The <strong>Art</strong> <strong>of</strong> <strong>Healing</strong><br />

<strong>Art</strong>icle: 1<br />

According to <strong>the</strong> terms <strong>of</strong> this law, <strong>the</strong> art <strong>of</strong> healing shall include <strong>the</strong> medical art, <strong>the</strong> dental<br />

art and <strong>the</strong> pharmaceutical art viewed under <strong>the</strong>ir curative and preventive aspects and<br />

practised with regard to human-beings.<br />

<strong>Art</strong>icle: 2<br />

Any pers<strong>on</strong> practising <strong>on</strong>e <strong>of</strong> <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>s related to <strong>the</strong> art <strong>of</strong> healing shall subject his<br />

activities to <strong>the</strong> c<strong>on</strong>trol <strong>of</strong> <strong>the</strong> Minister resp<strong>on</strong>sible for <strong>Health</strong><br />

Chapter 1. MEDICAL ART<br />

<strong>Art</strong>icle: 3<br />

Shall be qualified as a medical act, any act whose purpose is ei<strong>the</strong>r to prevent, or to examine<br />

a state <strong>of</strong> health, to detect diseases or deficiencies, to establish a diagnosis, to treat,<br />

pathological or psychic cases, real or imaginary, or to m<strong>on</strong>itor delivery and post-partum.<br />

Normal accomplishment <strong>of</strong> such in act by a pers<strong>on</strong> complying with <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s required in<br />

article 4 <strong>of</strong> this law shill c<strong>on</strong>stitute <strong>the</strong> practice <strong>of</strong> <strong>the</strong> medical art.<br />

<strong>Art</strong>icle: 4<br />

Without prejudice to particular provisi<strong>on</strong>s c<strong>on</strong>cerning <strong>the</strong> practice <strong>of</strong> Rwanda traditi<strong>on</strong>al<br />

medicine, no <strong>on</strong>e can practise <strong>the</strong> medical art in Rwanda:<br />

1 ° Unless he/she is <strong>of</strong> Rwandan nati<strong>on</strong>ality and holder <strong>of</strong> a duly acceptable university degree<br />

<strong>of</strong> doctorate in medicine. However, a foreigner can, <strong>on</strong> authorizati<strong>on</strong> by <strong>the</strong> Minister in charge<br />

<strong>of</strong> <strong>Health</strong>, practise his art in Rwanda, without prejudice to reciprocity and recogniti<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

equivalent rating <strong>of</strong> his degree by <strong>the</strong> Minister resp<strong>on</strong>sible for Higher Educati<strong>on</strong>.<br />

The <strong>Ministry</strong> <strong>of</strong> <strong>Health</strong> shall require <strong>the</strong> foreigner who wants to practise <strong>the</strong> medical art in<br />

Rwanda to show a certificate <strong>of</strong> morality granted to <strong>the</strong> applicant -by <strong>the</strong> Nati<strong>on</strong>al Medical<br />

Associati<strong>on</strong> <strong>of</strong> his/her country.<br />

2° Can also practise <strong>the</strong> medical art, <strong>the</strong> holder <strong>of</strong> Rwandan nati<strong>on</strong>ality, <strong>of</strong> a foreign degree<br />

whose equivalent rating has been established in accordance with <strong>the</strong> laws in force in Rwanda.<br />

3° Students in medicine can be authorized to carry out part <strong>of</strong> <strong>the</strong>ir practical training under a<br />

doctor in medicine according to <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s and modes as shall be determined by an order<br />

issued by <strong>the</strong> Minister resp<strong>on</strong>sible for <strong>Health</strong>.<br />

<strong>Art</strong>icle: 5<br />

The Minister resp<strong>on</strong>sible for <strong>Health</strong> will determine, by order, <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s in which doctors<br />

can, under <strong>the</strong>ir resp<strong>on</strong>sibility and c<strong>on</strong>trol, c<strong>on</strong>fide to a paramedical pers<strong>on</strong>nel <strong>the</strong><br />

accomplishment <strong>of</strong> certain acts preliminary to diagnosis or relating to <strong>the</strong> applicati<strong>on</strong> <strong>of</strong><br />

medical treatment or <strong>the</strong> executi<strong>on</strong> <strong>of</strong> preventive medical measures, or <strong>the</strong> eutocicous<br />

midwifery.<br />

Traditi<strong>on</strong>al medicine shall not be governed by this law. A particular law shall determine its<br />

practising c<strong>on</strong>diti<strong>on</strong>s.<br />

Chapter 2. DENTISTRY<br />

<strong>Art</strong>icle: 7<br />

Dentistry shall include practical manipulati<strong>on</strong>s and interventi<strong>on</strong>s in <strong>the</strong> patients'buccal cavity<br />

aimed at preserving, curing, redressing or replacing <strong>the</strong> dental organ, those manipulati<strong>on</strong>s and<br />

interventi<strong>on</strong>s being namely related to operatory dentistry, orthod<strong>on</strong>tics and oral pro<strong>the</strong>sis.<br />

