<strong>of</strong>ficial c<strong>on</strong>duct <strong>of</strong> all members/pers<strong>on</strong>nel/<strong>of</strong>ficers <strong>of</strong> <strong>the</strong><br />

ies/units:<br />

(ICESCR); ILO Protocols and Recommendati<strong>on</strong>s and<br />

dards, in particular ILO C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Freedom <strong>of</strong><br />

<strong>of</strong> <strong>the</strong> Right to Organize (No. 87) and ILO C<strong>on</strong>venti<strong>on</strong> <strong>on</strong><br />

Collective Bargaining (No. 98); Internati<strong>on</strong>al Humanitarian<br />

orandum No. 393; Joint Circular 2-91 (Directing <strong>the</strong> AFP and<br />

erence to <strong>the</strong> Principles <strong>of</strong> Humanitarian Law and Human Rights<br />

in <strong>the</strong> C<strong>on</strong>duct <strong>of</strong> Security/Po ice Operati<strong>on</strong>s); and <strong>the</strong> Social C<strong>on</strong>tract with <strong>the</strong> Filipino People<br />

<strong>of</strong> President Benigno S. Aqui o Ill.<br />

I. GENERAL POLICY<br />

unds <strong>of</strong> law. The absence <strong>of</strong> <strong>the</strong>se civil liberties removes all<br />

workers' and employers' rights, which are better exercised in a<br />

nce, pressure or threats <strong>of</strong> any kind. It is incumbent up<strong>on</strong> <strong>the</strong>

government to ensure that this principle is respected and for workers' and employers'<br />

organizati<strong>on</strong>s to guarantee <strong>the</strong> t <strong>the</strong>se rights are not abused.<br />

Workers' rights are human rights. The right to form and to join uni<strong>on</strong>s for <strong>the</strong> protecti<strong>on</strong><br />

<strong>of</strong> his/her interests are c<strong>on</strong>s" ituti<strong>on</strong>ally guaranteed pursuant to Article 23 <strong>of</strong> <strong>the</strong> UDHR and<br />

provided in <strong>the</strong> ICCPR. Thus, a system <strong>of</strong> democracy and respect <strong>of</strong> fundamental human rights<br />

are essential to full and genuine observance <strong>of</strong> <strong>the</strong> rights <strong>of</strong> all workers particularly, freedom <strong>of</strong><br />

associati<strong>on</strong> and civil liberties.<br />

In order to ensure observance <strong>of</strong> workers' rights, it is hereby emphasized that labor<br />

disputes are within <strong>the</strong> sole ,urisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong> DOLE and/or through its appropriate agencies<br />

pursuant to <strong>the</strong> Labor Code cf <strong>the</strong> <strong>Philippine</strong>s, as amended, while matters involving peace and<br />

order and law enforcement are under <strong>the</strong> jurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong> DILG through <strong>the</strong> PNP pursuant to<br />

Republic Act No. 6975, "Department <strong>of</strong> <strong>the</strong> Interior and Local Government Act <strong>of</strong> 1990", as<br />

amended by Republic Act No 8551, "<strong>Philippine</strong> Nati<strong>on</strong>al <strong>Police</strong> Reform and Reorganizati<strong>on</strong> Act<br />

<strong>of</strong> 1998" and <strong>the</strong> protecti<strong>on</strong> <strong>of</strong> <strong>the</strong> people and <strong>the</strong> State and securing <strong>the</strong> sovereignty <strong>of</strong> <strong>the</strong><br />

State and integrity <strong>of</strong> <strong>the</strong> nati<strong>on</strong>al territory are under <strong>the</strong> jurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong> AFP pursuant to<br />

Article II, Secti<strong>on</strong> 3 <strong>of</strong> <strong>the</strong> 1987 <strong>Philippine</strong> C<strong>on</strong>stituti<strong>on</strong>.<br />

II.<br />

WORKERS' RIGHTS RELATIVE TO THE EXERCISE OF FREEDOM OF<br />

ASSOCIATION<br />

Workers' rights relative to <strong>the</strong> exercise <strong>of</strong> freedom <strong>of</strong> associati<strong>on</strong> shall be respected and<br />

protected at all times. These include:<br />

1) The right to establ sh and join organizati<strong>on</strong>s without discriminati<strong>on</strong> to include <strong>the</strong> right<br />

<strong>of</strong> trade uni<strong>on</strong>s/workers' organizati<strong>on</strong>s or <strong>the</strong>ir leaders or members not to be<br />

prejudiced by reaE <strong>on</strong> <strong>of</strong> <strong>the</strong>ir actual or potential membership in a political party that is<br />

in oppositi<strong>on</strong> to a political party in power;<br />

2) The right to life and pers<strong>on</strong>al safety shall include <strong>the</strong> right <strong>of</strong> trade uni<strong>on</strong>s and<br />

workers' associati<strong>on</strong>s to carry out <strong>the</strong>ir activities in full freedom in accordance with<br />

labor and o<strong>the</strong>r related laws and to be protected from threats <strong>of</strong> or actual violence<br />

committed by pers<strong>on</strong>s or organizati<strong>on</strong>s opposed to <strong>the</strong>ir trade uni<strong>on</strong> activities;<br />

3) The right to freedom and security from arbitrary arrest and detenti<strong>on</strong> shall include <strong>the</strong><br />

right <strong>of</strong> pers<strong>on</strong>s and properties <strong>of</strong> trade uni<strong>on</strong>s and workers' associati<strong>on</strong>s to be<br />

secured from unreas<strong>on</strong>able and unlawful searches and seizures and to due process<br />

<strong>of</strong> law;<br />

4) The right to freedom <strong>of</strong> opini<strong>on</strong> and expressi<strong>on</strong> shall include <strong>the</strong> right <strong>of</strong> every<br />

worker/trade unicnist to freely and publicly express his/her pers<strong>on</strong>al opini<strong>on</strong>s, orally<br />

or in writing, <strong>on</strong> rr atters affecting his/her rights; and<br />

5) The right to freedom <strong>of</strong> assembly shall include <strong>the</strong> right <strong>of</strong> workers and trade uni<strong>on</strong>s<br />

to engage in peaceful c<strong>on</strong>certed acti<strong>on</strong>s in accordance with law and <strong>the</strong> Internati<strong>on</strong>al<br />

Labour Standards.<br />

III.<br />

SCOPE AND COVERAGE<br />

This Guidelines shall be applicable to all cases <strong>of</strong> exercise <strong>of</strong> workers' rights<br />

particularly, freedom <strong>of</strong> associati<strong>on</strong>, collective bargaining, c<strong>on</strong>certed acti<strong>on</strong>s and o<strong>the</strong>r<br />

trade uni<strong>on</strong> activities in relat <strong>on</strong> to <strong>the</strong> involvement/mobilizati<strong>on</strong> <strong>of</strong> <strong>the</strong> members <strong>of</strong> <strong>the</strong><br />

