18. GOVERNMENT RESTRICTIONS: In the event any governmental<br />

restrictions may be imposed which would necessitate alteration of the<br />

material/quality, workmanship, or performance of the items/services offered<br />

on the bid prior to delivery/performance, it shall be the responsibility of the<br />

successful bidder to notify the CITY at once, indicating in their letter the<br />

specific regulation which required an alteration. The City of Margate reserves<br />

the right to accept any such alteration, including any price adjustment<br />

occasioned hereby, or to cancel the contract at no further expense to the<br />

CITY.<br />

19. PUBLIC ENTITY CRIMES INFORMATION STATEMENT: “A person or<br />

Affiliate who has been placed on the convicted vendor list following a<br />

conviction for a Public Entity Crime may not submit a bid on a contract to<br />

provide any goods or services to a public entity, may not submit a bid on a<br />

contract with a public entity for the construction or repair of a public building<br />

or public work, may not submit bids on leases of real property to a public<br />

entity, may not be awarded or perform work as a contractor, supplier,<br />

subcontractor, or consultant under a contract with any public entity, and may<br />

not transact business with any public entity in excess of the threshold amount<br />

provided in Section 287.017 for CATEGORY TWO for a period of 36 months<br />

from the date of being placed on the convicted vendor list.”<br />

20. DISCRIMINATORY VENDOR LIST: An entity or affiliate who has been<br />

placed on the discriminatory vendor list may not submit a bid on a contract to<br />

provide goods or services to a public entity, may not submit a bid on a<br />

contract with a public entity for the construction or repair of a public building<br />

or public work, may not submit bids on leases of real property to a public<br />

entity, may not award or perform work as a contractor, supplier,<br />

subcontractor, or consultant under contract with any public entity, and may<br />

not transact business with any public entity.<br />

21. COPYRIGHTS OR PATENT RIGHTS: Bidder warrants that there has been<br />

no violation of copyrights or patent rights in manufacturing, producing, or<br />

selling the goods shipped or ordered, as a result of this bid.<br />

22. TAXES: The City of Margate is exempt from all Federal and State taxes.<br />

CONTRACTOR shall pay all sales, consumer, use and other similar taxes<br />

required, to be paid by the CONTRACTOR in accordance with the laws and<br />

regulations of the State of Florida and its political subdivisions.<br />

CONTRACTOR is responsible for reviewing the pertinent State Statutes<br />

involving such taxes and complying with all requirements.<br />

23. STANDARDS <strong>OF</strong> SAFETY: The Bidder warrants that the product(s) and<br />

services supplied to the CITY conforms in all respects to the standards set<br />

forth in the Occupational Safety and Health Act and its amendments and to<br />

any industry standards if applicable. Bid Proposal must be accompanied by<br />