The usual accomplishment <strong>of</strong> <strong>the</strong> acts as defined in <strong>the</strong> preceding paragraph by a pers<strong>on</strong><br />

complying with <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s required in article 8 <strong>of</strong> this law c<strong>on</strong>stituted <strong>the</strong> practice <strong>of</strong><br />

dentistry.<br />

<strong>Art</strong>icle: 8<br />

With <strong>the</strong> excepti<strong>on</strong> <strong>of</strong> pers<strong>on</strong>s set out in article 8, no <strong>on</strong>e can practise dentistry unless he/her<br />

is a holder <strong>of</strong> a duty acceptable university degree <strong>of</strong> licence in dental sciences or <strong>of</strong> dental<br />

surgery.<br />

Can also practise dentistry, holders <strong>of</strong> a foreign degree whose equivalent rating has been<br />

legally recognized in Rwanda.<br />

However, <strong>the</strong> <strong>Ministry</strong> resp<strong>on</strong>sible for <strong>Health</strong> can, by order, in c<strong>on</strong>sultati<strong>on</strong> with <strong>the</strong> Nati<strong>on</strong>al<br />

Associati<strong>on</strong> <strong>of</strong> Doctors, grant exempti<strong>on</strong> from <strong>the</strong> degrees required in <strong>the</strong> preceding<br />

paragraphs.<br />

Chapter 3. THE PHARMACEUTICAL ART<br />

<strong>Art</strong>icle: 9<br />

For <strong>the</strong> purposes <strong>of</strong> this law, pharmaceutical art means any act aimed at preparing,<br />

manufacturing, c<strong>on</strong>trolling quality, c<strong>on</strong>diti<strong>on</strong>ing, preserving, as well as dispensing, even free<br />

<strong>of</strong> charge, drugs and o<strong>the</strong>r - pharmaceutical products in c<strong>on</strong>formity with this pr<strong>of</strong>essi<strong>on</strong>al art.<br />

<strong>Art</strong>icle: 10<br />

With <strong>the</strong> excepti<strong>on</strong> <strong>of</strong> some special cases provided for in <strong>the</strong> specific laws, no <strong>on</strong>e can practise<br />

<strong>the</strong> pharmaceutical art unless he/she is a holder <strong>of</strong> a duty acceptable university degree <strong>of</strong><br />

pharmacist or <strong>of</strong> a foreign degree whose equivalent rating has been established in accordance<br />

with <strong>the</strong> laws in force in Rwanda.<br />

Students in pharmacy can practise <strong>the</strong> pharmaceutical art during <strong>the</strong>ir final year <strong>of</strong> practical<br />

training, under a qualified pharmacy trainer's c<strong>on</strong>trol and supervisi<strong>on</strong>.<br />

Modes to start and exploiting pharmaceutical establishments shall be determined by a<br />

particular law.


Title II. PROFESSIONS RELATED TO THE ART OF HEALING<br />

<strong>Art</strong>icle: 11<br />

For <strong>the</strong> purposes <strong>of</strong> this law, pr<strong>of</strong>essi<strong>on</strong>s related to <strong>the</strong> art <strong>of</strong> healing shall be <strong>the</strong> nursing art<br />

and <strong>the</strong> paramedical art.<br />

Chapter 1. THE NURSING ART<br />

<strong>Art</strong>icle: 12<br />

The nursing art shall c<strong>on</strong>sist <strong>of</strong>:<br />

1) Observing and finding <strong>the</strong> patient's physical as well as psychic symptoms and reacti<strong>on</strong>s so<br />

as to c<strong>on</strong>tribute to <strong>the</strong> establishment <strong>of</strong> diagnosis by <strong>the</strong> doctor and to <strong>the</strong> applicati<strong>on</strong> <strong>of</strong><br />

medical treatment, in order to provide <strong>the</strong> patient with <strong>the</strong> care appropriate to his health<br />

state.<br />

2) Taking care <strong>of</strong> a healthy or sick pers<strong>on</strong> with <strong>the</strong> aim <strong>of</strong> helping him/her by a sustained<br />

assistance in <strong>the</strong> accomplishment <strong>of</strong> acts relating to keeping him/her in good health,<br />

improving his health and restoring him/her to health or c<strong>on</strong>forting him in his last hour.<br />

