4.2 The submission of a Bid will constitute an incontrovertible<br />

representation by the Bidder that the Bidder has complied with every<br />

requirement of “Bidders Examination of Bid Documents and Site”<br />

contained herein, that without exception the Bid is premised upon<br />

performing the Work required by the Bid Documents and such means,<br />

methods, techniques, sequences or procedures as may be indicated in or<br />

required by the Bid Documents, and that the Bid Documents are sufficient<br />

in scope and detail to indicate and convey understanding of all terms and<br />

conditions for performance of the Work.<br />

5. INTERPRETATIONS: All questions about the meaning or intent of the Bid<br />

Documents are to be directed to the CITY OR <strong>THE</strong> CITY’S<br />

REPRESENTATIVE in writing. Interpretations or clarifications considered<br />

necessary in response to such questions will be issued by written Addenda to<br />

all parties recorded by the CITY OR <strong>THE</strong> CITY’S REPRESENTATIVE as<br />

having received the Bid Documents. Questions received less than 7 days<br />

prior to the date for opening of Bids may not be answered. Only questions<br />

answered by formal written addenda will be binding. Oral and other<br />

interpretations or clarifications will be without legal effect. It is the<br />

Contractor’s responsibility to contact the City prior to the bid opening to<br />

determine if any addenda have been issued on the project.<br />

6. BID SECURITY, BONDS: (IF REQUIRED) Each bid shall be accompanied<br />

by a certified or cashier’s check or approved Bid Bond in the amount stated<br />

in the Bid Documents. Said check or bond shall be made payable to the<br />

CITY and shall be given as guarantee that the Bidder, if awarded the Bid will<br />

enter into an Agreement with the CITY, and shall furnish the necessary<br />

insurance certificates, Payment and Performance Bonds (IF REQUIRED),<br />

each of said bonds to be in the amount stated in the Agreement. In case of<br />

refusal or failure by Bidder to enter into said Agreement, the check or bid<br />

bond shall be forfeited to the CITY. If the bidder elected to furnish a Bid Bond<br />

as its Bid Security, the Bidder shall use the Bid Bond form bound herein, or<br />

one conforming substantially to it in form.<br />

Pursuant to the requirements of Section 255.05(l)(a), Florida Statutes, it shall<br />

be the duty of the CONTRACTOR to record the aforesaid payment and<br />

performance bonds in the public records of Broward County, with the<br />

CONTRACTOR to pay all recording costs.<br />

7. RETURN <strong>OF</strong> BID SECURITY: Within 14 days after award of the Bid or<br />

Contract, the CITY will return the Bid securities accompanying such of the<br />

bids as are not considered in making the award. All other bid securities will<br />

be held until the Agreement has been fully executed. They will then be<br />

returned to the respective bidders whose bids they accompany.<br />
