ACTION REQUESTED: Discussion Approval BUDGET AMENDMENT REQUIRED: Yes No See Below PUBLIC HEARING: Yes No FIRST READING SECOND READING REQUEST: Approval of Ordinance No. 2012-04 (2011-40 CPA 2) a Comprehensive Plan Amendment to change the approved uses to 112,400 square feet of professional/medical office with a maximum of 112,400 square feet allowed for medical office. EXPLANATION: The agent Donaldson Hearing of Cotleur & Hearing, Inc., on behalf of the owner/petitioner, Palomino Executive Park Property Owners Association and applicant, International Real Estate Acquisitions, LLC. (AKA Cyber Knife), is requesting a Comprehensive Plan Amendment to change the approved use from 55,000 square feet of medical office and 55,000 square feet of general office to 112,400 square feet of professional/medical office with a maximum of 112,400 square feet allowed for medical office. This request will not change the property’s Future Land Use Map designation of Office Commercial only the approved square footages. The Comprehensive Plan Amendment application was submitted concurrently with a Master Plan Amendment (2012-40 MPA 2) that has almost identical conditions of approval. The Master Plan Amendment petition has a condition of approval regarding signalization at the Palomino Drive and State Road 7 intersection. The Palm Beach County Traffic Division letter identified impacts with this development and the proposed developments to the south that will warrant signalization at the Palomino Drive and State Road 7 intersection.

LEGAL SUFFICIENCY: Yes FISCAL IMPACT: N/A VILLAGE GOAL: Responsive Government RECOMMENDATION: Staff recommends approval of Ordinance No. 2012-04 (2011-40 CPA 2) a Comprehensive Plan Amendment to change the approved uses to 112,400 square feet of professional/medical office with a maximum of 112,400 square feet allowed for medical office, subject to the following conditions of approval: 2. The development shall consist of 112,400 square feet of professional/medical office uses with a maximum of 112,400 square feet allowed for medical office use.
