the Department of Justice on behalf of the Navy are financed in<br />

accordance with paragraph 2(a).<br />

3. COURTS-MARTIAL.<br />

Financial responsibility for costs incurred in support of courts-martial,<br />

courts of inquiry, and certain investigations convened under the provisions<br />

of the current issuance of JAGINST 5800.3, Manual for Courts-Martial,<br />

United States is assigned as follows:<br />

a. Travel, Per Diem, and Fees.<br />

(1) Navy and Marine Corps Personnel.<br />

Except for members of the Navy-Marine Corps Trial Judiciary<br />

when acting as military judges of a special or general courtmartial,<br />

the cost of travel and per diem (related to the conduct of<br />

courts) for Navy and Marine Corps military personnel and civilian<br />

employees of the DON will be charged to the operating budget<br />

which supports temporary additional duty travel for the Navy or<br />

Marine Corps convening authority.<br />

(2) Military Judges.<br />

The cost of travel and per diem for members of the Navy-Marine<br />

Corps Trial Judiciary, when acting as military judges of a special<br />

or general court-martial, will be charged to the operating budget of<br />

the Judge Advocate General.<br />

(3) Other Personnel.<br />

The cost of mileage and fees for civilians other than employees of<br />

the DON (also see par. 075183) will be charged to the operating<br />

budget that supports the Navy or Marine Corps convening<br />

authority.<br />

b. Services and Supplies.<br />

(1) Convening Authority.<br />

The resources of the convening authority will be charged with the<br />

costs of services or supplies provided by an activity in support of<br />

courts, as follows:<br />

1. in-house costs which are direct, out-of-pocket, identifiable,<br />

and which total $100 or more in a calendar month;<br />

2. costs which arise under contracts which are entered into in<br />

support of the courts.<br />

(2) Other.<br />

Costs not chargeable to the convening authority will be absorbed<br />
