ORDINANCE NO. 2012-04<br />

AN ORDINANCE <strong>OF</strong> <strong>WELLINGTON</strong>, FLORIDA’S <strong>COUNCIL</strong>,<br />

AMENDING CONDITIONS <strong>OF</strong> <strong>THE</strong> COMMUNITY<br />

COMMERCIAL DESIGNATION FOR <strong>THE</strong> PARCEL KNOWN<br />

AS PALOMINO EXECUTIVE PARK, TOTALING 12.15<br />

ACRES, MORE OR LESS, LOCATED APPROXIMATELY ONE<br />

MILE NORTH <strong>OF</strong> <strong>THE</strong> INTERSECTION <strong>OF</strong> STATE ROAD 7<br />

AND LAKE WORTH ROAD, ON <strong>THE</strong> WEST SIDE <strong>OF</strong> STATE<br />

ROAD 7, AS MORE SPECIFICALLY DESCRIBED HEREIN;<br />

AMENDING <strong>THE</strong> CONDITIONS TO ALLOW 112,400 SQUARE<br />

FEET <strong>OF</strong> PR<strong>OF</strong>ESSIONAL / MEDICAL <strong>OF</strong>FICE WITH A<br />

MAXIMUM <strong>OF</strong> 112,400 SQUARE FEET <strong>OF</strong> MEDICAL<br />

<strong>OF</strong>FICE; PROVIDING A CONFLICTS CLAUSE AND A<br />

SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE<br />

DATE.<br />

WHEREAS, the Council of Wellington, Florida, adopted Ordinance No. 2006-09<br />

on March 7, 2006 establishing a future land use designation of Office Commercial with<br />

the conditions of approval as listed below:<br />

A. The proposed office development will comply with the traffic limitations as<br />

outlined in Exhibit “B”.<br />

B. The proposed office development shall consist of maximum of 55,000 square<br />

feet of medical office and 55,000 or more square feet of general office for a<br />

total of not more than 110,000 square feet of office space.<br />

WHEREAS, Wellington has held all duly required public hearings prior to<br />

submission of the amendment to the state land planning agency, in accordance with<br />

Section 163.3184(3), Florida Statutes; and<br />

WHEREAS, on January 4, 2012, the Planning, Zoning & Adjustment Board,<br />

sitting as the Local Planning Agency, after notice and public hearing, has considered<br />

amending the conditions of approval from this proposed Comprehensive Plan<br />

Amendment for the property which is the subject of this Ordinance, and has submitted<br />

its recommendation to the Council; and<br />

WHEREAS, the Council has taken the recommendations from the Local Planning<br />

Agency, Wellington staff, the Petitioner and the comments from the public into<br />

consideration when considering amending the conditions of approval from this proposed<br />

Comprehensive Plan Amendment for the property, which is the subject of this<br />

Ordinance; and<br />

WHEREAS, the Council, after notice and public hearing, voted to transmit the<br />

proposed amendment as Ordinance 2012 - 04 to the state land planning agency for<br />

written comment; and<br />