3) Accomplishing technical medical care through measures relating to preventive and sanitary<br />

medicine.<br />

<strong>Art</strong>icle: 13<br />

No <strong>on</strong>e can practise <strong>the</strong> nursing art unless he/she is a holder <strong>of</strong> a diploma in nursing and<br />

medical assistance which has been issued to him in c<strong>on</strong>formity with legal provisi<strong>on</strong>s in force in<br />

Rwanda, or unless he/she is a holder <strong>of</strong> a foreign diploma, whose equivalent rating has legally<br />

been recognized by <strong>the</strong> Minister resp<strong>on</strong>sible for Sec<strong>on</strong>dary Educati<strong>on</strong>.<br />

Nursing school pupils can practise <strong>the</strong> nursing art during <strong>the</strong> practical training period in <strong>the</strong><br />

final years <strong>of</strong> <strong>the</strong>ir studies, under <strong>the</strong> trainer's supervisi<strong>on</strong>.<br />

However, <strong>the</strong> Minister resp<strong>on</strong>sible for <strong>Health</strong> can determine <strong>the</strong> c<strong>on</strong>diti<strong>on</strong> <strong>of</strong> exempti<strong>on</strong> for<br />

pers<strong>on</strong>s who do not fulfil <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s provided for in first paragraph <strong>of</strong> this law.<br />

Chapter 2. THE PARAMEDICAL ART<br />

<strong>Art</strong>icle: 14<br />

For <strong>the</strong> purpose <strong>of</strong> this law, practising <strong>the</strong> pharmaceutical art shall mean usual<br />

accomplishment <strong>of</strong> auxiliary technical acts related to <strong>the</strong> establishment <strong>of</strong> diagnosis or <strong>the</strong><br />

executi<strong>on</strong> <strong>of</strong> treatment or preventive medicine measures, by pers<strong>on</strong>s o<strong>the</strong>r than those set out<br />

in articles 4, 8, 10 and 13 <strong>of</strong> this law.<br />

A ministerial order shall determine acts which may be c<strong>on</strong>fided by physicians and pharmacists<br />

to paramedical agents under <strong>the</strong>ir c<strong>on</strong>trol and resp<strong>on</strong>sibility.


<strong>Art</strong>icle: 15<br />

The Minister resp<strong>on</strong>sible for <strong>Health</strong> shall determine by ministerial order, <strong>the</strong> list <strong>of</strong> paramedical<br />

pr<strong>of</strong>essi<strong>on</strong>s and acts corresp<strong>on</strong>ding to <strong>the</strong>m<br />

<strong>Art</strong>icle: 16<br />

No <strong>on</strong>e can practise <strong>the</strong> paramedical art unless he/she holds a duty acceptable diploma<br />

obtained in Rwanda or a foreign diploma whose equivalent rating has been legally recognized<br />

allowing <strong>the</strong> bearer to practise a specific task <strong>of</strong> <strong>the</strong> paramedical pr<strong>of</strong>essi<strong>on</strong>.<br />

Title III. COMMON PROVISIONS<br />

Chapter 1. MODES OF PRACTICE<br />

<strong>Art</strong>icle: 17<br />

Practiti<strong>on</strong>ers <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing set out in articles 4, 8, 10, 13 and 14 can practise <strong>the</strong>ir art:<br />

1) Independently al<strong>on</strong>e or in associati<strong>on</strong>s, or c<strong>on</strong>tractually with health establishments;<br />

2) In State <strong>Health</strong> Establishments;<br />

3) In health establishments linked to <strong>the</strong> state scheme.<br />

<strong>Art</strong>icle: 18<br />

C<strong>on</strong>diti<strong>on</strong>s and modes <strong>of</strong> practice <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing shall be determined by an order issued<br />

by <strong>the</strong> Minister resp<strong>on</strong>sible for health.<br />

<strong>Art</strong>icle: 19<br />

The list <strong>of</strong> specialities <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing and modes <strong>of</strong> <strong>the</strong>ir practice will be determined by<br />

<strong>the</strong>ir Associati<strong>on</strong>, in c<strong>on</strong>sultati<strong>on</strong> with <strong>the</strong> Minister resp<strong>on</strong>sible for <strong>Health</strong>.<br />

