(b) The issuance of the group policy would result in<br />
ec<strong>on</strong>omies of acquisiti<strong>on</strong> or administrati<strong>on</strong>; and<br />
(c) The benefits are reas<strong>on</strong>able in relati<strong>on</strong> to the premiums<br />
charged.<br />
F. "Policy means, for the purposes of this Act, any policy, c<strong>on</strong>tract,<br />
subscriber agreement, rider or endorsement delivered or issued for<br />
delivery in this state by an insurer, fraternal benefit society,<br />
n<strong>on</strong>profit health, hospital, or medical service corporati<strong>on</strong>, prepaid<br />
health plan, health maintenance organizati<strong>on</strong> or any similar<br />
organizati<strong>on</strong>.<br />
Drafting Note: This Act is intended to apply to the specified group and<br />
individual policies, c<strong>on</strong>tracts, and certificates whether issued by<br />
insurers, fraternal benefit societies, n<strong>on</strong>-profit health, hospital, and<br />
medical service corporati<strong>on</strong>s, prepaid health plans, health maintenance<br />
organizati<strong>on</strong>s, or any similar organizati<strong>on</strong>. In order to include such<br />
organizati<strong>on</strong>s, each state should identify them in accordance with its<br />
statutory terminology or by specific statutory citati<strong>on</strong>. Depending up<strong>on</strong><br />
state law, insurance department jurisdicti<strong>on</strong>, and other factors, separate<br />
legislati<strong>on</strong> may be reQuired. In any event, the legislati<strong>on</strong> should provide<br />
that the particular terminology used by these plans and organizati<strong>on</strong>s may<br />
be substituted for, or added to, the corresp<strong>on</strong>ding terms used in this Act,<br />
The term "regulati<strong>on</strong>s" should be replaced by the terms "rules and<br />
regulati<strong>on</strong>s" or rules as may be appropriate under state law,<br />
The definiti<strong>on</strong> of "l<strong>on</strong>g-term care insurance" under this Act is designed to<br />
allow maximum flexibility in benefit scope, intensity and level, while<br />
assuring that the purchaser's reas<strong>on</strong>able expectati<strong>on</strong>s for a l<strong>on</strong>g-term care<br />
insurance policy are met. The Act is intended to permit l<strong>on</strong>g-term care<br />
insurance policies to cover either diagnostic, preventive,. therapeutic,<br />
rehabilitative, maintenance, or pers<strong>on</strong>al care services, or any combinati<strong>on</strong><br />
thereof, and not to mandate coverage for each of these types of services.<br />
Pursuant to the definiti<strong>on</strong>, l<strong>on</strong>g-term care insurance may be either a group<br />
or individual insurance policy or a rider to such a policy, *e.g, life, or<br />
accident and sickness~ The language in the definiti<strong>on</strong> c<strong>on</strong>cerning other<br />
then an acute care unit of a hospital is intended to allow payment of<br />
benefits when a porti<strong>on</strong> of a hospitel has been designated for, and duly<br />
licensed or certified as a l<strong>on</strong>g-term care provider or swing bed.<br />
