entire Government <strong>of</strong> Kosova. Such an outcome is desired by neither international<br />
community nor the current governing coalition. <strong>The</strong>refore, the interests between the<br />
Government and UNMIK are closely inter-connected in this regard, which as a result<br />
provide for a safe haven to the political crime and corruption.<br />
<strong>The</strong> right <strong>of</strong> the sovereign<br />
<strong>The</strong> SRSG, as the ultimate authority in Kosova according to Resolution 1244/99 <strong>of</strong> the<br />
UN Security Council, enjoys the right not to publish the Auditor’s report. According to<br />
the Regulation on establishment <strong>of</strong> the Auditor General 2002/18, article 3, paragraph<br />
3.3 b): “Within thirty (30) days following receipt <strong>of</strong> such report, the SRSG shall issue<br />
to the Auditor-General a written instruction stating whether the Auditor General may<br />
provide the report to other persons, institutions or entities, as set out in the present<br />
Regulation.” 34<br />
Audits <strong>of</strong> sectors controlled by the unMIK<br />
Till present, no institution categorized as an UNMIK’s reserved competence has been<br />
audited or such reports about it been published. According to un<strong>of</strong>ficial media information,<br />
an audit had been conducted in the Kosova Trust Agency, the body in charge<br />
<strong>of</strong> the privatization process. <strong>The</strong> report on KTA, according to the same sources, has<br />
not been published by the auditor, but the financial audit has uncovered numerous<br />
violations by the institutions.<br />
In case this audit has been conducted, as the newspaper reports, the Auditor’s decision<br />
not to publish it just proved the audits not only take place depending on the<br />
political interests <strong>of</strong> those in power, but the publication <strong>of</strong> such reports is politically<br />
motivated as well. In fact, the matter becomes clearer when sources from UNMIK<br />
claim that the publication <strong>of</strong> the Auditor’s report on KTA has been blocked by Joachim<br />
Rucker, himself, as until a year ago, he had been the main power in the KTA. Another<br />
case brought into debate the Rucker’s name quite a lot. This had to do with his responsibility,<br />
or at least abstention, that would prevent manipulations during Ferronickel’s<br />
privatization. UNMIK sources claim that the publication <strong>of</strong> the Auditor’s report<br />
on Ferronickel has also been stopped by Rucker.<br />

Audits <strong>of</strong> sectors controlled by the Government <strong>of</strong> Kosova<br />
<strong>The</strong>re are other reports that UNMIK prevents the Auditor General from their publication,<br />
beside those <strong>of</strong> KTA and Ferronickel. Such are reports on the Prime Ministry,<br />
Ministry <strong>of</strong> Economy and Finance, and Ministry <strong>of</strong> Public Services. Although the reports<br />
on the Ministry <strong>of</strong> Trade and Industry for the period prior to the current governing<br />
coalition and the report on the Ministry <strong>of</strong> Community and Returns have been published<br />
shortly after their completion the Auditor General and UNMIK continue to keep<br />
secret reports on these three budgetary organizations during the rule <strong>of</strong> the current<br />
governing coalition.<br />