<strong>Art</strong>icle: 20<br />

Practiti<strong>on</strong>ers set out in articles 4, 8 and 10 cannot be subjected to any statutory-restricti<strong>on</strong> in<br />

selecting means <strong>the</strong>y shall use ei<strong>the</strong>r for establishing <strong>the</strong> diagnosis, or instituting and<br />

executing <strong>the</strong> treatment, or for executing magistral preparati<strong>on</strong>s. Infringments <strong>of</strong> freedom in<br />

those three aspects <strong>on</strong> <strong>the</strong>ir part shall be punished by <strong>the</strong> associati<strong>on</strong>s <strong>the</strong>y are resp<strong>on</strong>sible<br />

to, without prejudice to <strong>the</strong> applicati<strong>on</strong> criminal laws in force by legal authorities.<br />

<strong>Art</strong>icle: 21<br />

Are c<strong>on</strong>sidered as not written in <strong>the</strong> c<strong>on</strong>venti<strong>on</strong>s c<strong>on</strong>cluded by practiti<strong>on</strong>ers set out in articles<br />

4, 8 and 10 <strong>of</strong> this law, <strong>the</strong> clauses which shall interfere with <strong>the</strong> freedom <strong>of</strong> choice provided<br />

for in <strong>the</strong> preceding article.<br />

<strong>Art</strong>icle: 22<br />

Practiti<strong>on</strong>ers set out in articles 4, 8 and 10 shall have a right, in c<strong>on</strong>formity with <strong>the</strong><br />

pr<strong>of</strong>essi<strong>on</strong>al code <strong>of</strong> ethics, to h<strong>on</strong>oraria or remunerati<strong>on</strong>s for <strong>the</strong> services <strong>the</strong>y have provided.<br />

The amount <strong>of</strong> h<strong>on</strong>oraria shall be determined freely by <strong>the</strong> practiti<strong>on</strong>ers <strong>the</strong>mselves in<br />

reference to <strong>the</strong> ceiling <strong>of</strong> salaries which shall be determined by <strong>the</strong> Minister resp<strong>on</strong>sible for<br />

<strong>Health</strong>, in c<strong>on</strong>sultati<strong>on</strong> with <strong>the</strong> practiti<strong>on</strong>er's associati<strong>on</strong>s.<br />

<strong>Art</strong>icle: 23


Practiti<strong>on</strong>ers set out in articles 4, 8 and 10 shall not be allowed, <strong>on</strong> purpose or without a<br />

legitimate reas<strong>on</strong>, to interrupt a treatment without first having made all arrangements for <strong>the</strong><br />

treatment to be c<strong>on</strong>tinued by ano<strong>the</strong>r practiti<strong>on</strong>er having <strong>the</strong> same duty acceptable<br />

qualificati<strong>on</strong><br />

<strong>Art</strong>icle: 24<br />

Practiti<strong>on</strong>ers <strong>of</strong> <strong>the</strong> branches <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing shall not be allowed <strong>on</strong> purpose and without<br />

a legitimate, to close temporarily or definitively <strong>the</strong> establishments <strong>the</strong>y are in charge <strong>of</strong>,<br />

without having first made all arrangements for <strong>the</strong> treatment to be carried <strong>on</strong>.<br />

The practiti<strong>on</strong>ers'Associati<strong>on</strong>s Councils shall see to <strong>the</strong> enforcement <strong>of</strong> this provisi<strong>on</strong>.<br />

<strong>Art</strong>icle: 25<br />

With <strong>the</strong> aim <strong>of</strong> c<strong>on</strong>tinuing or completing <strong>the</strong> diagnosis or <strong>the</strong> treatment, any practiti<strong>on</strong>er set<br />

out in articles 4, 8 and 10 shall be required, at <strong>the</strong> patient's request or in agreement with him,<br />

to pass to ano<strong>the</strong>r practiti<strong>on</strong>er who has been designated by <strong>the</strong> patient, all medical or<br />

pharmaceutical useful and necessary informati<strong>on</strong> about <strong>the</strong> latter. He/she will notify <strong>the</strong><br />

patient's doctor that.<br />

Councils <strong>of</strong> <strong>the</strong> practiti<strong>on</strong>er's associati<strong>on</strong>s shall see to <strong>the</strong> enforcement <strong>of</strong> <strong>the</strong> law provided for<br />

in <strong>the</strong> preceding paragraph.<br />

Chapter 2. PROHIBITIONS<br />

<strong>Art</strong>icle: 26<br />

Under no circumstances and in no way, pr<strong>of</strong>essi<strong>on</strong>s <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing can be practised for<br />

purely pr<strong>of</strong>it-making purposes.<br />

Practiti<strong>on</strong>ers should c<strong>on</strong>form to <strong>the</strong> norms as defined by <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>al code <strong>of</strong> ethics.<br />

