Such stock and facilities may be examined by a representative of the City at any time either<br />

before an award is made or during the term of the contract.<br />

The City reserves the right during the contract period to determine by independent tests if<br />

the product(s) supplied meet aforementioned specifications. The cost of the test is to be<br />

paid for by the City if the sample meets specifications and by contractor if it does not. In<br />

addition, the facilities of the Florida State Department of Agriculture testing laboratories<br />

may be used for any referee testing. Failure to meet specifications will result in prevailing<br />

testing rate cost to be borne by the Supplier.<br />

Under no circumstances shall the contractor start work until the certificate of insurance is<br />

received and approved by the city.<br />

Contractor shall be responsible for initiating, maintaining and supervising all safety<br />

precautions and programs in connection with the Work to prevent damage, injury or loss<br />

to all employees on the work site and other persons and organizations who may be affected<br />

thereby; all the work and materials and equipment to be incorporated therein, whether in<br />

storage on or off the site; and other property at the site or adjacent thereto.<br />

Contractor shall comply with all applicable laws and regulations of any public body having<br />

jurisdiction for the safety of persons or property or to protect them from damage, injury or<br />

loss.<br />

If delivery requirements cannot be fulfilled by the Contractor, the City retains the right to<br />

cancel the order and make such purchases on the open market and contractor shall be<br />

liable for all price differences if delivery failure is not a case of FORCE MAJEURE.<br />

The contractor shall assure the City that each delivery truck will be in A-1 mechanical<br />

condition and will have a properly licensed capable driver trained in the proper handling,<br />

use and operation of equipment required for delivery.<br />

The contractor shall assure the City that when in the opinion of the City an emergency<br />

condition exists, TRAINED EMERGENCY CREW WITH PROPERLY FITTED<br />

EQUIPMENT will be made available to the City via a telephone call to the contractor,<br />

telephone answering service, pager, cellular phone or other designated telephone number.<br />

At the time of bid submission, the bidder shall supply the following information:<br />

Location of nearest emergency station.<br />

Name of person in charge of emergency crews.<br />

Telephone numbers, pagers, cellular, etc. to be called for emergency service or normal<br />

maintenance.<br />

Time periods during which service will be made available from the contract numbers<br />

provided to ensure 24 hours coverage.<br />
