THE TOWNSHIP OP MILLBURN IN 

THE COUNTY OP ESSEX AND 

AMENDING ARTICLE 3 OP CHAP- 

TER 4 OP TITLE 3 OF THE ORDI- 

NANCES OF THE TOWNSHIP OP 

MILLBUTtN IN THE COUNTY OF 

ESSEX (REVISION OF 1939). 

BE IT OEDAINBD BY THB TOWN- 

SHIP COMMITTEE OP THE TOWN- 

SHIP OF MTLLBURN IN THE COUNTY 

OF ESSSX, as follows: 

Section 1. Section 5 of Article 3 of 

Chapter 4 of Title 3 of The Ordinances 

of The Township of Millburn In the 

County of Essex (Revision of 1339), is 

hereby amended to read as -follows: 

"Section 4, Ail sewers now or here- 

after laid within the Township ot 

Millburn, draining directly or in- 

directly into the Joint Trunk Sewer, 

shall form the sanitary sewer sys- 

tem of the Township, and except as 

otherwise provided by ordinance of 

said Township, shall carry liquid 

house wastes exclusively. No open 

gutter, cesspool, cellar or house 

drain, ground drain, rain water lead- 

er or privy vault shall be connected 

with the sanitary sewer system, ex- 

cept as aforesaid." 

• Section 2. This ordinance shall take 

effect at the time and in the manner 

prescribed by law.

AN ORDINANCE RELATING TO 

SWIMMING POOLS IN THE TOWN- 

SHIP OF MILLBURN IN THE 

COUNTY OF ESSEX. 

BE IT ORDAINED BY THE TOWN- 

SHIP COMMITTEE OF THE TOWN- 

SHIP OF MILLBURN IN THE COUN- 

TY OF, ESSEX, as follows: 

Section 1. For the purpose of thla 

ordinance, a swimming pool is de- 

fined as «n artificially constructed 

basin, or other structure, for the hold- 

ing of TPa-ter for use by persons for 

| swimming, diving and other aquatic 

sports and recreation. 

Section 2. Swimming pools, as de- 

fined in the foregoing section of this 

ordinance, shall be deemed to be 

buildings as defined in and subject 

to the provisions of the Building 

Code of the Township of Millburn 

in the County of Essex; and no swim- 

ming pool as herein defined phall be 

i constructed without a permit and the 

payment of fee and submission of 

plans as required by the provisions 

of Sections 2, 3 and 4 of said Build' 

Ing Code, which are hereby expressly 

made applicable to and required for 

'the construction of swimming pools. 

Section 3- The discharge pipe line 

leading from any swimming pool 

which may hereafter be constructed 

In the Township ot Millburn in the 

County of Essex, shall not exceed 2" 

in diameter and shall be composed of 

galvanized Iron, or such other stand- 

ard durable material as may be ap- 

proved by the Building Inspector. 

Section 4. No swimming pool shall 

be wholly or partially emptied into 

the sanitary xewer system of tha Town- 

ship aforesaid if a storm water drain 

Is readily accessible to the premises 

upon which, the TJOOI shall be lo- 

cated, for the reception of water from 

such pool. Where, however, only the 

sanitary sewer syetern is available for 

the reception oi water dlschargable 

from a swimming pool, such discharge 

Into- such system shall be permitted 

only at a time of which previous no- 

tice sh&'.l have been given to and for 

which, permission shall have been re- 

ceived from an authorized representa- 

tive of the Department of Public 

Works of said Township. 

Section 5. Every awlmming pool 

constructed or to be constructed in 

ihe Township aforesaid, shall at all 

times comply with the requirements 

of all health authorities having Juris- 

diction fn the premises, and any 

nuisance or hazard to life or health, 

which may exist or develop In or In 

consequence of or in connection with 

any such swimming pool, shall forth- 

with be abated and removed by the 

person Jn possession of such pool, 

Upon receipt of notice from the Build- 

ing Inspector or Health Officer so re- 

quiring. 

Section 5. For the violation of any 

of the provisions of the foregoing sec- 

tion, a. penalty may be imposed as 

provided In Article 1 of Chapter 7 

of Title 3 of the Ordinances of the 

Township of Millburn in the County 

-of Essex (Revision of 1939). 

Section 7. This ordinance- shall take 

effect at the time and In the man- 

ner prescribed by law, and shall con- 

stitute Article 3 of Chapter 5 or Title 

3 of tlie Ordinances aforesaid.

that the above Ordinance was Intro- 

duced and passed on first reading at 

a regular meeting of the Township 

Committee of the Township of Mill- 

burn In the County of Essex. New 

Jersey, held on Monday evening, May 

15, 1050, and that said Ordinance will 

be tafcen up for further considera- 

tion and final passage at a regular 

meeting of said Committee to be held 

in the meeting room, Town Hail, on