<strong>Art</strong>icle: 27<br />

Practising <strong>the</strong> art <strong>of</strong> healing under a fictitious name is prohibited.<br />

<strong>Art</strong>icle: 28<br />

Any form <strong>of</strong> collusi<strong>on</strong> between practiti<strong>on</strong>ers <strong>the</strong>mselves and between practiti<strong>on</strong>ers and third<br />

parties such as manufacturers <strong>of</strong> pharmaceutical products or suppliers <strong>of</strong> medical appliances<br />

or pro<strong>the</strong>sis, shall be prohibited.<br />

<strong>Art</strong>icle: 29<br />

Practiti<strong>on</strong>ers shall never carry out c<strong>on</strong>sultati<strong>on</strong> activities within commercial premises where<br />

<strong>the</strong> appliances <strong>the</strong>y prescribe or used are sold.<br />

<strong>Art</strong>icle: 30<br />

Except if this is d<strong>on</strong>e within <strong>the</strong> framework <strong>of</strong> <strong>the</strong> organisati<strong>on</strong> <strong>of</strong> medical care provisi<strong>on</strong> by<br />

groups <strong>of</strong> practiti<strong>on</strong>ers and if this is made known to <strong>the</strong> patient, sharing h<strong>on</strong>oraria am<strong>on</strong>g<br />

practiti<strong>on</strong>ers <strong>of</strong> <strong>the</strong> same branch <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing is prohibited in all its forms.<br />

<strong>Art</strong>icle: 31<br />

Unless o<strong>the</strong>rwise provided for in particular laws, any form <strong>of</strong> plurality <strong>of</strong> pr<strong>of</strong>essi<strong>on</strong>s in <strong>the</strong><br />

practice <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing and plurality <strong>of</strong> exploitati<strong>on</strong>s within <strong>the</strong> same pr<strong>of</strong>essi<strong>on</strong> are


prohibited.<br />

<strong>Art</strong>icle: 32<br />

For <strong>the</strong> purposes <strong>of</strong> this law, any qualified practiti<strong>on</strong>er shall be prohibited from collaborating in<br />

any case with an unqualified third party or from acting as his figurehead with <strong>the</strong> aim <strong>of</strong><br />

shielding him from undergoing <strong>the</strong> penalities against <strong>the</strong> illegal practice <strong>of</strong> pr<strong>of</strong>essi<strong>on</strong>s as<br />

defined in articles 3, 8, 13 and 16.<br />

He/she shall also be prohibited from providing in any case any help or assistance for an<br />

unqualified third party with <strong>the</strong> aim <strong>of</strong> allowing him to practise <strong>on</strong>e <strong>of</strong> <strong>the</strong> arts provided for in<br />

<strong>the</strong> same articles.<br />

<strong>Art</strong>icle: 33<br />

No <strong>on</strong>e can attribute to pers<strong>on</strong>s he/she employs even for nothing a pr<strong>of</strong>essi<strong>on</strong>al title relating<br />

to <strong>the</strong> services set out in articles 3 paragraph I and 11 <strong>of</strong> this law if those pers<strong>on</strong>s do not fulfill<br />

<strong>the</strong> required qualifying c<strong>on</strong>diti<strong>on</strong>s.<br />

Chapter 3. DISCIPLINARY JURISDICTIONS<br />

<strong>Art</strong>icle: 34<br />

It shall be established for each branch <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing disciplinary jurisdicti<strong>on</strong>s hereafter<br />

referred to as "Associati<strong>on</strong>s":<br />

a) The Associati<strong>on</strong> <strong>of</strong> Doctors and Dentists;<br />

b) The Associati<strong>on</strong> <strong>of</strong> Pharmacists;<br />

c) The Associati<strong>on</strong> <strong>of</strong> Nurses and Midwives<br />