AFP, including CAAs and SCAAs, <strong>the</strong> PNP, <strong>the</strong> Local Chief Executives, company<br />

security pers<strong>on</strong>nel/security gJards and <strong>the</strong> Barangay Tanod/BPSO <strong>the</strong>reat.<br />

DEFINITION OF TERMS<br />

Actual Violence — re ers to an <strong>on</strong>going and intenti<strong>on</strong>al use <strong>of</strong> physical force or power,<br />

against <strong>on</strong>eself, ano<strong>the</strong>r pers<strong>on</strong>, or against a group or community, that ei<strong>the</strong>r results<br />

in or has a high like ihood <strong>of</strong> resulting in injury, death or destructi<strong>on</strong> <strong>of</strong> or damage to<br />

property.<br />

Area <strong>of</strong> Operati<strong>on</strong>s — refers to geographical areas assigned to unit commanders <strong>of</strong><br />

<strong>the</strong> PNP and AFP fc r which <strong>the</strong>y have resp<strong>on</strong>sibility and in which <strong>the</strong>y have authority<br />

to c<strong>on</strong>duct police and military operati<strong>on</strong>s respectively.<br />

Certificati<strong>on</strong> Electi<strong>on</strong> — means <strong>the</strong> process <strong>of</strong> determining, through secret ballot, <strong>the</strong><br />

sole and exclusive Dargaining agent <strong>of</strong> <strong>the</strong> employees in an appropriate bargaining<br />

unit, for purposes <strong>of</strong> collective bargaining,<br />

Community — refe 's to a body <strong>of</strong> people having comm<strong>on</strong> rights, privileges or<br />

interests, or living ir <strong>the</strong> same place under <strong>the</strong> same laws and regulati<strong>on</strong>s.<br />

5) C<strong>on</strong>certed Acti<strong>on</strong>s — refer to activities undertaken by two or more pers<strong>on</strong>s arising<br />

from a labor dispile or in <strong>the</strong> exercise <strong>of</strong> c<strong>on</strong>stituti<strong>on</strong>ally guaranteed rights and<br />

freedoms.<br />

C<strong>on</strong>flict Group — rEfers to any armed group or force formed not for <strong>the</strong> purpose <strong>of</strong><br />

advancing interestz or causes <strong>of</strong> workers that is in clash with or in a state <strong>of</strong><br />

oppositi<strong>on</strong> to <strong>the</strong> ar-ned forces/state.<br />

Counter-insurgency — refers to comprehensive civilian and military efforts, strategies,<br />

plans and prograrr s undertaken to address insurgency and its root causes and to<br />

halt or extinguish an organized movement aimed at <strong>the</strong> overthrow <strong>of</strong> a duly<br />

c<strong>on</strong>stituted government through <strong>the</strong> use <strong>of</strong> subversi<strong>on</strong> and armed c<strong>on</strong>flict.<br />

Freedom <strong>of</strong> associati<strong>on</strong> — refers to <strong>the</strong> right <strong>of</strong> workers and employers to form or join<br />

an organizati<strong>on</strong> o <strong>the</strong>ir own choosing, without prior authorizati<strong>on</strong>, to collectively<br />

protect and promo e <strong>the</strong>ir ec<strong>on</strong>omic and social interests.<br />

Harassment — refers to <strong>the</strong> manifestly physical or verbal or systematic and/or<br />

c<strong>on</strong>tinued unwarranted acti<strong>on</strong> <strong>of</strong> <strong>on</strong>e party or group, including threats and demands.<br />

10) Labelling and/or -ragging and/or Red Baiting - refers to <strong>the</strong> act <strong>of</strong> accusing,<br />

denouncing, attack ng or persecuting an individual or organizati<strong>on</strong> as a communist or<br />

communist sympatnizer without legal basis and due process <strong>of</strong> law.<br />

11) Labor Dispute - re'ers to any c<strong>on</strong>troversy or matter c<strong>on</strong>cerning terms and c<strong>on</strong>diti<strong>on</strong>s<br />

<strong>of</strong> employment or he associati<strong>on</strong> or representati<strong>on</strong> <strong>of</strong> pers<strong>on</strong>s in negotiating, fixing,<br />

maintaining, changing or arranging <strong>the</strong> terms and c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> employment,<br />

regardless <strong>of</strong> whet-ier <strong>the</strong> disputants stand in <strong>the</strong> proximate relati<strong>on</strong> <strong>of</strong> employer and<br />

employee.<br />

12) Labor Federati<strong>on</strong> - means any labor organizati<strong>on</strong> registered with <strong>the</strong> DOLE as labor<br />

federati<strong>on</strong>.<br />

13) Labor Organizatio - means any uni<strong>on</strong> or associati<strong>on</strong> <strong>of</strong> employees which exist in<br />

whole or in part fo- <strong>the</strong> purpose <strong>of</strong> collective bargaining or <strong>of</strong> dealing with employers<br />

c<strong>on</strong>cerning terms and c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> employment.<br />

14) Lockout - means tne temporary refusal <strong>of</strong> an employer to provide work as a result <strong>of</strong><br />

an industrial or lator dispute.<br />

15) Militarizati<strong>on</strong> - for purposes <strong>of</strong> this Guidelines, refers to military intrusi<strong>on</strong>,<br />

involvement or prE sence in a workplace or in trade uni<strong>on</strong> campaigns.<br />

16) Military Operatior - refers to planned activities undertaken independently or in<br />

coordinati<strong>on</strong> with .-;ivilian entities in support to <strong>the</strong> accomplishment <strong>of</strong> AFP missi<strong>on</strong> to<br />

gain popular support and weaken <strong>the</strong> will <strong>of</strong> <strong>the</strong> enemy to fight. It is characterized by<br />

activities that inflJence <strong>the</strong> beliefs, emoti<strong>on</strong>, behaviors, attitudes and opini<strong>on</strong>s <strong>of</strong><br />

selected target audience; it establishes and maintains good relati<strong>on</strong>s between<br />

military forces, ivil authorities and <strong>the</strong> civilian populace to facilitate military<br />

operati<strong>on</strong>s in support to <strong>the</strong> accomplishment <strong>of</strong> <strong>the</strong>.AFP missi<strong>on</strong>.<br />

17) Nati<strong>on</strong>al Security Threat - refers to a situati<strong>on</strong> and/or envir<strong>on</strong>ment where <strong>the</strong> nati<strong>on</strong>'s<br />

fundamental valLes defined in <strong>the</strong> <strong>Philippine</strong> C<strong>on</strong>stituti<strong>on</strong> and <strong>the</strong> way <strong>of</strong> life <strong>of</strong><br />

