GENERAL CONDITIONS<br />

INSTRUCTIONS TO BIDDERS<br />

1. DEFINED TERMS: Terms used in these instructions to Bidders and the<br />

Notice Inviting Bids which are defined in the General Conditions have the<br />

meaning assigned to them in the General Conditions. The term “Bidder”<br />

means one who submits a Bid directly to CITY, as distinct from a sub-bidder,<br />

who submits a Bid to a Bidder.<br />

2. COMPETENCY <strong>OF</strong> BIDDER: In selecting the bid which best meets the<br />

interests of the CITY consideration will be given not only to the financial<br />

standing but also to the general competency of the Bidder for the<br />

performance of the Work covered by the Bid. To this end, each Bid shall be<br />

supported by a statement of the Bidder’s experience as of recent date on the<br />

form entitled “Reference Sheet” herein. A “NO BID” for the WORK will be<br />

accepted from a contractor who does not hold a valid contractor’s license in<br />

the State and County where the WORK is to be performed (if required by<br />

State or County) applicable to the type of work bid upon at the time of<br />

opening bids.<br />

3. DISQUALIFICATION <strong>OF</strong> BIDDER: More than one bid from an individual<br />

firm, partnership, corporation, or association under the same or different<br />

names will not be considered. If the CITY believes that any Bidder is<br />

interested in more than one Bid for the WORK contemplated, all bids in which<br />

such Bidder is interested will be rejected. If the CITY believes that collusion<br />

exists among the Bidder’s, all bids will be rejected.<br />

4. BIDDER’S EXAMINATION <strong>OF</strong> BID DOCUMENTS AND SITE:<br />

4.1 It is the responsibility of each Bidder before submitting a bid, to:<br />

(a) Examine the Bid Documents thoroughly,<br />

(b) Visit the site to become familiar with local conditions<br />

that may affect cost, progress, or performance of Work,<br />

(c) Consider federal, state and local Laws and Regulations<br />

that may affect cost, progress, or performance of Work,<br />

(d) Study and carefully correlate the Bidder’s observations<br />

with the Bid Documents, and,<br />

(e) Notify the CITY OR <strong>THE</strong> CITY’S REPRESENTATIVE<br />

of all conflicts, errors, or discrepancies in the Bid<br />

Documents.<br />
