Title 10 U.S.C. 2493 directs the Department of the Navy to operate Fisher<br />

Houses and Suites as a single NAFI. Section 914 of the FY 2001 National<br />

Defense Authorization Act limits appropriated fund support to base<br />

operating support at a level equivalent to that provided to MWR Category<br />

B community activities. SECNAVINST 7010.8 provides guidance for the<br />

establishment, management, and control of the Fisher House Program.<br />

FUND INSTRUMENTALITIES<br />

1. GENERAL<br />

The Department continues to emphasize the network of programs that<br />

support the quality of life (QOL) of our service members and their<br />

families. To that end, the Secretary of Defense established the Utilization,<br />

Support and Accountability (USA) practice to facilitate the effective use<br />

of funds for the Morale, Welfare and Recreation (MWR) program. The<br />

USA practice provides flexibility to both the activity commander and the<br />

MWR Program Manager that maximizes the availability of appropriated<br />

(APF) and nonappropriated (NAF) fund support to the MWR program.<br />

2. SCOPE<br />

This policy applies to all DON commands and activities with Operation<br />

and Maintenance appropriation (Operation & Maintenance, Navy/Marine<br />

Corps/Reserves (O&M,N; O&M,NR; O&M,MC; O&M,MCR) funding.<br />

3. <strong>POLICY</strong><br />

a. Commanding Officers have a fiduciary responsibility for the APF<br />

and NAF resources that support military MWR programs. Total<br />

program cost shall be accounted for through sound financial<br />

management practices.<br />

b. The Antideficiency Act, 31 United States Code (U.S.C.) 1341(a),<br />

1512-19, prohibits incurring of obligations in excess or in advance<br />

of available funds. The Purpose Statute, 31 U.S.C. 1301(a),<br />

requires APF to be used only for the purposes and programs for<br />

which appropriated. The bona fide need rule, 31 U.S.C. 1502,<br />

precludes the use of funds to purchase supplies or services to<br />

satisfy future year needs.<br />

c. By authority of 10 U.S.C. 2783, the Secretary of Defense<br />

prescribes regulations governing the purpose for which NAF funds<br />

may be spent, as well as the financial management of those funds<br />