Filipinos, its instituti<strong>on</strong>s, and its socio-ec<strong>on</strong>omic-political interests are actually or<br />

potentially threatE ned.<br />

18) Picketing - means <strong>the</strong> right <strong>of</strong> workers to freedom <strong>of</strong> expressi<strong>on</strong>, peaceful assembly,<br />

and c<strong>on</strong>certed acti<strong>on</strong>s c<strong>on</strong>sisting <strong>of</strong> <strong>the</strong> marching to and fro before <strong>the</strong> premises <strong>of</strong><br />

an establishment involved in a labor dispute, generally accompanied by <strong>the</strong> carrying<br />

and display <strong>of</strong> sicns, placards or banners with statements relating to <strong>the</strong> dispute.<br />

19) Security situatior - refers to a c<strong>on</strong>diti<strong>on</strong> or positi<strong>on</strong> with respect to <strong>the</strong> degree <strong>of</strong><br />

protecti<strong>on</strong> against any danger, damage, loss and crime.<br />

20) Strike - means any temporary stoppage <strong>of</strong> work by <strong>the</strong> c<strong>on</strong>certed acti<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

employees as a result <strong>of</strong> an industrial or labor dispute, or to express positi<strong>on</strong>s <strong>on</strong><br />

socio-ec<strong>on</strong>omic matters affecting workers' interests.<br />

WORKERS' RIGHTS AND ACTIVITIES<br />

V.<br />

21) Strike-bound Area — refers to <strong>the</strong> 50-meter radius from <strong>the</strong> establishment,<br />

warehouse, depots, plants or <strong>of</strong>fices, including <strong>the</strong> sites or premises used as<br />

runaway shops <strong>of</strong> <strong>the</strong> employer struck against, as well as <strong>the</strong> immediate vicinity<br />

actually used by picketing strikers in moving to and fro before all points <strong>of</strong> entrance<br />

to and exit from said establishment.<br />

22) Workplace — refers to <strong>the</strong> <strong>of</strong>fice, premise or worksite where a worker is temporarily or<br />

habitually assigned. Where <strong>the</strong>re is no fixed or definite workplace, <strong>the</strong> term shall<br />

include <strong>the</strong> place where <strong>the</strong> worker actually performs regular work, or where he/she<br />

regularly reports to render service or to take an assignment.<br />

CONDUCT OF THE AFP/PNP RELATIVE TO THE EXERCISE OF WORKERS' RIGHT<br />

TO FREEDOM OF ASSOCIATION, COLLECTIVE BARGAINING, CONCERTED<br />

ACTIONS AND OTHER TRADE UNION ACTIVITIES<br />

1) Labor disputes shall be under <strong>the</strong> primary and sole jurisdicti<strong>on</strong> <strong>of</strong> DOLE and/or its<br />

appropriate agencies. Members <strong>of</strong> <strong>the</strong> AFP, PNP and o<strong>the</strong>r law enforcement<br />

agencies, incluc ing Barangay Tanod/BPSO and company security<br />

pers<strong>on</strong>nel/security guards shall not intervene in labor disputes. The AFP and PNP<br />

may intervene <strong>on</strong>ly in <strong>the</strong> following cases:<br />

a) Expressly reqi. ested in writing ei<strong>the</strong>r through mail, email, fax or any similar<br />

means by <strong>the</strong> DOLE, through its Regi<strong>on</strong>al Offices, or<br />

b) A criminal act has been committed, is being committed, or is about to be<br />

committed through overt acts in accordance with Rule 113 <strong>of</strong> <strong>the</strong> Revised<br />

Criminal Procedures whe<strong>the</strong>r or not it arises out <strong>of</strong> <strong>the</strong> labor dispute, or<br />

c) In cases <strong>of</strong> act Jal violence arising out <strong>of</strong> a labor dispute.<br />

2) Request for presence <strong>of</strong> AFP pers<strong>on</strong>nel/units in a workplace where strike, picketing<br />

or lockout has been declared and in progress should be based <strong>on</strong> a security<br />

situati<strong>on</strong>, and <strong>on</strong>ly for <strong>the</strong> purpose <strong>of</strong> extending support to <strong>the</strong> PNP, or in <strong>the</strong> extreme<br />

situati<strong>on</strong> when no o<strong>the</strong>r law enforcement agency in <strong>the</strong> area is available to perform<br />

<strong>the</strong> following:<br />

a) Maintain peace and order within <strong>the</strong> community/general vicinity <strong>of</strong> <strong>the</strong> labor-<br />

dispute area;<br />

b) Provide securiy for both workers and management;<br />

c) Prevent violence or prevent escalati<strong>on</strong> <strong>of</strong> <strong>on</strong>going violence;<br />

d) Prevent <strong>the</strong> commissi<strong>on</strong> <strong>of</strong> o<strong>the</strong>r crimes, <strong>the</strong> nature <strong>of</strong> which are not related to<br />

<strong>the</strong> labor dispLte <strong>on</strong> hand; and

WORKERS' RIGHTS AND ACTIVITIES<br />

3)<br />

e) Provide emergancy assistance during post-incident situati<strong>on</strong>s.<br />

The AFP pers<strong>on</strong>nel/units shall stay away from <strong>the</strong> 50-meter radius picket/<br />

strike/lockout arez except in situati<strong>on</strong>s stated in 1 (b) and (c) above. In case <strong>the</strong> 50-<br />

meter radius incIL des a public thoroughfare, traffic police shall ensure <strong>the</strong> free flow<br />

<strong>of</strong> traffic.<br />

The DOLE, however, shall remain in <strong>the</strong> vicinity <strong>of</strong> <strong>the</strong> strike/picket/lockout area to<br />

ensure <strong>the</strong> obseR ance <strong>of</strong> this Guidelines, until such time that peaceful situati<strong>on</strong> is<br />

ensured with <strong>the</strong> parties' agreement.<br />

4) The Inter-Agency Coordinating and M<strong>on</strong>itoring Committee, as provided in VII.12 <strong>of</strong><br />

<strong>the</strong> Joint DOLE-PNIP-PEZA Guidelines in <strong>the</strong> C<strong>on</strong>duct <strong>of</strong> PNP Pers<strong>on</strong>nel, Ec<strong>on</strong>omic<br />

Z<strong>on</strong>e <strong>Police</strong> and Security Guards, Company Security Guards and Similar Pers<strong>on</strong>nel<br />

during Labor Disputes issued <strong>on</strong> 23 May 2011, shall be expanded to include <strong>the</strong> AFP<br />

when <strong>the</strong>ir presence is requested.<br />

A. PEACE-KEEPING ASSISTANCE BY THE PNP PERSONNEL<br />

1) Pursuant to <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> Joint DOLE-PNP-PEZA Guidelines in <strong>the</strong> C<strong>on</strong>duct<br />

