ORDINANCE NO. 2012-07
AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL,
UPDATING THE COMPREHENSIVE PLAN TO AMEND THE
TEXT OF THE LAND USE, TRANSPORTATION, HOUSING,
INFRASTRUCTURE, CONSERVATION, RECREATION AND
OPEN SPACES, INTERGOVERNMENTAL COORDINATION,
CAPITAL IMPROVEMENT, EDUCATION, PUBLIC SCHOOL
FACILITIES AND EQUESTRIAN ELEMENTS; AUTHORIZING
THE TRANSMITTAL OF THE AMENDMENT TO THE FLORIDA
DEPARTMENT OF ECONOMIC OPPORTUNITY; AUTHORIZING
THE MANAGER TO AMEND THE COMPREHENSIVE PLAN;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 163.3184, Florida Statutes, established the process
for adoption of comprehensive plan or plan amendment; and
WHEREAS, the 2011 Florida Legislature adopted Chapter 2011-139,
Laws of Florida repealing Chapter 9J-5 of the Florida Administrative Code and
changing the comprehensive plan amendment process; and
WHEREAS, text changes have been made to the Land Use,
Transportation, Housing, Infrastructure, Conservation, Recreation and Open
Spaces, Intergovernmental Coordination, Capital Improvement, Education, Public
School Facilities and Equestrian Elements to reflect changes in State law; and
WHEREAS, Wellington has held all duly required public hearings prior to
submission of the amendment to the state land planning agency, in accordance
with Section 163.3184(3), Florida Statutes; and
WHEREAS, on November 2, 2011, the Planning, Zoning and Adjustment
Board, sitting as the Local Planning Agency, after notice and public hearing, has
considered the appropriateness of the proposed amendments to the Wellington
Comprehensive Plan, and has submitted its recommendation to the Wellington
Council; and
WHEREAS, the Wellington Council desires to adopt the amendments to
the comprehensive plan to guide and control the future development of
Wellington, and to preserve, promote and protect the public health, safety and
welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF
WELLINGTON, FLORIDA, THAT:
