LS/MU LAND USE OVERLAY <strong>OF</strong> <strong>WELLINGTON</strong>’S LAND DEVELOPMENT REGULATIONS;<br />

PROVIDING CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING<br />

REQUEST: Staff is requesting this Zoning Text Amendment (ZTA) second reading be postponed<br />

until May 8, 2012. This ZTA request was already advertised for the April 10, 2012 Council meeting.<br />

A motion is required to postpone the item until the May 8, 2012 Council meeting.<br />

EXPLANATION: The Council and Planning, Zoning and Adjustment Board (PZAB) had previously<br />

approved the Wellington Green Mall Development of Regional Impact (DRI) Resolution 2008-70<br />

with a condition requiring a ZTA of Land Development Regulations Section 7.14.19. Signs for<br />

Projects within the LS/MU Land Use Overlay.<br />

In our review of the LDR and the Wellington Green Mall approved Master Sign Plan it was<br />

determined the Wellington Green Mall Master Sign Plan (Resolution 2008-70) incorporated a<br />

substantial amount of the existing LDR regulations for directional, median, project identification and<br />

monument type signs and that the Wellington Green Mall project has been developed with a<br />

majority of the allowed signs. With the amendment of this LDR section the Architectural Review<br />

Board or Development Review Committee (DRC) as required will be allowed to approve future<br />

amendments to the Wellington Green Mall Master Sign Plan consistent with the sign standards<br />

contained in Resolution 2008-70.<br />

At the March 7, 2012 Planning, Zoning and Adjustment Board (PZAB) meeting, the Board<br />

recommended approval (6-0) of Zoning Text Amendment 2011-02 ZTA (Ordinance No. 2012-06).<br />

The PZAB recommended that specific reference to the Wellington Green Mall project be removed<br />

from this ordinance.