<strong>of</strong> PNP Pers<strong>on</strong>nel, Ec<strong>on</strong>omic Z<strong>on</strong>e <strong>Police</strong> and Security Guards, Company Security<br />

Guards and Simi ar Pers<strong>on</strong>nel during Labor Disputes issued <strong>on</strong> 23 May 2011, <strong>the</strong><br />

involvement <strong>of</strong> PNP pers<strong>on</strong>nel during, picketing, strikes, lockouts and labor disputes<br />

in general shall te limited to <strong>the</strong> maintenance <strong>of</strong> peace and order, enforcement <strong>of</strong><br />

laws, and implem?,ntati<strong>on</strong> <strong>of</strong> legal orders <strong>of</strong> <strong>the</strong> duly c<strong>on</strong>stituted authorities.<br />

2) A PNP peace-keeping team or Civil Disturbance Unit shall be assigned in a<br />

picket/strike/lockcut area when requested in writing by <strong>the</strong> DOLE or PEZA, and<br />

subject to <strong>the</strong> following c<strong>on</strong>diti<strong>on</strong>s:<br />

a) The peace-keeping team shall stay at least 50-meter radius away from <strong>the</strong><br />

picket/strike/lockout area. In case <strong>the</strong> 50-meter radius includes a public<br />

thoroughfare, traffic police shall ensure <strong>the</strong> free flow <strong>of</strong> traffic.<br />

b) In <strong>the</strong> exercise <strong>of</strong> <strong>the</strong>ir peace-keeping functi<strong>on</strong>s, members <strong>of</strong> <strong>the</strong> team shall at all<br />

times be in Droper uniform (battle dress uniform or patrol uniform) and with<br />

properly displayed nameplate. They shall:<br />

i. Ensure that <strong>the</strong> strike-bound area is a gun-free and o<strong>the</strong>r deadly weap<strong>on</strong> and<br />

explosive-free z<strong>on</strong>e;<br />

ii. Exercise maximum tolerance and when called for by <strong>the</strong> situati<strong>on</strong> or when all<br />

o<strong>the</strong>r peaceful and n<strong>on</strong>-violent means have been exhausted, may employ as<br />

a last re3ort <strong>on</strong>ly such means as may be necessary and reas<strong>on</strong>able to<br />

prevent o' repeal an aggressi<strong>on</strong>;<br />

Observe coxtesy and strict neutrality, bearing in mind that <strong>the</strong> parties to <strong>the</strong><br />

labor dispu.e are not <strong>the</strong>ir adversaries but <strong>the</strong>ir partners in <strong>the</strong> quest for<br />

industrial peace and human dignity;<br />

Not deliberately inflict any physical harm up<strong>on</strong> strikers and/or picketers or any<br />

pers<strong>on</strong> inyclved in <strong>the</strong> strike /lockout;<br />

Not fraterni le with any <strong>of</strong> <strong>the</strong> parties involved in <strong>the</strong> c<strong>on</strong>troversy, and shall not<br />

accept any invitati<strong>on</strong> from management pers<strong>on</strong>nel or uni<strong>on</strong> <strong>of</strong>ficials/pers<strong>on</strong>nel<br />

involved in <strong>the</strong> c<strong>on</strong>troversy; and<br />

Respect <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>al guarantee <strong>on</strong> <strong>the</strong> right <strong>of</strong> <strong>the</strong> people to be secured<br />

from unreaz<strong>on</strong>able searches and seizures and illegal arrests and detenti<strong>on</strong>s.<br />

3) All o<strong>the</strong>r applicat le provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> Joint DOLE-PNP-PEZA Guidelines in <strong>the</strong><br />

C<strong>on</strong>duct <strong>of</strong> PNP Pers<strong>on</strong>nel, Ec<strong>on</strong>omic Z<strong>on</strong>e <strong>Police</strong> and Security Guards, Company<br />

Security Guards and Similar Pers<strong>on</strong>nel during Labor Disputes issued <strong>on</strong> 23 May<br />

2011, <strong>on</strong> <strong>the</strong> invplvement <strong>of</strong> PNP pers<strong>on</strong>nel during strikes, lockouts and labor<br />

disputes shall be observed.<br />

B. CONDUCT OF AFP PERSONNEL/UN1TS DURING LABOR DISPUTES<br />

1) The provisi<strong>on</strong>s <strong>of</strong> Paragraph 4.6, particularly Secti<strong>on</strong> 4.6.1.1 and Secti<strong>on</strong> 4.6.2.3,<br />

<strong>of</strong> <strong>the</strong> AFP Rules <strong>of</strong> Engagement (ROE) for <strong>the</strong> Implementati<strong>on</strong> <strong>of</strong> IPSP<br />

"Bayanihan" datad 08 March 2011, shall be strictly observed/followed at all times,<br />

to wit:<br />

a) Secti<strong>on</strong> 4.6.1.1 — The AFP support to law enforcement agencies, such as <strong>the</strong><br />

PNP and oth?,r law enforcement agencies, shall be limited <strong>on</strong>ly in providing<br />

assistance in :he maintenance <strong>of</strong> peace and order and enforcement <strong>of</strong> laws, and<br />

in <strong>the</strong> admir istrati<strong>on</strong> <strong>of</strong> justice <strong>on</strong>ly when duly deputized by appropriate<br />

authorities.<br />

b) Secti<strong>on</strong> 4.6.2.3 — Deployment <strong>of</strong> military pers<strong>on</strong>nel, including CAAs and SCAAs,<br />

to address lator-related mass acti<strong>on</strong>s and disputes is strictly prohibited.<br />

2) In case <strong>the</strong>re is a written request from <strong>the</strong> DOLE, through its Regi<strong>on</strong>al Offices, duly<br />

addressed to a specific AFP unit <strong>on</strong> <strong>the</strong> ground and/or its main operati<strong>on</strong>al<br />

headquarters in tie area, for <strong>the</strong> presence <strong>of</strong> AFP pers<strong>on</strong>nel/units in a labor-dispute<br />

area due to a security-situati<strong>on</strong>, <strong>the</strong> AFP shall take <strong>the</strong> Support Role with <strong>the</strong> PNP<br />

taking <strong>the</strong> Lead Role, pursuant to secti<strong>on</strong> 4.6.1.1 <strong>of</strong> <strong>the</strong> AFP Rules <strong>of</strong> Engagement<br />

dated 08 March 2 011.<br />

3) In <strong>the</strong> absence aid/or lack <strong>of</strong> appropriate law enforcement agencies, AFP pers<strong>on</strong>nel<br />

shall be <strong>on</strong> a stand-by mode within <strong>the</strong> vicinity until <strong>the</strong> arrival <strong>of</strong> <strong>the</strong> law enforcement<br />

agencies, unless. o<strong>the</strong>rwise dictated by <strong>the</strong> prevailing security situati<strong>on</strong>. The Unit<br />

