Proper functioning <strong>of</strong> the justice sector in Kosova needs proper functioning <strong>of</strong> other<br />
state mechanisms as well. Already identified lack <strong>of</strong> political will to fight corruption<br />
and organized crime in Kosova affects first and foremost the justice sector. In this<br />
context, reforming and proper functioning <strong>of</strong> the judiciary will result from completion<br />
<strong>of</strong> the projects by engaged stakeholders in overall proper functioning <strong>of</strong> Kosovar<br />
society. In the meantime, the quality <strong>of</strong> the judiciary’s work, until the consolidation<br />
<strong>of</strong> the Kosovar state, will be closely inter-linked with the political cost <strong>of</strong> the engaged<br />
actors. Inclusion <strong>of</strong> international institutions in the functioning <strong>of</strong> justice sector makes<br />
it difficult for the citizens to identify the contributors or those responsible for created<br />
situation. For this purpose, it is highly necessary to set clearly which are the objectives<br />
<strong>of</strong> the listed institutions for certain periods <strong>of</strong> time and who are those responsible for<br />
certain actions. <strong>The</strong> public opinion must be informed on the entire process, and not<br />
only when certain developments make “news.” Increasing the access to information<br />
for the media and public is a high necessity that requires urgent attention by Kosovar<br />
justice sector.<br />
To overcome the backlog <strong>of</strong> accumulated cases for a period <strong>of</strong> time that would be<br />
considered acceptable, the Kosovar courts must increase the number <strong>of</strong> judges at sensitive<br />
levels. Otherwise, the justice sector would be left with an over-floated administration.<br />
Putting into function the expedited procedures, establishment <strong>of</strong> ‘ad hoc’<br />
institutions to treat certain categories <strong>of</strong> cases, or putting into action extra-judiciary<br />
resolution practices like mediation and arbitration could be only few elements <strong>of</strong> this<br />
strategy.<br />
Finally, there is an urgency to complete the legal framework which would enable<br />
progress on system’s reformation, with a special emphasis on creating <strong>of</strong> an enabling<br />
environment for a justice sector independent <strong>of</strong> politics.<br />
