(2) New construction of Bachelor Quarters (BQs) and BQ<br />

equivalent facilities is an investment and, therefore, funded by<br />

Commander, Naval Facilities Engineering Command (NAVFAC)<br />

in the Military Construction, Navy (MCON) appropriation.<br />

4. SOURCE DOCUMENTS.<br />

Navy policy on the adequacy, assignment, utilization and occupancy of<br />

Unaccompanied Personnel Housing (UPH) for ships undergoing overhaul<br />

or conversion is contained in the current issuance of OPNAVINST<br />

11103.1. For additional guidance relating to berthing and messing during<br />

CNO scheduled availabilities, see OPNAVINST 4700.38.<br />

075159 LEGAL COSTS<br />

1. LEGAL OFFICES.<br />

The General Counsel and immediate staff are funded by the Assistant for<br />

Administration to the Under Secretary of the Navy (AAUSN). Command<br />

counsel and other lawyers reporting to the General Counsel are funded by<br />

their commands.<br />

2. LITIGATION COSTS.<br />

a. Funding policy.<br />

(1) Litigation costs are considered expenses and are payable from<br />

the same funds used to fund the operating costs of the major<br />

command or subordinate activity.<br />

(2) Funding litigation expenses over and above salaries and<br />

administrative costs already budgeted is the responsibility of the<br />

major command or subordinate organization conducting the<br />

litigation regardless of whether the litigation resulted from an<br />

action, process, or procedure of their own personnel or of a<br />

separate, servicing organization. This will include actions of<br />

contracting personnel, and other Department of the Navy (DON)<br />

offices performing service functions as part of their mission<br />

responsibilities. As expenses, litigation costs are properly<br />

chargeable to the fiscal year funds in which costs are incurred.<br />

(3) Travel costs incurred by DON personnel in support of<br />

litigation are payable in accordance with paragraph 075183.<br />

b. Department of Justice.<br />