Commander <strong>of</strong> <strong>the</strong> AFP unit requested by DOLE shall coordinate at all times with<br />

appropriate DOLE C fficials.<br />

4) Coordinating c<strong>on</strong>ferences must be undertaken, as <strong>the</strong> security situati<strong>on</strong> so permits,<br />

with <strong>the</strong> DOLE anc PNP, and, when needed, with <strong>the</strong> parties-at-be to <strong>the</strong> labor<br />

dispute. These shall determine and clarify <strong>the</strong> exact role <strong>the</strong> AFP has to undertake,<br />

and to inform all cor cerned <strong>of</strong> such.<br />

5) In all <strong>the</strong> above-stored situati<strong>on</strong>s, AFP pers<strong>on</strong>nel must ensure that <strong>the</strong>ir presence in<br />

<strong>the</strong> area is strictly fcr security purposes and must not to take <strong>the</strong> side <strong>of</strong> any party-atbe<br />

to <strong>the</strong> labor dispute. The exercise <strong>of</strong> neutrality and n<strong>on</strong>-partisanship, in <strong>the</strong>se<br />

situati<strong>on</strong>s, must be observed all times <strong>the</strong> AFP is deployed in <strong>the</strong> area.<br />

6) The deployment <strong>of</strong> AFP pers<strong>on</strong>nel/units must always be time-bounded, area-<br />

bounded, and missi Dn-bounded. Unit Commanders must ensure <strong>the</strong> determinati<strong>on</strong> <strong>of</strong><br />

such in coordinatior with <strong>the</strong> DOLE and PNP.<br />

7) The exercise <strong>of</strong> maximum tolerance must always be observed/followed by AFP<br />

pers<strong>on</strong>nel/units.<br />

8) When <strong>the</strong> AFP is in <strong>the</strong> possessi<strong>on</strong> <strong>of</strong> reports <strong>of</strong> possible threats <strong>of</strong> violence within<br />

<strong>the</strong> labor dispute area, <strong>the</strong> AFP Unit in possessi<strong>on</strong> <strong>of</strong> <strong>the</strong> said report must<br />

immediately cause <strong>the</strong> timely relay <strong>of</strong> <strong>the</strong> said informati<strong>on</strong> to <strong>the</strong> DOLE, PNP, and<br />

when possible, <strong>the</strong> parties-at-be to <strong>the</strong> labor dispute. Such relay <strong>of</strong> informati<strong>on</strong> is for<br />

coordinati<strong>on</strong> purposes to prevent such threat from occurring.<br />

9) When actual violence is <strong>on</strong>going or <strong>the</strong>re is a general breakdown <strong>of</strong> peace and order,<br />

and/or <strong>the</strong> security <strong>of</strong> <strong>the</strong> local populace, community/ies, and parties (workers and<br />

management) are already being threatened, <strong>the</strong> AFP may immediately intervene for<br />

<strong>the</strong> sole purpose <strong>of</strong> preventing <strong>the</strong> escalati<strong>on</strong> <strong>of</strong> said <strong>on</strong>-going violence. The<br />

handling <strong>of</strong> <strong>the</strong> situati<strong>on</strong> must immediately be turned-over to <strong>the</strong> PNP, as<br />

appropriate.<br />

10) AFP units/pers<strong>on</strong>n al must not engage in labelling/tagging/red-baiting pers<strong>on</strong>alities/<br />

organizati<strong>on</strong>s unless <strong>the</strong>se are based <strong>on</strong> accurate, verified, validated and c<strong>on</strong>firmed<br />

reports, and/or documentary evidence.<br />

11) All acti<strong>on</strong>s by AFP pers<strong>on</strong>nel/units, as an individual and as a formed unit, must<br />

always be complicit with <strong>the</strong> respect and protecti<strong>on</strong> <strong>of</strong> human rights, adherence to<br />

<strong>the</strong> Internati<strong>on</strong>al Human Rights Law (IHRL)/IHL, and abidance to <strong>the</strong> Rule <strong>of</strong> Law.<br />

Where <strong>the</strong>re are leports <strong>of</strong> c<strong>on</strong>nivance by pers<strong>on</strong>alities/ organizati<strong>on</strong> with threat<br />

groups to violate tie law or in <strong>the</strong> fur<strong>the</strong>rance <strong>of</strong> armed struggle, <strong>the</strong>se are to be<br />

undertaken in acccrdance with due process <strong>of</strong> law.<br />

12) Unit Commanders shall always exercise supervisi<strong>on</strong>, and command and c<strong>on</strong>trol at all<br />

times and discharge <strong>the</strong>ir acti<strong>on</strong>s within <strong>the</strong> Doctrine <strong>of</strong> Command Resp<strong>on</strong>sibility.

13) Violati<strong>on</strong>s <strong>of</strong> <strong>the</strong> above Guidelines by any AFP unit or pers<strong>on</strong>nel may be reported to<br />

<strong>the</strong> unit's Human Rights Officers (HROs) and/or to <strong>the</strong> HROs <strong>of</strong> its higher<br />

headquarters and/o • to <strong>the</strong> Chief, AFP Human Rights Office.<br />

VI. COORDINATION BETWEEN LOCAL GOVERNMENT UNITS (LGUs) AND THE DOLE<br />

DURING LABOR DISPUTES<br />

1)<br />

Labor disputes shall be under <strong>the</strong> primary and sole jurisdicti<strong>on</strong> <strong>of</strong> DOLE and/or its<br />

appropriate agenc es. However, Local Chief Executives or <strong>the</strong>ir authorized<br />

representatives may assist in settling any labor dispute in <strong>the</strong>ir respective local<br />

government units b it shall always coordinate with DOLE and/or its Regi<strong>on</strong>al Offices.<br />

2) Any request for PNP or AFP assistance made by <strong>the</strong> LGU shall be coursed through<br />

<strong>the</strong> DOLE Regi<strong>on</strong>al Offices and it shall be in writing specifying <strong>the</strong> acts to be<br />

performed.<br />

3)<br />

The Inter-Agency Coordinating and M<strong>on</strong>itoring Committee referred to in VII.12 <strong>of</strong> <strong>the</strong><br />

Joint DOLE-PNP-PEZA Guidelines in <strong>the</strong> C<strong>on</strong>duct <strong>of</strong> PNP Pers<strong>on</strong>nel, Ec<strong>on</strong>omic<br />