<strong>Art</strong>icle: 35<br />

The associati<strong>on</strong>s will have <strong>the</strong> mandate to ensure that <strong>the</strong> principles <strong>of</strong> morality, probity and<br />

dedicati<strong>on</strong> <strong>of</strong> <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>s <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing shall be maintained and that <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>al<br />

code <strong>of</strong> ethics shall be respected by all its members.<br />

They will ensure <strong>the</strong> defence <strong>of</strong> h<strong>on</strong>our and <strong>the</strong> independence <strong>of</strong> <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>s <strong>of</strong> <strong>the</strong> art <strong>of</strong><br />

healing. Their organizati<strong>on</strong> and competencies will be determined by <strong>the</strong> law.<br />

The associati<strong>on</strong>s shall enact internal regulati<strong>on</strong>s and define <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>al code <strong>of</strong> ethics, as<br />

well as <strong>the</strong> disciplinary measures for each branch.<br />

The Minister resp<strong>on</strong>sible for <strong>Health</strong> publishes, those regulati<strong>on</strong>s and deol<strong>on</strong>tological codes and<br />

disciplinary measures in <strong>the</strong> Official Journal <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Rwanda.<br />

Title IV. PENALTY AND DISCIPLINARY PROVISIONS<br />

<strong>Art</strong>icle: 36<br />

Any pers<strong>on</strong> who will exercise <strong>the</strong> art <strong>of</strong> healing in n<strong>on</strong> c<strong>on</strong>formity with <strong>the</strong> moral and<br />

de<strong>on</strong>tological code will be liable to impris<strong>on</strong>ment <strong>of</strong> 6 to 12 m<strong>on</strong>ths and a fine <strong>of</strong> two hundred<br />

thousand to five hundred thousand rwandan francs or to <strong>on</strong>ly <strong>on</strong>e <strong>of</strong> <strong>the</strong>se two penalties; and,


in <strong>the</strong> event <strong>of</strong> a repetiti<strong>on</strong> <strong>of</strong> <strong>the</strong> <strong>of</strong>fence, he/she will be liable to impris<strong>on</strong>ment <strong>of</strong> <strong>on</strong>e to two<br />

years and a fine <strong>of</strong> five hundred thousand to <strong>on</strong>e milli<strong>on</strong> Rwanda francs, or <strong>on</strong>ly <strong>on</strong>e <strong>of</strong> those<br />

two penalties.<br />

<strong>Art</strong>icle: 37<br />

Without prejudice to <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> in article 13 <strong>of</strong> this law, <strong>the</strong> practiti<strong>on</strong>er set out in<br />

articles 4, 8 <strong>of</strong> this law who habitually c<strong>on</strong>fided to helpers <strong>the</strong> resp<strong>on</strong>sibility <strong>of</strong> performing <strong>on</strong>e<br />

or more activities partaining to <strong>the</strong> art <strong>of</strong> healing c<strong>on</strong>trarily to specific regulati<strong>on</strong>s meant for<br />

<strong>the</strong> implementati<strong>on</strong> <strong>of</strong> this law, shall be punished through impris<strong>on</strong>ment during a period not<br />

exceeding six mouths and fine not exceeding two hundred fifty thousand rwandan francs or<br />

<strong>on</strong>ly <strong>on</strong>e <strong>of</strong> those penalties.<br />

Title V. FINAL PROVISIONS<br />

<strong>Art</strong>icle: 38<br />

Unless o<strong>the</strong>rwise provided in laws specific to certain branches <strong>of</strong> <strong>the</strong> art <strong>of</strong> healing, pers<strong>on</strong>s<br />

who, at <strong>the</strong> coming into force <strong>of</strong> this law, exercise <strong>the</strong> art <strong>of</strong> healing and related pr<strong>of</strong>essi<strong>on</strong>s<br />

without fulfilling <strong>the</strong> requirements provided for in this law, will not be entitled to c<strong>on</strong>tinue<br />

exercising that art.<br />

<strong>Art</strong>icle: 39<br />

The Minister having health in his/her portfolio can authorise nurses to perform certain duties<br />

reserved to practicians as menti<strong>on</strong>ned in articles 4, 8, 10 and 14 <strong>of</strong> this law, and <strong>the</strong> way in<br />

which <strong>the</strong>ir acitivities are remunerated.<br />

<strong>Art</strong>icle: 40<br />

All previous provisi<strong>on</strong>s c<strong>on</strong>trary to this law are abrogated.<br />

<strong>Art</strong>icle: 41<br />

This law comes into force <strong>on</strong> <strong>the</strong> date <strong>of</strong> its publicati<strong>on</strong> in <strong>the</strong> <strong>of</strong>ficial gazette <strong>of</strong> <strong>the</strong> Republic <strong>of</strong><br />

Rwanda.
