AN ORDINANCE <strong>OF</strong> <strong>WELLINGTON</strong>, FLORIDA’S <strong>COUNCIL</strong>;<br />

TO AMEND CONDITIONS <strong>OF</strong> <strong>THE</strong> COMMUNITY<br />

COMMERCIAL FUTURE LAND USE MAP DESIGNATION<br />

FOR CERTAIN PROPERTY KNOWN AS <strong>WELLINGTON</strong><br />

CHARTER SCHOOL (FKA <strong>WELLINGTON</strong> DESIGN CENTER),<br />

TOTALING 8.35 ACRES, MORE OR LESS, LOCATED<br />

APPROXIMATELY ONE MILE SOUTH <strong>OF</strong> FOREST HILL<br />

BOULEVARD ON <strong>THE</strong> EAST SIDE <strong>OF</strong> STATE ROAD 7, AS<br />

MORE SPECIFICALLY DESCRIBED HEREIN; AMENDING<br />

<strong>THE</strong> USE CONDITIONS TO ALLOW A 1,200 STUDENT<br />

PRIVATE SCHOOL FOR GRADES K–8 TOTALING 75,000<br />

SQUARE FEET AND 15,000 SQUARE FEET DAY CARE<br />

CENTER; PROVIDING A CONFLICTS CLAUSE AND A<br />

SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE<br />

DATE.<br />

WHEREAS, the Council of Wellington, Florida, adopted Ordinance No. 2008-03<br />

on March 4, 2008 to establish a Future Land Use Map designation of Community<br />

Commercial with the previous conditions of approval as listed below:<br />

The 96,880 total square feet of the project will be developed consistent with the<br />

use limitations presented below:<br />

Not to exceed 79,480 gross square feet.<br />

WHEREAS, Wellington has held all duly required public hearings prior to<br />

submission of the amendment to the State Land Planning Agency, in accordance with<br />

Section 163.3184(3), Florida Statutes; and<br />

WHEREAS, on March 7, 2012, the Planning, Zoning & Adjustment Board, sitting<br />

as the Local Planning Agency, after notice and public hearing, has considered<br />

amending the proposed Comprehensive Plan Amendment conditions of approval for the<br />

property which is the subject of this Ordinance, and has submitted its recommendation<br />

to the Council; and<br />

WHEREAS, the Council has taken the recommendations from the Local Planning<br />

Agency, Wellington staff, the Petitioner and the comments from the public into<br />