Z<strong>on</strong>e <strong>Police</strong> and Security Guards, Company Security Guards and Similar Pers<strong>on</strong>nel<br />

during Labor Disputes issued <strong>on</strong> 23 May 2011, shall apply, to include <strong>the</strong> AFP where<br />

applicable.<br />

VII. PNP/AFP DETACHMENTS/PATROL BASES IN RELATION TO LABOR DISPUTES<br />

OR EXERCISE OF TRADE UNION RIGHTS<br />

1) Up<strong>on</strong> coordinati<strong>on</strong> between and am<strong>on</strong>g <strong>the</strong> Regi<strong>on</strong>al Inter-Agency Coordinating and<br />

M<strong>on</strong>itoring Committee (RICMC)/Regi<strong>on</strong>al Tripartite Industrial Peace Council (RTIPC)<br />

and <strong>the</strong> appropria:e Regi<strong>on</strong>al or Provincial or Municipal or City Peace and Order<br />

Council (POC), <strong>the</strong> setting up <strong>of</strong> PNP/AFP detachments/patrol bases is dictated by<br />

"security situati<strong>on</strong>", and <strong>the</strong> moment <strong>the</strong> risk ceases to exist, <strong>the</strong> same should be<br />

dismantled/remove d from <strong>the</strong> said area.<br />

2) In a situati<strong>on</strong> where <strong>the</strong> existing detachment is near or proximate to <strong>the</strong> workplace<br />

where <strong>the</strong>re is a potential or actual labor dispute, or <strong>the</strong>re is an <strong>on</strong>going trade uni<strong>on</strong><br />

organizing or cam Daign for certificati<strong>on</strong> <strong>of</strong> <strong>the</strong> workers' sole and exclusive bargaining<br />

agent, <strong>the</strong> uni<strong>on</strong>, its members, uni<strong>on</strong> organizers or <strong>the</strong> employer may request <strong>the</strong><br />

RICMC/RTIPC tc initiate a dialogue with <strong>the</strong> PNP or <strong>the</strong> AFP detachment<br />

commander to ensure that <strong>the</strong> exercise <strong>of</strong> trade uni<strong>on</strong> rights and workers' civil<br />

liberties are proteoted and respected.<br />

3) If a detachment is yet to be established near or proximate to <strong>the</strong> workplace<br />

regardless <strong>of</strong> whe<strong>the</strong>r <strong>the</strong>re is a potential or actual labor dispute, or trade uni<strong>on</strong><br />

campaigns, <strong>the</strong> u li<strong>on</strong>, its members, uni<strong>on</strong> organizers or <strong>the</strong> employer may request<br />

<strong>the</strong> RICMC/RTIP to initiate a dialogue with <strong>the</strong> PNP or <strong>the</strong> AFP detachment<br />

commander, with z: view to have an accord to ensure respect <strong>of</strong> trade uni<strong>on</strong> rights,<br />

n<strong>on</strong>-interference in trade uni<strong>on</strong> campaigns, and n<strong>on</strong>-engagement in<br />

labelling/tagging/rei-baiting, including <strong>the</strong> appropriate locati<strong>on</strong> <strong>of</strong> <strong>the</strong> detachment,<br />

where necessary.<br />

VIII. RESPECT FOR WC RKERS' RIGHTS DURING AFP INTERNAL PEACE AND<br />

SECURITY OPERATIONS / PNP OPERATIONS<br />

In <strong>the</strong> c<strong>on</strong>duct and exercise <strong>of</strong> AFP internal peace and security operati<strong>on</strong>s/PNP<br />

operati<strong>on</strong>s, <strong>the</strong> workers' rights and civil liberties must be respected, protected and advanced at<br />

all times, and thus, AFP and PNP:<br />

1)<br />

Shall not stigmatize/label workers' organizati<strong>on</strong>s/associati<strong>on</strong>s, labor leaders,<br />

members or organ zers as fr<strong>on</strong>t or members <strong>of</strong> certain c<strong>on</strong>flict armed group/s;<br />

2) Shall not hold or assist in any manner whatsoever in <strong>the</strong> c<strong>on</strong>duct <strong>of</strong> informati<strong>on</strong> drive<br />

or seminars, inside and outside <strong>the</strong> company premises especially during <strong>the</strong> 60-day<br />

freedom period urtil <strong>the</strong> actual c<strong>on</strong>duct <strong>of</strong> certificati<strong>on</strong> electi<strong>on</strong>, to dissuade workers<br />

from organizing a .11-li<strong>on</strong> or participating in <strong>the</strong> certificati<strong>on</strong> electi<strong>on</strong> campaign, or from<br />

voting/ supporting a specific trade uni<strong>on</strong> organizati<strong>on</strong>;<br />

3)<br />

Shall not issue invitati<strong>on</strong> to workers, organizers, or uni<strong>on</strong> <strong>of</strong>ficials <strong>on</strong> <strong>the</strong>ir alleged<br />

links or support o certain armed group/s; however, <strong>the</strong> PNP, in fur<strong>the</strong>rance <strong>of</strong><br />

criminal investigat <strong>on</strong>s, may invite <strong>the</strong>m to shed light; and<br />

4) Shall not force <strong>the</strong>m to renounce membership in <strong>the</strong>ir trade uni<strong>on</strong> organizati<strong>on</strong>.<br />

IX. REMEDY IN CASE OF VIOLATION<br />

1) Any violati<strong>on</strong>s/s a this Guidelines shall be dealt with as follows:<br />

a) For PNP Pers<strong>on</strong>nel:<br />

i. Acts or omissi<strong>on</strong> arising out <strong>of</strong> or in c<strong>on</strong>necti<strong>on</strong> with <strong>the</strong>ir participati<strong>on</strong> in <strong>the</strong><br />

implemen1ati<strong>on</strong> <strong>of</strong> this Guidelines shall be processed and resolved in<br />

accordance with <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> Republic Act No. 6975, "Department <strong>of</strong> <strong>the</strong><br />

Interior ar d Local Government Act <strong>of</strong> 1990", as amended by RA No. 8551,<br />

"<strong>Philippine</strong> Nati<strong>on</strong>al <strong>Police</strong> Reform and Reorganizati<strong>on</strong> Act <strong>of</strong> 1998".<br />

According y, all complaints/ reports <strong>of</strong> violati<strong>on</strong>/s against any pers<strong>on</strong>nel <strong>of</strong> <strong>the</strong><br />

PNP may be filed before <strong>the</strong> PNP-Internal Affairs Service for investigati<strong>on</strong><br />

and c<strong>on</strong>duct <strong>of</strong> summary hearings.<br />

ii. The filing <strong>of</strong> <strong>the</strong> complaint or report is without prejudice to criminal liabilities to<br />

<strong>the</strong> power or authority <strong>of</strong> <strong>the</strong> PNP-IAS to, motu proprio, c<strong>on</strong>duct investigati<strong>on</strong><br />

