. Pordum, State Assembly regarding NYSDOT Funding situation received and filed in the Clerk's office. Letters received from Francis J. Pordum, State Assembly and regarding Service Award Programs for Independent Emergency Squad Hembers received and on file in the Clerk's office. Councilman Wittmeyer received and read a letter from Senator Dale Volker regarding Service Award Programs for Independent Emergency Squad Hembers. Councilman Wittmeyer requested that copies of both letters be sent to the Emergericy Squad by the Towri Clerk. Letter received from Erie Courity Legislature Frederick J. Harshall re: Food distribution to be held on Thursday, April 22, 1993 beginning at 9:00 A.H. Resolution received from the Town of Evans Re: DWI processing and trial, received and filed in the Clerk's office. N.Y. Telephone Protest of Special Franchise Assessment for 1993 Tax Roll received and on file in the Clerk's office. Received a certified letter from Integrated Waste Systems, Inc. with a questionnaire askirig the Town Board to consider a well designed, professionally operated, state-of-the-art landfill. The Town Board after hearing the questions and answers as outlined by Town Attorney Perley, directed Town Clerk Shenk to respond to Integrated Waste System's questionnaire by answering "no" to all the questions asked. Stating that our Zoning Law does not permit the construction of landfills and we do not wish to change this. REQUESTS FROM THE FLOOR Kevin Hess, Boston State Rd.: Regarding drainage problem on my property on Redwing Drive. I met with Supervisor Kennedy, Councilman Wittmeyer and Highway Superintendent Ruchalski. Supervisor Kennedy stated that the Town Engineer will be doing some research to clarify what the possibilities are and if the people will be receptive to something being done. Whether we can acquire easements on the property that is affected so that we can take that drainage water down as far as the State <strong>Road</strong>. Something will be done. At the request of Recreation Director Gerald O'Brien the Friday Night Youth Program this year has initiated a dance program under the direction of Jennifer Schunk. Ms. Schunk and eleven girls from the program put on a ten minute demonstration of line dancing. A motion was made by Councilman Wittmeyer and seconded by Supervisor Kennedy at the recommendation of the Recreation Director Gerald O'Brien to awarded the bid for transportation for the Summer Recreation Program and Ski Program for 1993 to Laidlaw Transit, Inc. as follows: four (4) Ayes Summer-per bus/per day $115.00 Ski-per bus/per day $115.00 Carried A motion was made by Councilman Zimmerman and seconded by Councilman Wittmeyer to grant permission to Recreation Director Gerald O'Brien to conduct "Concerts in the Park 1993" in the Lion's Shelter on the following dates: Tuesdays Fridays four (4) Ayes August 3rd, 10th, 17th August 6th, 13th, 20th Carried A motion was made by Supervisor Kennedy and seconded by Councilman Wittmeyer to deny the rezoriing request of the Carol Seamon property which was tabled from the March 17, 1993 meeting. four (4) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilman Zimmerman to table the Gerwitz application to build a deck till the next Town Board Meeting on April 21, 1993, until Code Enforcement Officer Kramer can review the plans more thoroughly due to the height and because this is commercial property. four (4) Ayes Carried Boston Planning Board received a notice from Mr. Clair A. Montroy, III, Attorney for Larry Ovitt withdrawing his request for rezoning of property located at 5805-5803 Herman Hill <strong>Road</strong>. A motion was made by Supervisor Kennedy and seconded by Councilman Flowers to Appropriate Excess Revenue in Highway Fund as follows: Estimated Revenue: D 2665 Sale of equipment Appropriation: D 5130.2 Machinery - Equipment four (4) Ayes $56,000.00 $56,000.00 Carried A motion was made by Supervisor Kennedy and seconded by Councilman Flowers to appropriate funds as follows for Memorial Day Celebration: AMVETS Boston Post 219 VFW Post 2556 $400.00 250.00 four (4) Ayes Carried Letter received from E-Z Shop, Inc. notifying the Town of their intent to renew its' beer license received and on file in the Clerk's office.
