oster of certified investigators. The Chief of Naval Operations (CNO),<br />

the Commandant of the Marine Corps (CMC), all major commands, and<br />

all Secretariat offices are required to identify individuals to serve as<br />

investigators. Mandatory service is required of all DON investigators.<br />

2. Preliminary Review.<br />

If the CNO, CMC, or a major command has evidence that a potential<br />

ADA has occurred, the major command should appoint a qualified<br />

investigator in writing to conduct a preliminary review to determine if, in<br />

fact, a violation has occurred. A copy of the appointing letter, the results<br />

of the preliminary review, and all supporting documentation are to be<br />

provided to OASN(FM&C), Budget Policy and Procedures Division,<br />

FMB-5, for final disposition.<br />

3. Formal Investigation.<br />

If it is determined that an ADA violation has in fact occurred,<br />

OASN(FM&C) will appoint a certified investigator(s) from the current<br />

roster to conduct a formal investigation. The formal investigation will be<br />

conducted in accordance with the provisions of the DOD FMR Vol. 14.<br />

The investigator is to be relieved of his or her day-to-day duties until the<br />

investigation is completed.<br />

a. Each command is to identify subject matter experts to provide<br />

assistance to the investigator, as required, in specific functional areas<br />

during the course of the investigation. These functional areas include<br />

contracting, accounting, funding document policies and procedures,<br />

legal, information technology systems, facilities management, and<br />

construction policies and procedures. While these individuals need not<br />

be certified ADA investigators, they should have adequate knowledge<br />

in the functional area and no vested interest in the outcome of the<br />

investigation.<br />

b. The activity where the potential violation occurred is to fund all<br />

costs associated with the investigation (travel, local travel, etc.) from<br />

activity operating funds. Additionally, the activity is to cooperate with<br />

the investigator, as required, to ensure a complete and expeditious<br />

conclusion of the investigation. This includes access to all documents,<br />

other information, individuals, and facilities within the activity that the<br />

investigator considers necessary in order to accomplish his or her<br />

mission.<br />

c. Each investigator is to submit monthly status reports describing the<br />

progress made on the investigation in the format of the DOD FMR<br />

Vol. 14, Chapter 6, Enclosure 6-1, Part II, to OASN(FM&C), FMB-5,<br />

by the end of each month.<br />

d. The formal ADA investigation report must be submitted to<br />

OUSD(C) by OASN(FM&C) no later than 9 months from the<br />