<strong>on</strong> <strong>the</strong> following cases:<br />

(1) incidents where a police pers<strong>on</strong>nel discharges a firearm;<br />

(2) incidents where death, serious physical injury, or any violati<strong>on</strong> <strong>of</strong><br />

hume n rights occurred in <strong>the</strong> c<strong>on</strong>duct <strong>of</strong> a police operati<strong>on</strong>;<br />

(3)<br />

incidents where evidence was compromised, tampered with,<br />

oblite rated, or lost while in <strong>the</strong> custody <strong>of</strong> police pers<strong>on</strong>nel;<br />

(4) incidents where a suspect in <strong>the</strong> custody <strong>of</strong> <strong>the</strong> police was seriously<br />

injured; and<br />

(5) incid ents where <strong>the</strong> established rules <strong>of</strong> engagement have been<br />

viola:ed.<br />

iii. Any compl aint by a natural or juridical pers<strong>on</strong> against any member <strong>of</strong> <strong>the</strong><br />

PNP may be brought before <strong>the</strong> following <strong>of</strong>fice: Office <strong>of</strong> <strong>the</strong> Ombudsman,<br />

Nati<strong>on</strong>al <strong>Police</strong> Commissi<strong>on</strong> (NAPOLCOM), Chief <strong>of</strong> <strong>Police</strong>, PNP Regi<strong>on</strong>al<br />

Directors, 1\1P Provincial Directors, Mayors, Human Rights Desks in all<br />

police stati<strong>on</strong>s, and <strong>the</strong> People's Law Enforcement Boards (PLEBs).<br />

iv. Any government <strong>of</strong>ficial or supervisor, or <strong>of</strong>ficer <strong>of</strong> <strong>the</strong> <strong>Philippine</strong> Nati<strong>on</strong>al<br />

<strong>Police</strong> or tt at <strong>of</strong> any o<strong>the</strong>r law enforcement agency shall be held accountable<br />

for "neglec: <strong>of</strong> duty' under <strong>the</strong> doctrine <strong>of</strong> "command resp<strong>on</strong>sibility' if he/she<br />

has knowledge that a crime or <strong>of</strong>fense is to or will be committed, is being<br />

committed, or has been committed by his/her subordinates, or by o<strong>the</strong>rs<br />

within his/her area <strong>of</strong> resp<strong>on</strong>sibility and, despite such knowledge, he/she did<br />

not take p 'eventive or corrective acti<strong>on</strong> ei<strong>the</strong>r before, during or immediately<br />

after its co nmissi<strong>on</strong>.<br />

b) For AFP Pers<strong>on</strong>nel:<br />

i. Acts or ornissi<strong>on</strong> arising out <strong>of</strong> or in c<strong>on</strong>necti<strong>on</strong> with <strong>the</strong>ir participati<strong>on</strong> in <strong>the</strong><br />

implementati<strong>on</strong> <strong>of</strong> this Guidelines shall be processed and resolved in<br />

accordance with <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> Republic Act No. 7055, "An Act<br />

Streng<strong>the</strong>ning Civilian Supremacy Over <strong>the</strong> Military by Returning to <strong>the</strong> Civil<br />

Courts <strong>the</strong> Jurisdicti<strong>on</strong> Over Certain Offenses Involving Members <strong>of</strong> <strong>the</strong><br />

Armed Fo-ces <strong>of</strong> <strong>the</strong> <strong>Philippine</strong>s, O<strong>the</strong>r Pers<strong>on</strong>s Subject to Military Law, and<br />

members <strong>of</strong> <strong>the</strong> CAFGUs, who commit crimes or <strong>of</strong>fenses penalized under<br />

<strong>the</strong> Revised Penal Code, o<strong>the</strong>r special penal laws, or local government<br />

ordinances, regardless, <strong>of</strong> whe<strong>the</strong>r or not civilians are co-accused, victims, or<br />

<strong>of</strong>fended parties which may be natural or juridical pers<strong>on</strong>s, shall be tried by<br />

<strong>the</strong> proper civil court, except when <strong>the</strong> <strong>of</strong>fense, as determined before<br />

arraignment by <strong>the</strong> civil court, is service c<strong>on</strong>nected, in which case <strong>the</strong> <strong>of</strong>fense<br />

may, in <strong>the</strong> interest <strong>of</strong> justice, order or direct at any time before arraignment<br />

that any such crimes or <strong>of</strong>fenses be tried by <strong>the</strong> proper civil courts.<br />

c) For elected or appointed <strong>of</strong>ficials or employees in <strong>the</strong> LGU — Complaints shall be<br />

c<strong>on</strong>ducted in accordance with <strong>the</strong> Local Government Code <strong>of</strong> <strong>the</strong> <strong>Philippine</strong>s.<br />

d) For DOLE Pers<strong>on</strong>nel — Complaints shall be processed in accordance with <strong>the</strong><br />

DOLE Manual <strong>on</strong> <strong>the</strong> Dispositi<strong>on</strong> <strong>of</strong> Administrative Cases and <strong>the</strong> Uniform Rules<br />

<strong>on</strong> Administrative Cases in <strong>the</strong> Civil Service.<br />

INDEPENDENT INVESTIGATION IN CASE OF COMPLAINTS OF VIOLATION OF<br />

THE GUIDELINES<br />

1) Notwithstanding th s provisi<strong>on</strong>s <strong>on</strong> <strong>the</strong> remedies available in case <strong>of</strong> violati<strong>on</strong> <strong>of</strong> this<br />

Guidelines, <strong>the</strong> Nati<strong>on</strong>al Tripartite Industrial Peace Council (TIPC), up<strong>on</strong> a<br />

recommendati<strong>on</strong> f 'om <strong>the</strong> sectors or from <strong>the</strong> Regi<strong>on</strong>al Tripartite Industrial Peace<br />

Council-M<strong>on</strong>itoring Body (RTIPC-MB), may c<strong>on</strong>stitute an independent body to verify<br />

or validate claims <strong>of</strong> trade uni<strong>on</strong> rights violati<strong>on</strong>s or violati<strong>on</strong>s <strong>of</strong> this Guidelines<br />

without prejudice to existing mechanisms under <strong>the</strong> Commissi<strong>on</strong> <strong>on</strong> Human Rights<br />

(CHR) or c<strong>on</strong>cerned government agencies.<br />

2) The RTIPC-MB stall validate and document cases <strong>of</strong> violati<strong>on</strong> <strong>of</strong> trade uni<strong>on</strong> rights<br />

and violati<strong>on</strong>s <strong>of</strong> His Guidelines, and shall submit a quarterly m<strong>on</strong>itoring report to <strong>the</strong><br />

