RESOLUTION NO. R2012-24
A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL
APPROVING AMENDMENT 5 TO THE AGREEMENT WITH
PALM BEACH COUNTY FOR THE PURPOSE OF
RECEIVING A GRANT UNDER THE PROVISIONS OF THE
NEIGHBORHOOD STABILIZATION GRANT PROGRAM;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Wellington’s Council authorized entering into an agreement with
Palm Beach County through the passage of Resolution R2010-29 to facilitate receipt of
grant monies under the Neighborhood Stabilization Grant Program; and
WHEREAS, on or about August 10, 2010, Wellington approved an Amendment
to said Agreement through the passage of Resolution R2010-50; and
WHEREAS, on or about February 8, 2011, Wellington approved Amendment No.
2 to said Agreement extending the deadline for completion of the terms of the
Agreement from April 30, 2011 to December 31, 2011; and
WHEREAS, Amendment No. 3 was agreed to administratively as it was
proposed by Palm Beach County to further clarify the date extension to December 31,
2011 which had been previously approved by Wellington’s Council; and
WHEREAS, Amendment No. 4 was agreed to administratively and further
amended the Agreement to extend the deadline for completion of the terms from
December 31, 2011 to December 31, 2012 and the Declarations of Restrictions; and
WHEREAS, Amendment No. 5 will further clarify the ability to forgive program
subsidy or funds invested in a property over and above the appraised value as allowed
by program guidelines established by the U.S. Department of Housing and Urban
Development.
NOW, THEREFORE, BE IT RESOLVED BY WELLINGTON, FLORIDA’S
COUNCIL that:
SECTION 1. The foregoing recitals are hereby affirmed and ratified.
SECTION 2. Amendment No. 5 to Agreement with Palm Beach County to
provide Neighborhood Stabilization Grant funds (attached hereto as Exhibit “A”) is
approved and the Mayor and Clerk are authorized to execute said Amendment on
behalf of the Village of Wellington.
SECTION 3. This Resolution shall become effective immediately upon adoption.
