REQUEST: Approval of Ordinance No. 2012-10 a Comprehensive Plan Amendment (2011-45 CPA<br />

4) to change the approved uses to allow a proposed 1,200 student private school for grades k–8<br />

totaling 75,000 square feet and a 15,000 square feet day care center.<br />

EXPLANATION: The agent Jon E. Schmidt and Associates, Inc., on behalf of S R 7, Inc., property<br />

owner, and MG3 Developer Group, LLC., applicant, is requesting a small scale Comprehensive<br />

Plan Amendment to change the approved uses from a maximum of 79,480 square feet of retail<br />

furniture sales showroom/design center and a maximum of 17,400 square feet of related warehouse<br />

storage space to a proposed 1,200 student private school for grades k–8 totaling 75,000 square feet<br />

and a 15,000 square feet day care center. This request to change site specific conditions of<br />

approval will not change the property’s Future Land Use Map (FLUM) designation of Community<br />

Commercial but only the previously approved uses and designated square footages. The Wellington<br />

Future Land Use Map will only be amended to include an adopted date and ordinance number for<br />

the Wellington Charter School project. Staff notes the previously approved Comprehensive Plan<br />

Amendment, Zoning Ordinance and current Master Plan all have the same conditions of approval.<br />

The petitioner only analyzed 100,000 square feet of retail use and not the maximum intensity<br />

allowed for the Community Commercial Future Land Use Map designation. Wellington’s Traffic<br />

Consultant recommended this project be restricted to a maximum of 100,000 square feet of retail