NTIPC. In <strong>the</strong> validati<strong>on</strong> and documentati<strong>on</strong> such cases, <strong>the</strong> RTIPC-MB shall<br />

coordinate with ott er government agencies.<br />

3) The PNP-IAS, Off ce <strong>of</strong> <strong>the</strong> Ombudsman, RTIPC-MB or PNP-Human Rights Desks<br />

may also c<strong>on</strong>stitJte an investigating body without filing a complaint <strong>on</strong>ly for<br />

m<strong>on</strong>itoring purposes.<br />

IMPLEMENTATION AND MONITORING OF THE GUIDELINES<br />

1) The existing regi<strong>on</strong>al structure <strong>of</strong> <strong>the</strong> Nati<strong>on</strong>al TIPC-M<strong>on</strong>itoring Body, <strong>the</strong> RTIPC-<br />

M<strong>on</strong>itoring Body, shall ensure observance <strong>of</strong> this Guidelines at <strong>the</strong> local level by<br />

engaging in <strong>the</strong> regi<strong>on</strong>al implementati<strong>on</strong> and m<strong>on</strong>itoring <strong>the</strong> respective regi<strong>on</strong>al<br />

Human Rights Of' ices/Officers <strong>of</strong> <strong>the</strong> AFP and PNP, and <strong>the</strong> regi<strong>on</strong>al <strong>of</strong>ficer <strong>of</strong> <strong>the</strong><br />

CHR.<br />

2) The DOLE toge<strong>the</strong>r with <strong>the</strong> labor sector shall coordinate with <strong>the</strong> AFP/PNP units to<br />

ensure workers' ights are respected at all times.<br />

3) The AFP/PNP shall ensure an open and c<strong>on</strong>tinuing dialogue with <strong>the</strong><br />

workers/uni<strong>on</strong>s/federati<strong>on</strong>s. However, in case <strong>the</strong> uni<strong>on</strong> is affiliated with a labor<br />

federati<strong>on</strong>, <strong>the</strong> AF P/PNP will initiate <strong>the</strong> dialogue at <strong>the</strong> federati<strong>on</strong> level for purposes<br />

<strong>of</strong> exchange <strong>of</strong> informati<strong>on</strong> and c<strong>on</strong>sultati<strong>on</strong>.<br />

XII. DOLE CLEARANCE FRIOR TO TAKING COGNIZANCE OF COMPLAINTS FOR<br />

PRELIMINARY INVESTIGATION<br />

Recognizing <strong>the</strong> primary jurisdicti<strong>on</strong> <strong>of</strong> DOLE over labor disputes and pursuant to <strong>the</strong><br />

DOJ Circular No. 15, Series <strong>of</strong> 1982, and Circular No. 9, Series <strong>of</strong> 1986, fiscals and o<strong>the</strong>r<br />

government prosecutors sha I first secure clearance from <strong>the</strong> DOLE and/or Office <strong>of</strong> <strong>the</strong><br />

President "before taking cogn zance <strong>of</strong> complaints for preliminary investigati<strong>on</strong> and <strong>the</strong> filing in<br />

court <strong>of</strong> <strong>the</strong> corresp<strong>on</strong>ding informati<strong>on</strong> <strong>of</strong> cases arising out <strong>of</strong> or related to a labor dispute,"<br />

including cases with "allegaticns <strong>of</strong> violence, coerci<strong>on</strong>, physical injuries, assault up<strong>on</strong> a pers<strong>on</strong><br />

in authority and o<strong>the</strong>r similar acts <strong>of</strong> intimidati<strong>on</strong> obstructing <strong>the</strong> free ingress to and egress from<br />

a factory or place <strong>of</strong> operati<strong>on</strong> <strong>of</strong> <strong>the</strong> machines <strong>of</strong> such factory, or <strong>the</strong> employer's premises."<br />

XIII. SERVICE OF LAWFUL ORDERS/WRITS ISSUED BY DOLE, COURTS OR DULY<br />

CONSTITUTED AUTI- ORITIES<br />

1) The service <strong>of</strong> lavi.ful Order/Writ issued by <strong>the</strong> DOLE is <strong>the</strong> primary c<strong>on</strong>cern <strong>of</strong> <strong>the</strong><br />

DOLE's duly autlorized representatives and/or sheriff. Before service <strong>of</strong> <strong>the</strong><br />

OrderANrit, <strong>the</strong> DCLE representative and/or sheriff shall:<br />

a) Coordinate and dialogue with <strong>the</strong> leaders <strong>of</strong> <strong>the</strong> workers and <strong>the</strong> representatives<br />

<strong>of</strong> management and explain <strong>the</strong> nature and c<strong>on</strong>tent <strong>of</strong> <strong>the</strong> Order/Writ to be<br />

enforced incluc ing possible c<strong>on</strong>sequences <strong>of</strong> any defiance <strong>the</strong>reto; and<br />

b) Coordinate wit 1 PNP when violence is imminent.<br />

2) Where PNP/AFP assistance is sought in <strong>the</strong> service <strong>of</strong> <strong>the</strong> Order/Writ issued by<br />

courts or o<strong>the</strong>r duly c<strong>on</strong>stituted authorities in relati<strong>on</strong> to or arising out <strong>of</strong> labor<br />

disputes, it shall De <strong>the</strong> duty <strong>of</strong> <strong>the</strong> AFP/PNP to observe this Guidelines and to<br />

coordinate with <strong>the</strong> DOLE and/or its appropriate agencies <strong>of</strong> <strong>the</strong> service <strong>of</strong> <strong>the</strong><br />

Order/VVrit.<br />

XIV. PERIODIC REVIEW AND ADJUSTMENTS<br />

1) The Nati<strong>on</strong>al TIP:, created under Executive Order No. 403, Series <strong>of</strong> 1990, as<br />

amended by Executive Order No. 49, Series <strong>of</strong> 1998, shall serve as <strong>the</strong> Oversight<br />

Committee in <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> this Guidelines. It shall initiate review and<br />

adjustments <strong>of</strong> thi Guidelines with <strong>the</strong> DND, DILG, DOJ, AFP, and PNP.<br />

2) The Nati<strong>on</strong>al TIPC shall c<strong>on</strong>tinue to engage <strong>the</strong> DND, AFP, PNP, NAPOLCOM and<br />

DILG in social die logue to address c<strong>on</strong>cerns relating to <strong>the</strong> exercise <strong>of</strong> trade uni<strong>on</strong><br />

rights and civil liberties.<br />

superseded.<br />

XVII. SEPARABILITY CLAUSE<br />

if any provisi<strong>on</strong> or porticn <strong>of</strong> this Guidelines are declared void or unc<strong>on</strong>stituti<strong>on</strong>al, <strong>the</strong><br />

remaining porti<strong>on</strong>s or provisi<strong>on</strong>s here<strong>of</strong> shall c<strong>on</strong>tinue to be valid and effective.<br />

XVIII. EFFECTIVITY<br />
