confi dential information means information and material we communicate to you in any<br />
form that we tell you is confi dential or which we communicate to you in circumstances<br />
of confi dence, in connection with this <strong>agreement</strong>. Confi dential information includes any<br />
information relating to our business systems, customers, properties, assets or affairs or<br />
those of our related bodies corporate. It also includes all copies, notes and records and all<br />
related information based on, or arising out of, any disclosure by us of such information and<br />
material. Confi dential information does not include information or material that is in the<br />
public domain (other than as a result of a breach of this <strong>agreement</strong>).<br />
contactless transaction means a transaction using a contactless card and a contactless<br />
reader approved by us and which is accepted by us.<br />
credit card means a card that:<br />
(a) has been designated by the issuer as a Visa or MasterCard card; and<br />
(b) the card schemes recognise as being a credit card.<br />
UnionPay means the card scheme known as China UnionPay.<br />
UnionPay card means a debit card or credit card that is branded as a UnionPay card.<br />
UnionPay terminal means an EFTPOS terminal that we have told you can be used to process<br />
UnionPay card transactions.<br />
data breach means any occurrence which results in the unauthorised access by a third party<br />
to confi dential data relating to card transactions stored by your business or any service<br />
provider or bureau providing storage or transmission services of that data.<br />
data security standards means the Payment Card Industry Data Security Standards<br />
(“PCIDSS”) mandated by the card schemes for the protection of cardholder details and<br />
transaction information, and any additional or replacement standards of which we advise<br />
you from time to time.<br />
electronic commerce transaction means a transaction between you and a cardholder over<br />
the Internet and other networks using electronic equipment to initiate such a transaction.<br />
electronic equipment means an electronic terminal, computer, television or telephone<br />
and includes:<br />
(a) Electronic Funds Transfer at Point of Sale terminals (EFTPOS terminals); and<br />
(b) any other authorised electronic terminal or device connected to our electronic<br />
banking system from time to time.<br />
EMV standards means the industry standards for chip-enabled cards established by Europay,<br />
Mastercard and Visa, and such replacement or additional standards as advised to you.<br />
EPAL means EFTPOS Payments Australia Limited which conducts the EFTPOS payments<br />
scheme.<br />
