Wellington Council Meeting April 10, 2012 Page 154 of 384 maximum of 79,480 square feet of retail furniture sales showroom/design center and a maximum of 17,400 square feet of related warehouse storage space to a proposed 1,200 student private school for grades k–8 totaling 75,000 square feet and a 15,000 square feet day care center. The proposed change will decrease the approved total square footage by 6,880 square feet. This request to change site specific conditions of approval will not change the property’s Future Land Use Map (FLUM) designation of Community Commercial but only the previously approved uses and designated square footages. The Wellington Future Land Use Map will only be amended to include an adopted date and ordinance number for the Wellington Charter School project. The original approved FLUM designation was subject to a condition that limited the use/square footages of the site and would require approval from Wellington Council if the use or square footage is changed. The approved FLUM designation (Community Commercial) remains consistent with the Comprehensive Plan as stated originally in the findings when Ordinance No. 2008-03 was originally approved. Staff has concluded this request is consistent with the Comprehensive Plan and will have minimal traffic impact on the existing surrounding properties. Staff notes that ordinances approving FLUM designations would normally not include conditions that limit the use of the site; however the Planning Zoning and Adjustment Board (PZAB) requested the use limitations on this FLUM and the subsequent rezoning ordinances for Wellington Design Center in order to address concerns from residents of the surrounding neighborhoods and potential traffic to State Road 7/ US 441. The proposed principal access to the site will from a proposed E-1 canal crossing to State Road 7/ US 441 with a second access across the property to the south in accordance with the Transportation Element inter-connectivity Policy 1.1.19 between parcels along the State Road 7 corridor. A Drainage and Cross Access Easement Agreement (OR Book 22406 / Pages 663 to 670) has already been executed between these adjacent parcels. A Master Plan Amendment will be required for this site to amend the previously approved uses, site design and designated square footages. A concurrency equivalency determination and more detailed review will also be required as part of the Master Plan Amendment process. The Palm Beach County (PBC) Traffic Division has reviewed and approved with conditions the traffic impact analysis submitted for the proposed change in use and square footages for this property. The Palm Beach County Traffic Division letter (Exhibit “C”) has their recommend conditions to mitigate site related impacts. The traffic impact analysis was also reviewed and accepted by Wellington’s Traffic Consultant for compliance with Traffic Performance Standards. The Traffic Consultant’s letter (Exhibit “D”) also has recommended conditions which staff has incorporated into the conditions of approval. The petitioner only analyzed the equivalent of 100,000 square feet of retail use and not the maximum intensity allowed for the Community Commercial Future Land Use Map designation. Wellington’s Traffic Consultant recommended condition of approval was amended from “The project shall be limited to no more than 100,000 square feet of retail use or uses with equivalent daily trip generation” to “The project shall be limited to a use or uses not to exceed a maximum equivalent daily trip generation of 100,000 square feet of retail” per the March 26, 2012 letter (Exhibit “D”). PUBLIC NOTIFICATION / COMMENTS As required by the Land Development Regulations and Florida Statutes, public notifications were placed in the Palm Beach Post, mailings were set to property owners within 500 feet and the property was posted. All notices advised to the public that a public hearing on the proposed ordinance/resolution would take place. The dates of notices are set forth below. IX. PLANNING, ZONING AND ADJUSTMENT BOARD The Planning, Zoning and Adjustment Board (PZAB) recommended approval (6-0) of the Comprehensive Plan Amendment and Development Order Amendment petitions with staff recommended conditions at the March 7, 2012 meeting. X. <strong>COUNCIL</strong> The first reading of the Comprehensive Plan Amendment is scheduled to be heard at the April 10, 2012 Council meeting. XI. STAFF RECOMMENDATION Based on consistency with Wellington’s Comprehensive Plan, staff recommends approval of the Ordinance No. 2012-10 (Comprehensive Plan Amendment 2011-45 CPA 4) a Small Scale Comprehensive Plan Amendment to change the approved uses to allow a proposed 1,200 student private school for grades K–8 totaling 75,000 square feet and a 15,000 square feet day care center for the 8.35 acre parcel known as Wellington Charter School (FKA Wellington Design Center), located on the east side of State Road 7/U.S. 441, approximately one mile south of Forest Hill Boulevard, as legal described in Exhibit “B,” subject to the conditions of approval listed below: 1. The project shall be limited to a use or uses not to exceed a maximum equivalent daily trip generation of 100,000 square feet of retail. (TRAFFIC) Page 4 of 10
